क्रमांक F RULE/6/2025-TRANSPORT-Part(2). छत्तीसगढ़ मोटरयान नियम, 1994 में और संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार, मोटरयान अधिनियम, 1988 (1988 का 59) की धारा 65 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 212 की उप-धारा (1) द्वारा अपेक्षित किये गये अनुसार, उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है, की जानकारी के लिए एतद्‌द्वारा प्रकाषित किया जाता है तथा एतद्‌द्वारा सूचित किया जाता है कि उक्त प्रारूप पर, इस सूचना के राजपत्र में प्रकाशन की तारीख से 30 दिवस के अवसान पर विचार किया जायेगा।

कोई आपत्ति या सुझाव, जो उक्त प्रारूप के संबंध में किसी व्यक्ति से विनिर्दिष्ट कालावधि के पूर्व, सचिव, छत्तीसगढ़ शासन, ई-मेल. [email protected], परिवहन विभाग, मंत्रालय, महानदी भवन, नवा रायपुर अटल नगर, रायपुर, के कार्यालय में कार्यालयीन समय पर प्राप्त हो, पर छत्तीसगढ़ शासन द्वारा विचार किया जायेगा।

संशोधन प्रारूप

उक्त नियमों में,-

1. नियम 55-ग के पश्चात्‌, निम्नलिखित नियम जोड़ा जाये, अर्थात्‌ः-

''55-घ. पंजीयन चिन्ह का प्रतिधारण.-(1) किसी मोटरयान का पंजी—त स्वामी, अपने पुराने वाहन के पंजीयन चिह्न (साधारण/फैंसी/चॉइस नंबर) का प्रतिधारण या पुनः उपयोग, क्रय किये गये नवीन वाहन अथवा अन्य राज्य से पते में परिवर्तन कर पंजीयन हेतु लाये गये वाहनों पर कर सकेगा।

(2) वाहन स्वामी को, प्रत्येक मोटरयान के पंजीयन चिन्ह का प्रतिधारण या पुनः उपयोग की अनुमति केवल एक बार ही होगी।

(3) पंजीयन चिन्ह का प्रतिधारण करने के लिए फैंसी/चॉइस नंबर हेतु निर्धारित शुल्क का भुगतान करना होगाः परंतु ऐसे पंजीयन चिन्ह, जिनके फैंसी/चॉइस नंबर के प्रतिधारण हेतु शुल्क का निर्धारण नहीं किया गया है, के उपयोग के लिए शुल्क ₹ 5000/- का भुगतान करना होगा। स्पष्टीकरण - फैंसी/चॉइस नंबर के अंतर्गत नीलामी की प्रारंभिक बोली राशि को यथा निर्धारित शुल्क समझा जायेगा।

(4) पंजीकरण चिन्ह के प्रतिधारण या पुनः उपयोग हेतु आवेदन, प्रारूप सी.जी.एम.व्ही.आर. 34-क में नियम 62 के अधीन यथा विनिर्दिष्ट अपेक्षित दस्तावेज एवं आवेदन शुल्क के साथ पंजीयन प्राधिकारी को प्रस्तुत करना होगा। (5) जहाँ वाहन स्वामी द्वारा मोटरयान को विधिवत्‌ स्क्रैप कर दिया गया है अथवा अन्य विधिपूर्ण साधनों के माध्यम से पंजीयन का निरस्तीकरण प्राप्त का लिया गया है, पंजीयन चिन्ह का पुनः उपयोग करने के लिए सक्षम प्राधिकारी द्वारा जारी पंजीयन निरस्तीकरण प्रमाणपत्र प्रस्तुत करना अनिवार्य होगाः

परन्तु, जहाँ वाहन को किसी अन्य राज्य में स्थानांतरित करने के लिए अनापत्ति प्रमाण-पत्र (एनओसी) जारी किया गया है, तो पंजीयन चिन्ह के पुनः उपयोग के लिए संबंधित पंजीयन प्राधिकारी से जारी नवीन पंजीयन प्रमाणपत्र (आर.सी.कार्ड) प्रस्तुत करना अनिवार्य होगा।

(6) पंजीयन चिन्ह के प्रतिधारण की सुविधा, निम्नलिखित वाहनों पर लागू नहीं होगीः

(क) राज्य में पूर्व से पंजी—त वाहनों के लिए; या

(ख) ऐसे वाहन, जिनके संबंध मेें अन्य राज्य से अंतर्राज्यीय अनापत्ति प्रमाणपत्र प्राप्त होने के आधार पर पता परिवर्तन दर्ज किया गया है, परन्तु पंजीयन चिन्ह किसी अन्य राज्य से संबंधित है; एवं

(ग) ऐसे वाहन, जिनका पंजीयन निरस्त हो गया है अथवा अन्य राज्य हेतु जारी अनापत्ति प्रमाणपत्र की अवधि एक वर्ष से अधिक हो चुकी हो।

(7) ऐसी दशा में, जहाँ अनापत्ति प्रमाणपत्र के आधार पर राज्य में पते के परिवर्तन को दर्ज किया गया है, तो पंजीयन चिन्ह का प्रतिधारण, अंतिम पंजीयन प्राधिकारी की अधिकारिता में होगा।

(8) पंजीयन चिन्ह के प्रतिधारण या पुनः उपयोग की सुविधा, शासकीय वाहनों पर भी लागू होगी; तथापि ऐसे वाहनों को विनिर्दिष्ट शुल्क के भुगतान से छूट प्राप्त होगी।''

2. नियम 62 के अंतर्गत सारणी में सरल क्रमांक 1 तथा उससे संबंधित प्रविष्टियों के पश्चात्‌, निम्नलिखित अंतःस्थापित किया जाये, अर्थात्‌ः-

NOTICE

No F RULE/6/2025-TRANSPORT-Part(2). The following further draft amendment in the Chhattisgarh Motor Vehicles Rules, 1994, which the State Government proposes to make in exercise of the powers conferred by Section 65 of the Motor Vehicles Act, 1988 (No. 59 of 1988), is hereby, published as required by sub-section (1) of Section 212 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on the expiry of 30 days from the date of publication of this notice in the Official Gazette.

Any objection or suggestions regarding the said draft received from any person, before the specified period, in office hours in the office of the Secretary, Department of Transport, Email- [email protected], Government of Chhattisgarh, Mantralaya, Mahanadi Bhawan, Nava Raipur Atal Nagar, Raipur, shall be considered by the Government of Chhattisgarh.

DRAFT AMENDMENT

In the said rules,-

1. After Rule 55-C, the following rule shall be added, namely:-

"55-D. Retention of Registration Mark.- (1) The registered owner of a motor vehicle may retain or re-use the registration mark (ordinary/fancy/choice number) of his/her old vehicle on a newly purchased vehicle or on a vehicle brought for registration due to change of address from another State.

(2) The vehicle owner shall be permitted to retain or re-use the registration mark of each motor vehicle only once.

(3) To retain the registration mark, the prescribed fee for fancy/choice number shall have to be paid:

Provided that for retention of fancy/choice number for which fee has not been fixed, a fee of ₹ 5000/- shall have to be paid for use of such registration mark.

Explanation– The initial bid amount of the auction under fancy/choice number shall be considered as fixed fee.

(4) An application for retention or re-use of a registration mark shall be submitted to the Registering Authority in Form CGMVR 34-A, along with the requisite documents and the application fee as specified under rule 62.

(5) Where the vehicle owner has duly scrapped the motor vehicle or has obtained cancellation of registration through any other lawful means, submission of the Registration Cancellation Certificate issued by the Competent Authority shall be mandatory for re-use of the registration mark:

Provided that, where a No Objection Certificate (NOC) has been issued for transfer of the vehicle to another State, the new Registration Certificate (RC Card) issued by the concerned Registering Authority shall be mandatorily submitted for re-use of the registration mark.

(6) The facility for retention of registration mark shall not be applicable to the following vehicles:

(a) For Vehicles already registered within the State, or

(b) Vehicles in respect of which change of address has been, recorded on the basis of an-inter State No Objection Certificate received from another State, but the registration mark pertains to another State;

(c) Vehicles whose registration has been cancelled or No Objection Certificate issued for another State has exceeded a period of one year.

(7) In cases where change of address within the State has been recorded on the basis of a No Objection Certificate, retention of the registration mark shall be subject to the jurisdiction of the last Registering Authority.

(8) The facility of retention or re-use of registration marks shall also be applicable to Government vehicles; however, such vehicles shall be exempted from payment of the prescribed fee."

2. After serial number 1 and the entries relating thereto in the Table under rule 62, the following shall be inserted, namely:–
