क्रमांक GENCOR-35/761/2025-HOME SECTION. विधि विरूद्ध क्रिया-कलाप (निवारण) अधिनियम, 1967 (1967 को 37) की धारा 45 की उप-धारा (2) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्द्वारा जांच के दौरान एकत्रित साक्ष्यों की स्वतंत्र समीक्षा करने तथा अभियोजन की स्वीकृति प्रदान करने हेतु राज्य सरकार को अनुशंसा करने के उद्देश्य से समीक्षा प्राधिकरण का गठन करती है, जिसके निम्नलिखित सदस्य होंगे :-
01. उच्च न्यायालय के सेवानिवृत्त न्यायाधीश - अध्यक्ष
02. प्रमुख सचिव/अतिरिक्त सचिव, - सदस्य विधि एवं विधायी कार्य विभाग, छत्तीसगढ़ शासन, मंत्रालय, महानदी भवन, नवा रायपुर, अटल नगर।
समीक्षा प्राधिकरण, जांच अधिकारी द्वारा भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) के अधीन एकत्रित किए गए साक्ष्य की प्राप्ति की तारीख से 07 कार्य दिवसों के अन्दर अपनी अनुशंसाओं सहित सहित अपनी रिपोर्ट देगा, जैसा कि केंद्रीय सरकार द्वारा विधि विरूद्ध क्रियाकलाप (निवारण) (अभियोजन की सिफारिशें और मंजूरी) नियम, 2008 के अनुसार, भारत के असाधारण राजपत्र में जारी अधिसूचना संख्या क्र.आ. 3014(अ), दिनांक 31 दिसंबर, 2008 में आंतरिक सुरक्षा विभाग, गृह मंत्रालय, भारत सरकार, नई दिल्ली द्वारा अधिसूचित किया गया है।
तद्नुसार पुलिस महानिदेशक, छत्तीसगढ़, नवा रायपुर, प्रकरण में आगे आवश्यक कार्यवाही करेंगे। Nava Raipur Atal Nagar, the 9th April 2026
NOTIFICATION
No. GENCOR-35/761/2025-HOME SECTION. In exercise of the powers conferred by sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act, 1967 (No. 37 of 1967), the State Government hereby constitute the Review Authority for the Purpose of independent review of the evidence gathered during the course of Investigation and to make recommendation to the State Government for sanction of prosecution, Consisting of the following members:-
(1) A Retired High Court Judge - Chairperson (2) The Principal Secretary/Additional Secretary - Member
Law and Legislative, Affairs Department, Government of Chhattisgarh, Mantralaya, Mahanadi Bhawan, Nava Raipur, Atal Nagar.
The Review Authority shall submit its report, containing its recommendations, to the State Government within 7 working days from the date of receipt of the evidence Collected by the investigating Officer under the Code of Bharatiya Nagarik Suraksha Sanhita, 2023 (No. 46 of 2023) in accordance with the Unlawful Activities (Prevention) (Recommendation and Sanction of Prosecution) Rules, 2008 notified in the Extraordinary issue of Gazette of India vide Notification No.S.0.3014(E), dated 31 December, 2008, by the Department of Internal Security, Ministry of Home Affairs, Government of India, New Delhi.
The Director General of Police, Chattisgarh State, Nava Raipur shall take further necessary action in the matter accordingly.
