क्रमांक RULE/504/2026-TRANSPORT. छत्तीसगढ़ मोटरयान नियम 1994 में और संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार मोटरयान अधिनियम,1988 (क्रं 59 सन् 1988) की धारा 65 द्वारा प्रदत्त शक्तियों को प्रयोग लाते हुए, और भारत सरकार, सड़क परिवहन और राजमार्ग मंत्रालय, नई दिल्ली की अधिसूचना क्रमांक सा.का. नि. 901(अ), दिनांक 22 दिसम्बर 2022 केे अनुसरण में बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 212 की उप-धारा (1) द्वारा अपेक्षित किये गये अनुसार, उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है, की जानकारी के लिए एतद्द्वारा प्रकाशित किया जाता है तथा एतद्द्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस सूचना के राजपत्र में प्रकाशन की तारीख से 30 दिवस के अवसान पर विचार किया जायेगा।
कोई आपत्ति या सुझाव, जो उक्त प्रारूप के संबंध में किसी व्यक्ति से विनिर्दिष्ट कालावधि के पूर्व, सचिव, परिवहन विभाग, ईमेल- [email protected]., छत्तीसगढ़ शासन, मंत्रालय, महानदी भवन, नवा रायपुर अटल नगर, रायपुर के कार्यालय में, कार्यालयीन समय पर प्राप्त हो, पर छत्तीसगढ़ शासन द्वारा विचार किया जाएगा।
संशोधन प्रारूप
उक्त नियमों में,-
नियम 54 के उप-नियम (3) के पश्चात्, निम्नलिखित अंतःस्थापित किया जाये, अर्थात्ः-
''(4) पुराने वाहनों के खरीदी और बिक्री करने वाले व्यौहारी (डीलर्स) को मोटरयान वर्गवार बैंक गारण्टी निम्नलिखित तालिका अनुसार जमा करानी होगी, जो व्यापार प्रमाणपत्र की अवधि के लिए वैध होगीः-

प्राधिकृत व्यौहारी (डीलर्स) के लिए निम्नलिखित शर्ताें का पालन किया जाना आवश्यक है, अन्यथा उनके विरूद्ध संबंधित रजिस्ट्रीकरण प्राधिकारी द्वारा कार्यवाही की जा सकेगीः-
(क) प्राधिकृत व्यौहारी (डीलर्स) को नियम 55क के उप-नियम (2) के अनुसार, प्ररूप 29क में, जिस दिन वाहन प्राप्त हो, उसी दिन पोर्टल पर इलेक्ट्रॉनिक रूप से इंद्राज करना होगा।
(ख) केन्द्रीय मोटरयान नियम, 1989 के नियम 55ख के उप-नियम (1) के अधीन किसी मोटरयान का रजिस्ट्रीकृत स्वामी उस रजिस्ट्रीकरण प्राधिकारी को, जिसके पास वर्तमान में यान रजिस्ट्रीकृत है, रजिस्ट्रीकृत यान के प्राधिकृत व्यौहारी (डीलर्स) को, पोर्टल पर इलेक्ट्रानिक रूप से दाखिल किए गए उसके और रजिस्ट्रीकृत यान के प्राधिकृत व्यौहारी (डीलर्स) द्वारा सम्यक् रूप से हस्ताक्षरित प्ररूप 29ग के माध्यम से, यान की आपूर्ति के तथ्य की सूचना देगा और पोर्टल पर प्ररूप 29ग के सफलतापूर्वक दाखिल करने पर पावती संख्या पोर्टल के माध्यम से स्वतः जारी हो जाएगी। (ग) केन्द्रीय मोटरयान नियम, 1989 के नियम 55ख के उप-नियम (2) के अधीन, मोटरयान का रजिस्ट्रीकृत स्वामी उस रजिस्ट्रीकरण प्राधिकारी को जिसे उप-नियम (1) के अधीन सूचना दी गई है, रजिस्ट्रीकृत यान के प्राधिकृत व्यौहारी (डीलर्स) को पोर्टल पर इलेक्ट्रॉनिक रूप से दाखिल किए गए उसके और रजिस्ट्रीकृत यान के प्राधिकृत व्यौहारी (डीलर्स) द्वारा सम्यक् रूप से हस्ताक्षरित प्ररूप 29घ के माध्यम से यान के वापस करने के तथ्य की सूचना देगा और पोर्टल पर प्ररूप 29घ के सफलतापूर्वक दाखिल करने पर पावती संख्या पोर्टल के माध्यम से स्वतः जारी हो जाएगी।
(घ) केन्द्रीय मोटरयान नियम 1989 के नियम 55ग उप-नियम (3) के अधीन प्राधिकृत व्यौहारी (डीलर्स) इलेक्ट्रॉनिक रूप से पोर्टल पर प्ररूप 29ड. में सूची का रिकार्ड रखेगा।
(ड.) केन्द्रीय मोटरयान नियम 1989 के नियम 55ड. उप-नियम (1) के अधीन प्राधिकृत व्यौहारी (डीलर्स) पोर्टल पर प्ररूप 29च में इलेक्ट्रॉनिक रजिस्टर को बनाए रखेगा।
(च) प्राधिकृत व्यौहारी (डीलर्स) मोटरयान अधिनियम, 1988 (1988 का 59), केन्द्रीय मोटरयान नियम, 1989 तथा अन्य लागू नियमों के अनुसार कार्य करेगा तथा वित्त पोषक के रूप में दृष्टिबंधक अथवा बंधक रखे गये वाहन के संबंध में मोटरयान अधिनियम, 1988 (1988 का 59) की धारा 51 तथा केन्द्रीय मोटरयान नियम, 1989 के नियम 61 के अनुपालन में वित्त पोषक की सहमति प्राप्त करेगा।
(छ.) प्राधिकृत व्यौहारी (डीलर्स) वाहनों के लिए पर्याप्त पार्किंग स्थान की उपलब्धता सुनिश्चित करेगा एवं कार्य स्थल पर अग्निशामक यंत्र संधारित करेगा।
(ज.) प्राधिकृत व्यौहारी (डीलर्स) यह सुनिश्चित करेगा कि वास्तविक एवं वैध दस्तावेज प्रस्तुत किये जाये, प्रयोज्य नियमों का पालन किया जाये तथा वाहन के व्यौहारी (डीलर्स) से संबंधित सभी बकाया राशियों का भुगतान किया जाए। नियमों के प्रावधानों का उल्लंघन या अनुपालन न करने की स्थिति में, संबंधित रजिस्ट्रीकरण प्राधिकारी, सुनवाई का अवसर प्रदान करने के पश्चात् प्राधिकृत व्यौहारी (डीलर्स) के विरूद्ध कार्यवाही कर सकता है, जिसमें प्राधिकार पत्र का निलंबन या निरस्तीकरण तथा प्राधिकृत व्यौहारी (डीलर्स) द्वारा जमा बैंक गांरटी की राशि का समपहरण सम्मिलित है।''

NOTICE
No. F RULE/504/2026-TRANSPORT. The following further draft amendment in the Chhattisgarh Motor Vehicles Rules, 1994, which the State Government proposes to make in exercise of the powers conferred by Section 65 of the Motor Vehicles Act, 1988 (N0. 59 of 1988), and in pursuance of notification number G.S.R. 901 (A), dated 22 December 2022, Government of India, Ministry of Road Transport and Highways New Delhi, is hereby, published as required by sub-section (1) of Section 212 of the said Act, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration on the expiry of 30 days from the date of publication of this notice in the Official Gazette.
Any objection or suggestions regarding the said draft received from any person, before the specified period, in office hours in the office of the Secretary, Department of Transport, Email- [email protected], Government of Chhattisgarh, Mantralaya, Mahanadi Bhawan, Nava Raipur Atal Nagar, Raipur, shall be considered by the Government of Chhattisgarh.
DRAFT AMENDMENT
In the said rules,-
After Sub-rule (3) of Rule 54, of the following shall be inserted, namely:-
"(4) The dealers buying and selling old vehicles shall have to deposit bank guarantee, motor vehicle category wise as per the following table, which shall be valid for the period of trade trade certificate:-

The concerned registering authority may review compliance by the authorized dealer with the following conditions:-
(a) The authorized dealer shall enter the stock electronically on the portal on the day on which vehicle is received, in Form 29A in accordance with sub-rule (2) of rules 55A.
(b) Under sub-rule (1) of rule 55B of the Central Motor Vehicles Rules, 1989, registered owner of a motor vehicle shall intimate the registering authority, with whom the vehicle is currently registered, the fact of delivery of vehicle to authorized dealer of registered vehicles, through From 29C, submitted electronically on portal, duly signed by him and authorized dealer of registered vehicles and on successful submission of Form 29C on the portal, acknowledgement number shall be auto generated through the portal.
(c) Under sub-rule (2) of rule 55B of the Central Motor Vehicles Rules, 1989, the registered owner of a motor vehicle shall intimate the registering authority, to whom the intimation under sub-rule (1) has been given, the fact of taking back vehicle from authorized dealer of registered vehicles, through Form 29D submitted electronically on portal, duly signed by him and the authorized dealer of registered vehicle and on successful submission of Form 29D on the portal, acknowledgement number shall be auto generated through the portal.
(d) Under sub-rule (3) of rule 55C of the Central Motor Vehicles Rules, 1989, the authorized dealer shall maintain the record of inventory electronically on the portal in Form 29E.
(e) Under sub-rule (1) of rule 55E of the Central Motor Vehicles Rules, 1989 the authorized dealer shall maintain an electronic register on the portal in Form 29F.
(f) The authorized dealer shall Act in accordance with the provisions of the Motor Vehicles Act, 1988 (N0. 59 of 1988), the Central Motor Vehicles Rules, 1989 and other applicable rules, and shall obtain the consent of the financier in respect of vehicles hypothecated or mortgaged in favor of financier, in compliance with section 51 of the Motor Vehicles Act, 1988 (N0. 59 of 1988) and rule 61 of the Central Motor Vehicles Rules, 1989.
(g) The authorized dealer shall ensure availability of adequate parking space for vehicles and shall maintain fire extinguishers at the workplace.
(h) The authorized dealer shall ensure submission of genuine and valid documents, compliance with the applicable rules, and clearance of all outstanding dues relating to the vehicle dealer.
In the event of violation or non-compliance with the provision of the rules, the concerned registering authority may, after giving an opportunity of being heard, take appropriate action against the authorized dealer, including suspension or cancellation of the authorization certificate and forfeiture of the bank guarantee amount deposited by the authorized dealer.
