अधिसूचना
क्रमांक GENCOR/2171/2025-HOUSING. छत्तीसगढ़ नगर तथा ग्राम निवेश अधिनियम, 1973 (क्र. 23 सन् 1973) की धारा 85 की उप-धारा (1) सहपठित धारा 24 की उप-धारा (3) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, एतद्वारा, छत्तीसगढ़ विशेष क्षेत्र (अचल सम्पत्ति का व्ययन) नियम, 2008 में निम्नलिखित और संशोधन करती है, जिसे उक्त अधिनियम की धारा 85 की उप-धारा (1) द्वारा अपेक्षित अनुसार पूर्व में ही प्रकाशित किया जा चुका है, अर्थात :-

उक्त नियमों में, -
नियम 4 के पश्चात, निम्नलिखित नियम जोड़ा जाए, अर्थातः-
''4अ. इन नियमों में कहीं भी अंतर्विष्ट किसी विपरीत बात के होते हुए भी, छत्तीसगढ़ नगर तथा ग्राम निवेश अधिनियम, 1973 (क्र. 23 सन् 1973) के प्रावधानों के अनुसार अधिसूचित नगर विकास योजनाओं के क्षेत्र में स्थित सभी प्रकार की भूमि के अंतरण हेतु निम्नलिखित प्रावधान लागू होंगे.-
(1) प्राधिकारी नगर विकास योजनाओं के अंतर्गत भूमि के लिये योजना की विशिष्ट प्र—ति के आधार पर समुचित आरक्षित प्रीमियम और वार्षिक पट्टा भाटक निर्धारित करेगा।
(2) नगर विकास योजनाओं के अंतर्गत प्राधिकरण की सभी प्रकार की भूमि को पट्टाधृति आधार पर अथवा अनुज्ञप्ति पर अथवा पूर्ण स्वामित्व के आधार पर अंतरित किया जा सकेगा।
(3) प्राधिकारी किसी भी समय निम्नलिखित निबंधनों एवं शर्तों पर ऐसी सभी भूमि के पट्टे को पूर्ण स्वामित्व में परिवर्तित कर सकेगाः-
(क) पट्टेदार पट्टे को फ्री होल्ड स्वामित्व में परिवर्तन के लिये प्राधिकारी द्वारा निर्धारित प्रचलित भूमि प्रीमियम के अनुसार संगणित के कुल भूमि प्रीमियम के 1ः (एक प्रतिशत) के बराबर राशि जमा करेगा।
(ख) पट्टेदार, न्यूनतम 15 (पंद्रह) वर्ष के वार्षिक पट्टा भाटक के बराबर एकमुश्त राशि जमा करेगा। (ग) पट्टेदार, पंजीकरण अधिनियम, 1908 (क्र 16 सन् 1908) के अधीन पंजी—त परिवर्तन विलेख, स्वयं के व्यय पर प्राप्त करेगा। नवा रायपुर अटल नगर, दिनांक 2 जून 2026 क्रमांक GENCOR/2171/2025-HOUSING. भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में छत्तीसगढ़ विशेष क्षेत्र (अचल संपत्ति का व्ययन) नियम, 2008 में संशोधन संबंधी इस विभाग की समसंख्यक अधिसूचना दिनांक 02-06-2026 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्द्वारा प्रकाशित किया जाता है। छत्तीसगढ़ के राज्यपाल के नाम से तथा आदेशानुसार,

NOTIFICATION
No. GENCOR/2171/2025-HOUSING. In exercise of the powers conferred by sub-section (3) of Section 24 read with sub-section (1) of Section 85 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973), the State Government, hereby, makes the following further amendment in the Chhattisgarh Vishesh Kshetra (Achal Sampatti Ka Vyayan) Niyam, 2008, the same having been previously published as required by sub-section (1) of Section 85 of the said Adhiniyam, namely:-
AMENDMENT
In the said rules,-
After rule 4, the following shall be added, namely:-
"4A. Notwithstanding anything contrary contained anywhere in these rules, following provisions shall be applicable for transfer of all types of land present in the area of Town Development Scheme notified in accordance with the provisions of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973)-
(1) The Authority shall fix appropriate reserve premium and annual lease rent for the land under Town Development Scheme(s) based on the specific nature of the Scheme.
(2) All types of land of authority under the Town Development Scheme(s) may be transferred on lease hold basis or on license basis or on freehold basis.
(3) The authority may at any time convert the lease of all such land to free hold ownership on following terms and conditions:-
(a) The lessee shall deposit an amount equal to 1% (one percent) of the total land premium calculated as per the prevailing land premium determined by the Authority for conversion of lease to free hold ownership.
(b) The lessee shall deposit a lump sum amount equal to minimum 15 (Fifteen) years of annual lease rent.
(c) The lessee shall get the conversion deed registered under the Registration Act, 1908 (No.16 of 1908) at his one cost.
(4) In case of upfront transfer of such land on free hold basis, the land premium decided for such free hold transfer shall include the lump sum amount equal to minimum 15 (Fifteen) years of annual lease rent, over and above the reserve premium."
