अधिसूचना
क्रमांक RULE/170/2025-HOUSING. - छत्तीसगढ़ नगर तथा ग्राम निवेश अधिनियम, 1973 (क्र. 23 सन् 1973) की धारा 85 की उप-धारा (1), सहपठित धारा 24 की उप-धारा (3) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा, छत्तीसगढ़ भूमि विकास नियम, 1984 में निम्नलिखित और संशोधन करती है, जो उक्त अधिनियम की धारा 85 की उप-धारा (1) के अधीन अपेक्षित किये गये अनुसार पूर्व में ही प्रकाशित किया जा चुका है, अर्थात :-
संशोधन
उक्त नियमों में-
1. नियम 38 के उप-नियम (1) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाए, अर्थात् :-
''(1) भूमि उपयोग वर्गीकरण में परिसर का अनुज्ञात उपयोग -इस नियम के अन्य प्रावधानों के अध्याधीन रहते हुए, निम्नलिखित उद्योगों को आवासीय एवं वाणिज्यिक उपयोग परिक्षेत्रों में प्रतिबंधित किया जाता है,-
(एक) आवासीय उपयोग परिक्षेत्र में, रेड, ऑरेंज, ग्रीन एवं ब्लू श्रेणी में वर्गी—त उद्योगों को अनुमति नहीं दी जाएगी।
(दो) वाणिज्यिक उपयोग परिक्षेत्र में, रेड एवं ऑरेंज श्रेणी में वर्गी—त उद्योगों को अनुमति नहीं दी जाएगी।
टीप :- उद्योगों का रेड, ऑरेंज, ग्रीन, व्हाईट और ब्लू श्रेणियों में वर्गीकरण, छत्तीसगढ़ पर्यावरण संरक्षण मंडल द्वारा समय-समय पर अधिसूचित किए गए अनुसार होगा।''
2. परिशिष्ठ-ठ के खण्ड ठ-6 में, अंक ''100'' के स्थान पर, अंक ''1000'' प्रतिस्थापित किया जाए। नवा रायपुर अटल नगर, दिनांक 17 दिसम्बर 2025 क्रमांक RULE/170/2025-HOUSING .— भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में छत्तीसगढ़ भूमि विकास नियम, 1984 में संशोधन संबंधी इस विभाग की समसंख्यक अधिसूचना दिनांक 17-12-2025 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है।

NOTIFICATION
No. RULE/170/2025-HOUSING .— In exercise of the powers conferred by sub-section (1) of Section 85 read with sub-section (3) of Section 24 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973), the State Government, hereby, makes the following further amendment in the Chhattisgarh Bhumi Vikas Niyam, 1984, the same having been previously published as required by sub-section (1) of Section 85 of the said Adhiniyam, namely:-
AMENDMENT
In the said rules,-
1. For sub-rule (1) of rule 38, the following sub-rule shall be substituted, namely:-
"(1) Permitted use of premises in land use classification- Subject to other provisions of this rule, the following Industries shall be restricted in residential and commercial use zones,-
(i) Industries categorized under Red, Orange, Green and Blue category shall not be permitted in residential use zones.
(ii) Industries categorized under Red and Orange category shall not be permitted in commercial use zones.
Note:-The Categorization of Industries as Red, Orange, Green, White and Blue shall be as notified by Chhattisgarh Environment Conservation Board from time to time."
2. In clause L-6 of Appendix-L, for the figure "100", the figure "1000" shall be substituted.
