File No. RULE - 503 / 29 / 2025 - GAD-7.- छत्तीसगढ़ लोकतंत्र सेनानी सम्मान नियम, 2026 के संबंध में नियमों का निम्नलिखित प्रारूप , जिसे राज्य सरकार, छ.ग. लोकतंत्र सेनानी सम्मान अधिनियम , 2025 की धारा 10 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है , उक्त अधिनियम की धारा 10 की उप- धारा ( 1 ) द्वारा अपेक्षित किये गए अनुसार, उन समस्त व्यक्तियों , जिनके कि इससे प्रभावित होने की संभावना है , की जानकारी के लिए एतद्वारा प्रकाशित किया जाता है तथा एतद्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस सूचना के राजपत्र में प्रकाशन की तारीख से 30 दिवस के अवसान के पश्चात् विचार किया जायेगा ।
कोई आपत्ति या सुझाव , जो उक्त प्रारूप के संबंध में किसी व्यक्ति से , विनिर्दिष्टि कालावधि के पूर्व सचिव , छत्तीसगढ़ शासन, सामान्य प्रशासन विभाग, मंत्रालय , कक्ष क S-3-4 , महानदी भवन, नवा रायपुर अटल नगर , जिला रायपुर, के कार्यालय में, कार्यालयीन समय में प्राप्त हो, पर छत्तीसगढ़ शासन द्वारा विचार किया जाएगा।
नियम प्रारूप
1.
संक्षिप्त नाम विस्तार तथा प्रारंभ:- ( 1) ये नियम , छत्तीसगढ़ लोकतंत्र सेनानी सम्मान नियम , 2026 कहलाएंगे ।
(2 ) इनका विस्तार संपूर्ण छत्तीसगढ़ राज्य में होगा ।
( 3) ये नियम , राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. परिभाषाएं : -( 1 ) इन नियमों में , जब तक संदर्भ से अन्यथा अपेक्षित न हो, -
(क ) "अधिनियम " से अभिप्रेत है , छत्तीसगढ़ लोकतंत्र सेनानी सम्मान अधिनियम , 2025 ( क्रमांक 16 सन् 2025) ;
(ख) " प्ररूप " से अभिप्रेत है , इन नियमों से संलग्न प्ररूप;
( ग) " धारा " से अभिप्रेत है , उक्त अधिनियम की धारा;
(घ) " राज्य शासन " से अभिप्रेत है , छत्तीसगढ़ शासन ;
( 2) उन शब्दों और अभिव्यक्तियों के, जो इन नियमों में प्रयुक्त किए गए हैं किन्तु परिभाषित नहीं किए गए हैं , के वही अर्थ होंगे , जो अधिनियम में उनके लिए यथा समनुदेशित हैं । 3. इन नियमों के अधीन , निम्नलिखित व्यक्तियों को आजीवन मासिक सम्मान राशि की पात्रता होगी.-
(क) लोकतंत्र सेनानी;
( ख) दिवंगत लोकतंत्र सेनानी का पति / पत्नी;

4. ( 1 ) लोकतंत्र सेनानी, सम्मान राशि हेतु निम्नलिखित मानदण्डों के अनुसार पात्र होंगेः- (क) 1 माह से कम या उसकी समतुल्य अवधि के लिए निरूद्ध ₹8,000 /- प्रतिमाह (ख) 1 माह से अधिक किन्तु 5 माह से कम अवधि के लिए निरूद्ध ₹ 15,000 / - प्रतिमाह ( ग) 5 माह या उससे अधिक अवधि के लिए निरूद्ध
₹25,000 /- प्रतिमाह ( 2 ) दिवंगत लोकतंत्र सेनानियों के पति / पत्नी की दशा में , विहित सम्मान राशि के आधे की पात्रता होगी ।
( 3) सम्मान राशि का लाभ , जिला मजिस्ट्रेट छत्तीसगढ़ शासन , सामान्य प्रशासन विभाग द्वारा जारी स्वीकृति आदेश दिनांक से दिया जाएगा ।
5. ( 1) लोकतंत्र सेनानी की मृत्यु होने पर , उनकी अंत्येष्टि में जिला मजिस्ट्रेट द्वारा नामांकित एक प्रतिनिधि , जो द्वितीय श्रेणी के अधिकारी की श्रेणी से अनिम्न श्रेणी का ना हो , उनके सम्मान हेतु अनिवार्य रूप से उपस्थित रहेगा ।
( 2) लोकतंत्र सेनानी के मरणोपरांत , उनकी अंत्येष्टि के लिए रूपये 25,000 /- (रूपये पच्चीस हजार मात्र) की वित्तीय सहायता , उनके परिवार के प्रमुख को दी जाएगी ।
6.
लोकतंत्र सेनानी तथा उनके पति / पत्नी को , स्वतंत्रता संग्राम सैनिक के समान चिकित्सा सुविधा प्रदान की जायेगी ।
7. ( 1 ) सम्मान राशि प्राप्त करने हेतु, लोकतंत्र सेनानी या दिवगंत लोकतंत्र सेनानी के पति / पत्नी को राजनैतिक या सामाजिक कारणों से जेल या पुलिस थाने में निरुद्ध रहने के प्रमाण पत्र सहित , प्ररूप - एक में जिला मजिस्ट्रेट को आवेदन प्रस्तुत करना होगा । जेल की दशा में , जेल अधीक्षक का प्रमाणपत्र तथा पुलिस थाने की दशा में , जिला पुलिस अधीक्षक का प्रमाणपत्र संलग्न करना अनिवार्य होगा ।
( 2 ) आवेदक यदि शारीरिक या आर्थिक विपन्नता के कारण दस्तावेज प्राप्त करने में समर्थ न हो , तो उसके निवेदन पर दस्तावेज प्राप्त करने में जिला मजिस्ट्रेट आवश्यक सहयोग कर सकेगा ।
( 3) यदि जेल में निरुद्ध होने या जेल से छूटने का कोई अभिलेख उपलब्ध है और जेल अधीक्षक प्रमाणित करता है कि अन्य सुसंगत अभिलेख उपलब्ध नहीं हैं , तो निरुद्ध रहने की न्यूनतम अवधि मानकर सम्मान राशि स्वीकृत की जाएगी ।
( 4) जहाँ सम्मान राशि स्वीकृत की जा चुकी है , वहाँ दिवंगत लोकतंत्र सेनानी के पति / पत्नी , उक्त स्वतंत्रता सेनानी की मृत्यु संबंधी सूचना मिलने पर उनकी सम्मान राशि को प्राप्त करने के लिए पात्र हो जाएंगे ।
8. ( 1 ) इन नियमों के अधीन प्राप्त आवेदनों का परीक्षण करने तथा सम्मान राशि की छत्तीसगढ़ राजपत्र , दिनांक 20 मार्च 2026
292( 1) पात्रता / अपात्रता के संबंध में अनुशंसाएं करने के लिए , जिला स्तर पर एक समिति का गठन किया जाएगा ।
(2 ) समिति निम्नलिखित सदस्यों से मिलकर बनेगी : -
अध्यक्ष
( क) जिले के प्रभारी मंत्री
सदस्य सचिव
(ख ) जिला मजिस्ट्रेट
सदस्य
( ग ) जिला पुलिस अधीक्षक
सदस्य
(घ) जिला जेल अधीक्षक
समिति यह सुनिश्चित करेगी कि सम्मान राशि केवल उन व्यक्तियों को ही प्राप्त हो , जो मीसा या डी.आई.आर कानून के अधीन राजनैतिक या सामाजिक कारणों से निरुद्ध हुए थे तथा उनका तत्समय पुलिस रिकार्ड में कोई पृथकतः आपराधिक या असामाजिक गतिविधियों का इतिहास नहीं था ।
(3 ) उप - नियम ( 2 ) में विनिर्दिष्ट समिति द्वारा की गई अनुशंसाओं के आधार पर , जिला मजिस्ट्रेट द्वारा सम्मान राशि स्वीकृत / अस्वीकृत किए जाने का आदेश जारी किया जाएगा । जिन व्यक्तियों को सम्मान राशि स्वीकृत की जाएगी , उन्हें एक परिचय पत्र जैसे "लोकतंत्र सेनानी सम्मान राशि पात्रता कार्ड " जिला मजिस्ट्रेट द्वारा जारी किया जाएगा । 9. ( 1 ) जिला मजिस्ट्रेट द्वारा जारी किए गए आदेश से व्यथित व्यक्ति, ऐसे आदेश की तारीख से 30 दिनों के अंदर , प्ररूप - दो में राज्य सरकार को अभ्यावेदन प्रस्तुत कर सकेगा । ( 2 ) राज्य सरकार , उप - नियम ( 1 ) के अधीन प्राप्त अभ्यावेदनों का गुणदोष के आधार पर निराकरण , ऐसे अभ्यावेदन की प्राप्ति की तारीख से 45 दिनों के अंदर करेगी और राज्य सरकार का विनिश्चय अंतिम एवं बाध्यकारी होगा ।
10. ( 1 ) इन नियमों के अधीन स्वीकृत सम्मान राशि, निम्नलिखित आधारों पर रोकी या निरस्त की जा सकेगी, -
( क) नैतिक अधमता से संबंधित किसी अपराध तथा राष्ट्र विरोधी क्रियाकलापों में भाग लेना;
( ख) किसी अपराध में दण्ड;
( ग) अधिनियम के अधीन किसी अपात्रता के बावजूद सम्मान राशि प्राप्त करना;
( घ) मिथ्या जानकारी तथा मिथ्या शपथ - पत्र प्रस्तुत करना ।
(2 ) नियम 8 के उप - नियम ( 2 ) में विनिर्दिष्ट समिति, या तो शिकायत या अभ्यावेदन प्राप्त होने पर या स्वप्रेरणा से प्राप्त की गई सूचना के आधार पर सुनवाई का युक्तियुक्त अवसर प्रदान करते हुए संबंधित व्यक्ति के प्रकरण की जाँच कर सकेगी ।
( 3 ) समिति की अनुशंसा के आधार पर , सम्मान राशि स्वीकृति आदेश को निरस्त करने की शक्ति जिला मजिस्ट्रेट को होगी । 292 ( 2)

( 4) जिला मजिस्ट्रेट के आदेश से व्यथित कोई व्यक्ति, नियम 9 के उप - नियम ( 1 ) के अधीन अभ्यावेदन प्रस्तुत कर सकेगा , जिसका निराकरण , नियम 9 के उप- नियम ( 2) के अनुसार में किया जाएगा ।
(5) जहाँ कोई व्यक्ति इन नियमों के अधीन अपात्र होने के बावजूद गलत जानकारी के आधार पर सम्मान राशि या सुविधाएं प्राप्त करता है, तो स्वीकृति आदेश निरस्त करते हुए संबंधित व्यक्ति से प्राप्त की गई सम्मान राशि या सुविधाएं वसूलनीय होंगी । यदि संबंधित व्यक्ति द्वारा प्राप्त की गई राशि वापस नहीं की जाती है , तो उसे भू- राजस्व के बकाया की भांति वसूल किया जा सकेगा ।
11. निम्नलिखित व्यक्ति, सम्मान राशि प्राप्त करने के लिए पात्र नहीं होंगे.-
( 1) कोई व्यक्ति, जो राजनैतिक या सामाजिक कारणों से भिन्न कारणों से जेल या पुलिस थाने में निरुद्ध किया गया था;
( 2) कोई व्यक्ति , जिसने मिथ्या जानकारी या प्रमाण पत्र प्रस्तुत किया है या जिसने सम्मान राशि एवं अन्य सुविधाएं प्राप्त करने हेतु अपनी या किसी अन्य व्यक्ति की पात्रता स्थापित करने के लिए मिथ्या जानकारी या प्रमाणपत्र या प्रस्तुत किया हो ।
12. दिवंगत लोकतंत्र सेनानी के पति या पत्नी को स्वीकृत सम्मान राशि का संदाय , उनकी मृत्यु की तारीख तक ही किया जाएगा ।
13. कोषालय संहिता और सरकारी पेंशन भोगियों को लागू होने वाले नियमों के उपबंध , इन नियमों के अधीन सम्मान राशि प्राप्त करने वालों पर भी लागू होंगे ।
14. इन नियमों के अधीन स्वीकृत सम्मान राशि पर होने वाला व्यय , मांग संख्या 02 , मुख्य शीर्ष 2235- सामाजिक सुरक्षा और कल्याण , उप - मुख्य शीर्ष 60 - अन्य सामाजिक सुरक्षा और कल्याण कार्यक्रम , लघु शीर्ष 800 - अन्य व्यय , योजना शीर्ष 7297- लोकनायक जयप्रकाश नारायण सम्मान निधि, उद्देश्य शीर्ष 13 - आर्थिक सहायता , विस्तृत शीर्ष 001 - प्रत्यक्ष सहायता के अंतर्गत विकलनीय होगा ।
15 . इन नियमों के राजपत्र में प्रकाशित होने की तारीख से 90 दिनों के अन्दर पात्र व्यक्तियों को अपना आवेदन प्रस्तुत करना होगा ।
16. पूर्व में लोकनायक जयप्रकाश नारायण ( मीसा /डी.आई.आर . राजनैतिक या सामाजिक कारणों से निरुद्ध व्यक्ति) सम्मान निधि नियम , 2008 के अंतर्गत निराकृत प्रकरण , इन नियमों के अंतर्गत निराकृत माने जाएंगे । ऐसे व्यक्तियों को , नए आवेदन प्रस्तुत करने की आवश्यकता नहीं होगी;
परन्तु जो आवेदन लंबित हैं , इन नियमों के अंतर्गत निराकृत किये जाएंगे ।

NOTICE
File No. RULE - 503 / 29 / 2025 - GAD- 7.- The following draft of Rules regarding the Chhattisgarh Fighters of democracy Samman Rules , 2026 , which the State Government , in exercise of the powers conferred by Section 10 of the Chhattisgarh Loktantra Senani Samman Adhiniyam, 2025 , proposes to make , hereby, published as required by sub - section ( 1 ) of Section 10 of the said Adhiniyam, for the information of all persons likely to be effected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of 30 days from the date of publication of this notice in the Official Gazette .
Any objections or suggestions regarding the said draft received from any person , before the specified period , during office hours in the office of the Secretary, Government of Chhattisgarh , General Administration Department , Mantralaya, Room number S - 3-4 , Mahanadi Bhawan , Nava Raipur Atal Nagar, District Raipur, shall be taken into consideration by the Government of Chhattisgarh .
DRAFT RULES
1. Short title , Extent and Commencement.- ( 1 ) These rules may be called the Chhattisgarh Loktantra Senani Samman Rules , 2026 .
(2 ) They shall extend to the whole State of Chhattisgarh .
(3 ) They shall come into force from the date of their publication in the Official Gazette .
2. Definitions.- ( 1 ) In these rules , unless the context otherwise requires , - ( a) " Act " means the Chhattisgarh Loktantra Senani Samman Adhiniyam , 2025 (No. 16 of 2025 ) ;
( b) " Form " means the form appended to these rules ;
(c) " Section " means Section of the said Adhiniyam ;
( d) " State Government " means the Government of Chhattisgarh ;
(2 ) Words and expressions used but not defined in these rules shall have the same meanings as assigned to them in the Adhiniyam .
3. Under these rules , the following persons shall be eligible for lifetime monthly 292 ( 6)

( a) Fighters of Democracy ;
(b) Spouse of late Fighters of Democracy ;
4. ( 1 ) Fighters of democracy shall be eligible for honour money according to the following criteria: -
(a) Detained for period less than or equivalent to 1 month-
₹ 8,000/- per month .
(b)
₹ 15,000/- permonth.
Detained for period more than 1 months but less than 5 month-
(c) Detained for period of 5 months or more-
₹ 25,000/ - per month .
( 2)
In case of spouses of deceased fighters of democracy , the eligibility shall be half of the prescribed honour money.
(3 ) The benefit of honour money shall be given from the date of sanction order issued by the District Magistrate / General Administration Department , Government of Chhattisgarh .
5. ( 1 ) On the death of a Fighter of democracy , a representative nominated by the District Magistrate , who shall not be lower in rank than a Class - II Officer , shall be mandatorily present at his funeral to pay him/ her respects .
(2 ) After the death of a Fighter of democracy , a financial assistance of 25,000 / - ( Rupees Twenty Five Thousand only ) shall be given to the head of the family for his / her funeral .
6. Fighters of democracy and their spouses shall be given medical facilities similar to Freedom Fighters .
7. ( 1 ) To receive the honour money , the Fighters of democracy or spouse of deceased fighter of democracy has to submit an application in Form - I to the District Magistrate along with a certificate of him/ her being detained in jail or police station for political or social reasons . In case of jail , it shall be mandatory to attach the certificate of the Jail Superintendent and in case of police station , the certificate of the District Superintendent of Police.

292 ( 7) ( 2 ) If the applicant is not able to obtain the documents due to physical or financial constraints , The District Magistrate may provide necessary assistance in obtaining the documents on his request .
(3 ) If any record of detention in jail or release from jail is available and the Superintendent of Jail certifies that other relevant records are not available , the honour money shall be sanctioned considering the minimum period of detention .
(4 ) Where the honour money has been sanctioned , the spouse of deceased Fighters of democracy shall be eligible to receive his /her honour money upon intimation regarding the death of the said Fighters of democracy .
8. ( 1 ) A committee shall be constituted at the district level for examination of applications received under these rules and make recommendations regarding eligibility/ ineligibility for the award of honour money .
( 2) The committee shall comprise of the following members : -
Chairman
(a) Minister in - charge of the district
(b ) District Magistrate
Member secretary
Member
( c) District Superintendent of Police
Member
( d) District Jail Superintendent
The committee shall ensure that the honour money is given only to those persons who were detained under MISA or DIR law for political or social reasons and they do not have any separate history of criminal or anti - social activities in the police records at that time .
( 3 ) On the basis of the recommendations made by the Committee specified in sub - rule ( 2 ) , the District Magistrate shall issue an order to sanction / reject the honour money. The persons to whom the honour money is sanctioned , an identity card , i.e. "Fighters of democracy Samman Rashi Eligibility Card " shall be issued by the District Magistrate .
9. ( 1 ) Any person aggrieved by the order passed by the District Magistrate , may submit a representation to the State Government in Form - II within 30 days from the date of the order .
(2 ) The State Government shall dispose of the representations received under sub - rule ( 1 ) upon merits within 45 days from the date of receipt of such representation and the decision of the State Government shall be final and binding .

10. ( 1 ) The honour money granted under these rules may be withheld or cancelled on the following grounds , -
(a ) Participation in any crime involving moral turpitude and anti - national activities ;
(b ) Convicted for any offence ;
( c ) Received honour money despite being ineligible under the Act ;
(d ) Giving false information and false affidavit .
(2 ) The committee specified in sub - rule ( 2 ) of rule 8 may , either upon receipt of a complaint or representation or suo - moto , inquire into the case of the concerned person after affording him a reasonable opportunity of being heard .
(3 ) The District Magistrate shall have the power to cancel the order sanctioning honour money on the basis of the recommendation of the Committee .
(4 ) Any person aggrieved by the order of the District Magistrate may submit a representation under sub - rule ( 1 ) of rule 9 , which shall be disposed of in accordance with sub - rule (2 ) of rule 9 .
( 5 ) Where a person receives honour money or facilities on the basis of incorrect information despite being ineligible under these rules , the honour money or facilities received shall be recoverable from the concerned person by cancelling the approval order . If the amount received by the concerned person is not recovered , it may be recoverable as arrears of land revenue .
11. The following persons shall not be eligible to receive the honour money.- ( 1 ) Any person who was detained in a prison or police station for reasons other than political or social reasons .
(2) Any person who has furnished false information or certificate or has furnished any false information to establish his or any other person's eligibility for receiving honour money and other facilities .
12. The payment of honour money sanctioned to the husband or wife of a deceased Fighter of democracy shall be made up to the date of his / her death .
13. The provisions of the Treasury Code and the rules applicable to Government pensioners , shall also apply to those receiving honour money under these rules .

292 ( 9) 14. The expenditure on honour money sanctioned under these rule shall be deducted under Demand No. 02 , Major Head 2235- Social Security and Welfare , Sub - Major Head 60 - Other Social Security and Welfare Programmes , Minor Head 800 - Other Expenditure , Plan Head 7297 - Lok Nayak Jayaprakash Narayan Samman Nidhi , Objective Head 13 - Financial Assistance , Detailed Head 001 - Direct Assistance .
15. Eligible persons shall have to submit their applications within 90 days from the date of publication of these rules in the Official Gazette .
16. The cases disposed of earlier under Loknayak Jayaprakash Narayan (MISA/ DIR Political or Socially Detained Persons ) Samman Nidhi Rules , 2008 shall be considered disposed of under these rules . Such persons shall not be required to submit fresh applications ;
Provided that pending applications shall be disposed of under these rules .
