छत्तीसगढ़ गृह निर्माण मंडल (संशोधन) अधिनियम, 2026
छत्तीसगढ़ गृह निर्माण मंडल अधिनियम , 1972 (क्र. 3 सन् 1973 ) में और संशोधन करने हेतु अधिनियम । भारत गणराज्य के सतहत्तरवें वर्ष में छत्तीसगढ़ विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो। 1.
(1)
संक्षिप्तनाम तथाप्रारंभ.
यह अधिनियम छत्तीसगढ़ गृह निर्माण मंडल (संशोधन) अधिनियम, 2026
कहलाएगा।
(2) यह राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा।
प्रोद्धरण का संशोधन.
2. छत्तीसगढ़ गृह निर्माण मंडल अधिनियम, 1972 (क्र. 3 सन् 1973 ) के उद्धरण (जो इसमें इसके पश्चात् मूल अधिनियम के रूप में निर्दिष्ट है) में, शब्द एवं अंक "छत्तीसगढ़ गृह निर्माण मंडल अधिनियम, 1972 " के स्थान पर, शब्द एवं अंक "छत्तीसगढ़ गृह निर्माण एवं अधोसंरचना विकास मंडल अधिनियम , 1972 " प्रतिस्थापित किएजाएं।
बृहत नाम का प्रतिस्थापन, 3. मूल अधिनियम के बृहत नाम के स्थान पर, निम्नलिखित वृहत नाम प्रतिस्थापित किया जाए, अर्थात्:-
"छत्तीसगढ़राज्य में आवासीय आवश्यकता के समाधान और उसके संबंध में उपाय करने एवं अधोसंरचना विकास स्कीमों को उपक्रमित करने हेतु गृह निर्माण और अधोसरंचना विकास मण्डल के, निगमन तथा विनियमन के लिए तथा उससे संबंधित विषयों के लिए उपबंध करने हेतु अधिनियम । "
धारा 1 का संशोधन.
4. मूल अधिनियम की धारा 1 की उप-धारा (1) में, शब्द एवं अंक "छत्तीसगढ़ गृह निर्माण मंडल अधिनियम, 1972" के स्थान पर, शब्द एवं अंक "छत्तीसगढ़ गृह निर्माण एवं अधोसंरचना विकास मंडल अधिनियम, 1972 " प्रतिस्थापित किए जाएं ।
5. मूल अधिनियम की धारा 2 में,
धारा 2 का संशोधन.
(क) खण्ड (3 ) में, शब्द "गृह निर्माण मण्डल " के स्थान पर शब्द "गृह निर्माण एवं अधोसंरचना विकास मण्डल" प्रतिस्थापित किये जाएं: (ख) खण्ड (7 -क) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाए, अर्थात्ः- छत्तीसगढ़ राजपत्र, दिनांक 24 अप्रैल 2026
398 ( 1 ) "(7-क) "अधोसंरचना विकास स्कीमों " से अभिप्रेत है तथा इसमें सम्मिलित है सड़कों, पुलों, हवाई अड्डों, मलजल एवं नगर स्तर की जल प्रदाय प्रणालियों के निर्माण की स्कीमें तथा अन्य अधोसंरचना विकासस्कीमें; "
(ग) खण्ड (9 ) में, शब्द "गृह निर्माण स्कीम" जहां कही भी आये हो के स्थान पर, शब्द 'गृह निर्माण एवं अधोसंरचना विकास स्कीम" प्रतिस्थापित किये जाएं।

धारा 3 का संशोधन.
मूल अधिनियम की धारा 3 में, शब्द "गृह निर्माण मण्डल" जहां कहीं भी आये हों, के स्थान पर शब्द "गृह निर्माण एवं अधोसंरचना विकास मण्डल " प्रतिस्थापित किये जाएं।
7.
शीर्षकका मूल अधिनियम के अध्याय 5 के शीर्षक के स्थान पर निम्नलिखित शीर्षक प्रतिस्थापित किया जाए, अर्थात्ः-
अध्याय 5 के संशोधन.
"गृह निर्माण और अधोसंरचना विकास स्कीमों पर व्यय करने और संविदा करने की मण्डल, अध्यक्ष तथा गृह निर्माण आयुक्त की शक्तियाँ । "
8.
अध्याय 6 के मूल अधिनियम के अध्याय 6 के शीर्षक के स्थान पर निम्नलिखित शीर्षक प्रतिस्थापितकिया जाए, अर्थात्ः-
शीर्षकका संशोधन.
"गृहनिर्माण स्कीमें तथा अधोसंरचना विकास स्कीमें।"
9.
धारा 31 का संशोधन.
मूल अधिनियम की धारा 31 में, शब्द "गृह निर्माण स्कीमों और विकास स्कीमों " जहां कहीं भी आये हों के स्थान पर शब्द एवं चिन्ह "गृह निर्माण स्कीमों तथा/या अधोसंरचनाविकास स्कीमों" प्रतिस्थापित किये जाएं ।
10.
धारा 32 का संशोधन.
मूल अधिनियम की धारा 32 में, शब्द "गृह निर्माण स्कीमों और विकास स्कीमों" जहां कहीं भी आये हों के स्थान पर शब्द एवं चिन्ह "गृह निर्माण स्कीमों तथा/या अधोसंरचना विकास स्कीमों " प्रतिस्थापित किये जाएं ।
11.
धारा 33 -क की मूल अधिनियम की धारा 33 के पश्चात्, निम्नलिखित धारा अंतःस्थापित किया जाए, अर्थात्ः-
नईधाराका अंतःस्थापन.
"33-क. अधोसंरचना विकास स्कीमों द्वारा किये जाने वाले विषय- तत्समय प्रवृत किसी अन्य विधि में अंतर्विष्ट किसी बात के होते हुए भी अधोसंरचना विकास स्कीम में निम्नलिखित समस्त विषयों या उनमें से किसी छत्तीसगढ़ राजपत्र , दिनांक 24 अप्रैल 2026

भी विषय के लिये उपबंध हो सकेंगे , अर्थात्:-
(क) अध, संरचना विकास हेतु, जिसमें पुलों, सड़कों , राजमार्गो, हवाई अड्डों, जल प्रदाय तथा मलवहन प्रणालियाँ अथवा अन्य अधोसंरचना विकास गतिविधियाँ सम्मिलित हों, स्कीमों एवं परियोजनाओं को तैयार करना, सूत्रबद्ध करना तथा कार्यान्वित करना ।
(ख) मास्टर प्लान कार्यान्वित तथा नगर निवेश स्कीमों (टी.पी.एस. )/नगर विकास स्कीमों (टी.डी.एस. ) को तैयार करना, सूत्रबद्ध करना तथा कार्यान्वित करना ।
(ग) छत्तीसगढ़ नगरपालिक निगम अधिनियम, 1956 (क्र. 23 सन् 1956) छत्तीसगढ़ नगर पालिका अधिनियम, 1961 (क्र. 37 सन् 1961 ) और छत्तीसगढ़ पंचायती राज एवं ग्राम स्वराज अधिनियम, 1993 (क्र. 1 सन् 1994) के अधीन गठित स्थानीय निकायों, छत्तीसगढ़ नगर तथा ग्राम निवेश अधिनियम, 1973 (क्र. 3 सन् 1973 ) के अधीन गठित नगर विकास प्राधिकरणों तथा ऐसे ही अन्य संगठनों को उनकी तकनीकी तथा आंतरिक क्षमताओं तथा उनके वित्तीय संसाधनों में सुधार के लिये सहायता तथा परामर्श सेवाएँ उपलब्ध कराना ।
(घ) मंडल, विद्यमान कॉलोनियों, जीर्ण-शीर्ण भवनों अथवा अल्पप्रयुक्त भूमियों के पुनर्विकास की परियोजनाओं को उपक्रमित कर सकेगा; आवास तथा संबद्ध अधोसंरचना हेतु सार्वजनिक-निजी भागीदारी आधारित परियोजनाओं को उपक्रमित कर सकेगा; तथा स्लम के पुनर्विकास सहित राज्य शासन द्वारा सौंपे गए किसी अन्य परियोजना काभी क्रियान्वयन कर सकेगा । "
12.
मूल अधिनियम की धारा 34 - क में
धारा 34-क का संशोधन.
(क) पार्श्व शीर्षक के स्थान पर, निम्नलिखित पार्श्व शीर्षक प्रतिस्थापित किया जाए, अर्थात्ः-
"अधोसंरचना विकास स्कीमें। "
(ख) उप- धारा ( 1 ) के स्थान पर, निम्लिखित उप- धारा प्रतिस्थापित किया जाए, अर्थात्:-
" ( 1 ) मंडल की, जब कभी राज्य सरकार या स्थानीय निकाय या विकास प्राधिकरण के अनुरोध पर या स्वविवेक पर यह राय हो कि छत्तीसगढ़ राजपत्र, दिनांक 24 अप्रैल 2026
398 किसी क्षेत्र में अधोसंरचना विकास स्कीम आरंभ करना समीचीन है तो मण्डल ऐसीविकास स्कीम बना सकेगा । "
(ग) उप-धारा (4) में, शब्द "विकास स्कीम" के स्थान पर, शब्द "अधोसंरचना विकास स्कीम" प्रतिस्थापित किये जाएं।
13.
धारा 35 का संशोधन.
मूल अधिनियन की धारा 35 की उप- धारा (2) के खण्ड (क) में, शब्द "विकास स्कीमों" के स्थान पर, शब्द " अधोसंरचना विकास स्कीमों " प्रतिस्थापित किये जाएं।
14.
धारा 37 का संशोधन.
मूल अधिनियम की धारा 37 मे प्रथम परंतुक में शब्द "विकास स्कीमों" के स्थान पर, शब्द"अधोसंरचना विकास स्कीमों" प्रतिस्थापित किये जाएं।
15.
धारा 44 का संशोधन.
मूल अधिनियम की धारा 44 में शब्द "गृह निर्माण स्कीमों " जहां कहीं भी आए हों, के स्थान पर, शब्द ' गृह निर्माण स्कीमों एवं अधोसंरचना विकास स्कीमों" प्रतिस्थापित किये जाएं।
16.
धारा 50 का संशोधन, मूल अधिनियम की धारा 50 की उप-धारा ( 1 ) के स्थान पर, निम्लिखित उप -धारा प्रतिस्थापित किया जाए, अर्थात्ः-
"(1) मण्डल किसी गृह निर्माण स्कीम से समाविष्ट किए गये क्षेत्र में या किसी लगे हुए क्षेत्र में या किसी अन्य गैर- आवासीय स्कीम में , या राज्य शासन द्वारा सौंपे/ प्रस्तावित किये गये किसी अन्य परियोजना में स्थित किसी भूमि या भूमि काभाग,विकसित भू-खण्ड, भवन या उसके किसी प्रकोष्ठ या अन्य संपत्ति को रखे रह सकेगा, या पट्टे पर दे सकेगा , उसका विक्रय कर सकेगा, विनिमय कर सकेगाया पुनर्गठन कर सकेगा या अन्यथा व्ययन कर सकेगा " ।
17.
धारा 62 का संशोधन, मूल अधिनियम की धारा 62 की उप- धारा (3 ) में, शब्द "गृह निर्माण स्कीम" के स्थान पर, शब्द "गृह निर्माण एवं अधोसंरचना विकास स्कीम" प्रतिस्थापित किये जाएं।
18.
धारा 76 का संशोधन.
मूल अधिनियम की धारा 76 में, शब्द "गृह निर्माण स्कीमों" के स्थान पर, शब्द "गृहनिर्माण एवं अधोसंरचना विकास स्कीमों" प्रतिस्थापित किये जाएं।

THE CHHATTISGARH GRIHA NIRMAN MANDAL ( SANSHODHAN )
ACT, 2026
An Act further to amend the Chhattisgarh Griha Nirman Mandal Adhiniyam , 1972 ( No. 3 of 1973 ) .
Be it enacted by the Chhattisgarh Legislature in the Seventy seventh Year of the Republic of India, as follows :-
1.
commencement .
(1) This Act may be called the Chhattisgarh Griha Short title and Nirman Mandal ( Sanshodhan) Adhiniyam , 2026 .
(2) It shall come into force from the date of its publication in the Official Gazette .
2.
citation . Amendment of In the citation of the Chhattisgarh Griha Nirman Mandal Adhiniyam , 1972 (No. 3 of 1973 ) ( hereinafter referred to as the Principal Act) , words and figure " The Chhattisgarh Griha Nirman Mandal Adhiniyam , 1972 " , the words and figure " The Chhattisgarh Griha Nirman Evam Adhosanrachana Vikas Mandal Adhiniyam , 1972 " shall be substituted .

Substitution of long title .
For the long title of the Principal Act , the following long title shall be substituted, namely:-
" An Act to provide for the incorporation and regulation of a Housing and Infrastructure Development Board in the State of Chhattisgarh for the purpose of taking measures to deal with and satisfying the need of housing accommodation and to undertake infrastructure development scheme and for matters connected therewith . "
4.
Amendment of Section 1 .
In sub - section ( 1 ) of Section 1 of the Principal Act, for the words and figure " The Chhattisgarh Griha Nirman Mandal Adhiniyam , 1972 " , the words and figure " The Chhattisgarh Griha Nirman Evam Adhosanrachana Vikas Mandal Adhiniyam , 1972 " shall be substituted .

In Section 2 of the Principal Act , -
Amendment of Section 2 .
(a) In clause (3 ) , for the words " Housing Board " , the words " Housing and Infrastructure Development Board " shall be substituted ;
(b) For clause ( 7 -a) , the following clause shall be substituted , namely : -
"(7 - a) " Infrastructure Development Schemes " means and includes schemes of construction of roads , bridges , airports , sewage and city level water supply system and other infrastructure development schemes ; "

Amendment of Section 3 .
In Section 3 of the Principal Act , for the words "Housing Board " , wherever they occur, the words "Housing and Infrastructure Development Board " shall be Substituted .
7.
Amendment of Heading of Chapter V. For the heading of Chapter V of the Principal Act , the following heading shall be substituted, namely:-
" POWERS OF BOARD , CHAIRMAN AND HOUSING COMMISSIONER TO INCUR EXPENDITURE ON HOUSING AND SCHEMES AND INFRASTRUCTRURE CONTRACTS . " DEVELOPMENT ENTER INTO
8.
Amendment of Heading of Chapter VI .
For the heading of Chapter VI of the Principal Act , the following heading shall be substituted , namely :-
" HOUSING SCHEMES AND INFRASTRUCTURE DEVELOPMENT SCHEMES . "
9.
Amendment of Section 31 .
In Section 31 of the Principal Act, for the words "Housing and Development Schemes " , wherever they occur, the words and symbol "Housing Schemes and/ or Infrastructure Development Schemes " shall be substituted.
10.
Amendment of Section 32 .
In Section 32 of the Principal Act, for the words "Housing Schemes and Development Schemes " , wherever they occur , the words and symbol "Housing Schemes Infrastructure Development Schemes " shall be substituted . and/or
11 .
After Section 33 of the Principal Act , the following Section shall be inserted , namely : -
Insertion of New Section 33 -Α .

398 " 33 - A . Matters to be dealt with by the Infrastructure Development Scheme . Notwithstanding anything contained in any other law for the time being in force , infrastructure development scheme may provide for all or any of the following matters , namely: -
(a) To prepare , formulate and implement schemes and project for infrastructure development including bridges , roads , highways , airports , water supplies and sewage systems or other infrastructure development activities ;
( b) To implement master plans and_to prepare , formulate , and implement Town Planning Schemes (T.P.S)/ Town Development Schemes (T.D.S ) ;
(c) To provide assistance and consultancy services to Local Bodies constituted under the Chhattisgarh Municipal Corporation Act , 1956 (No. 23 of 1956) , the Chhattisgarh Municipalities Act, 1961 (No.37 of 1961) and the Chhattisgarh Panchayat Raj Avam Gram Swaraj Adhiniyam , 1993 (No.1 of 1994) , Urban Development Authorities constituted under the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam , 1973 (no.3 of 1973 ) and such other organizations for improving their technical and internal capacity and their financial resources ;
(d) The Board may undertake re- development projects of existing colonies , obsolete buildings , or underutilized lands ; undertake Public- Private Partnership projects for housing and allied infrastructure ; and slum छत्तीसगढ़ राजपत्र, दिनांक 24 अप्रैल 2026

redevelopment , as well as any other project assigned by the State Government . "

In Section 34 -A of the Principal Act , -
Amendment of Section 34 - A .
(a) For the marginal heading , the following marginal heading shall be substituted , namely: -
" Infrastructure Development Schemes . " ;
(b) For sub - section ( 1 ) , the following sub- section shall be substituted , namely : -
" ( 1 ) Whenever the Board is of the opinion, on the basis of request made by the State Government or request made by Local Body or Development Authority or on its on motion , that it is expedient to take up infrastructure development scheme in any area, the Board may frame such Development Scheme . "
(c) In sub - section (4) , for the words " development scheme " , the words " infrastructure development scheme " shall be substituted .
13.
Amendment of Section 35 .
In clause (a) of sub - section (2 ) of Section 35 of the Principal Act , for the words " development schemes" , the words " infrastructure development schemes " shall be substituted .
14.
Section 37 . Amendment of In the first proviso of Section 37 of the Principal Act , for the words " development schemes " the words" Infrastructure development schemes " shall be substituted .
15.
Amendment of Section 44 .
In Section 44 of the Principal Act, for the words "housing schemes " , wherever they occur, the words " housing schemes and infrastructure छत्तीसगढ़ राजपत्र, दिनांक 24 अप्रैल 2026

16.
Section 50 . Amendment of For sub - section ( 1 ) of Section 50 of the Principal Act , for the following sub - section shall be substituted , namely : -
"( 1 ) The Board may retain or may lease , sell , exchange , reorganize or otherwise dispose of any land or part of land , developed plots , building or any other apartment therein or other property situated in the area comprised in any housing scheme or in any adjoining area or any other non - residential scheme or any other project assigned/ proposed by the State Government . "
17 .
Amendment of Section 62 .
In sub - section ( 3 ) of Section 62 of the Principal Act , for the words " housing scheme " , the words "housing and infrastructure development scheme " shall be substituted .
18.
Amendment of Section 76 .
In Section 76 of the Principal Act , for the words "housing schemes " , the words " housing and infrastructure development schemes " shall be substituted .
