क्रमांक त्न्स्म्.8ध्65ध्2026.स्।ठव्न्त्ण्— छत्तीसगढ़ दुकान एवं स्थापना (नियोजन एवं सेवा की शर्तों का विनियमन) अधिनियम, 2017 (क्र. 21 सन्‌ 2018) की धारा 28 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, राज्य सरकार, छत्तीसगढ़ दुकान एवं स्थापना (नियोजन एवं सेवा की शर्तों का विनियमन) नियम, 2021 में निम्नलिखित और संशोधन करती हैः-

संशोधन

उक्त नियमों में,-

1. नियम 4 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाए, अर्थात्‌ :-

''4. श्रम पहचान संख्या का पंजीयन प्रमाण पत्र.- (1) श्रम पहचान संख्या का पंजीयन प्रमाणपत्र, नियोजक द्वारा निर्धारित प्ररूप में ऑनलाईन आवेदन, आवश्यक दस्तावेजों एवं ई-चालान के माध्यम से भुगतान किए गए शुल्क की प्राप्ति पर, राजस्व प्राप्ति शीर्षः 0203 श्रम और रोजगार (800) राजस्व एवं अन्य प्राप्तियों के अंतर्गत, प्ररूप-2 में वेबपोर्टल के माध्यम से 24 घंटे के अंदर जारी किया जाएगा। (2) वेबपोर्टल के माध्यम से जारी श्रम पहचान संख्या के संबंध में, दुकान एवं स्थापनाओं की पंजी, ऑनलाईन श्रम विभाग के पोर्टल पर, फैसिलिटेटर कार्यालय द्वारा प्ररूप-3 में संधारित की जाएगी। (3) इस नियम के अधीन ऑनलाईन जारी श्रम पहचान संख्या प्रमाणपत्र, अधिनियम एवं नियमों के अधीन वैध माना जाएगा।

(4) यदि नियोजक द्वारा आवेदन में उपलब्ध कराई गई जानकारी/तथ्य/दस्तावेज मिथ्या, त्रुटिपूर्ण अथवा भ्रामक पाई जाती है, तो नियोजक पूर्णतः उत्तरदायी होगा।

(5) प्रत्येक दुकान एवं स्थापना के नियोजकों का यह दायित्व होगा कि दुकान एवं स्थापना के सहजदृष्य स्थान पर दुकान एवं स्थापना के नाम के अतिरिक्त पंजीयन प्रमाणपत्र आवश्यक रूप से प्रदर्शित करेगा, जो सुलभ पठनीय होना चाहिये।''

2. नियम 5 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाए, अर्थात्‌ :-

''5. श्रम पहचान संख्या के पंजीयन प्रमाण पत्र में संशोधन/परिवर्तन की सूचना.- (1) दुकान एवं स्थापना के नियोजक द्वारा पंजीयन प्रमाण पत्र में नियोजक/भागीदार का नाम एवं पता, कर्मकारों की संख्या, दुकान एवं स्थापना का पता, कार्य का स्वरूप इत्यादि में संशोधन/परिवर्तन के संबंध में आवेदन प्ररूप-4 में संशोधन शुल्क े 100/- के ई-चालान के माध्यम से भुगतान रसीद सहित श्रम विभागीय पोर्टल में ऑनलाईन प्रस्तुत किया जाएगा।

(2) श्रम पहचान संख्या का पंजीयन प्रमाणपत्र, नियोजक द्वारा निर्धारित प्ररूप में ऑनलाईन आवेदन, आवश्यक दस्तावेजों, ई-चालान के माध्यम से भुगतान किए गए शुल्क एवं संशोधित आवेदन की प्राप्ति पर, प्ररूप-2 में वेबपोर्टल के माध्यम से, 24 घंटे के अंदर जारी किया जाएगा।''

3. प्ररूप-2 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाए :-

यह प्रमाणित किया जाता है कि दुकान/स्थापना, जिसके विवरण ऊपर दिये गये हैं, नियोजक द्वारा ऑनलाईन आवेदन के साथ प्रस्तुत जानकारी/घोषणा/सूचना के आधार पर, छत्तीसगढ़ दुकान तथा स्थापना (नियोजन एवं सेवा की शर्ताें का विनियमन) अधिनियम, 2017 (क्र. 21 सन्‌ 2018) सहपठित छत्तीसगढ़ दुकान तथा स्थापना (नियोजन एवं सेवा की शर्ताें का विनियमन) नियम, 2021 के अधीन दिनांक .........../........./...................... को सूचना आधारित श्रम पहचान संख्या का पंजीयन प्रमाणपत्र जारी किया जाता है। इस प्रमाणपत्र के आधार पर किसी भी सम्पत्ति, दुकान, स्थापना अथवा नाम के दावे को प्राप्त करने का अधिकार नहीं होगा।

फैसिलिटेटर

यह प्रमाणपत्र, स्वघोषणा के आधार पर सिस्टम-जनरेटेड, सूचना आधारित पंजीयन प्रमाणपत्र है। किसी भौतिक हस्ताक्षर की आवश्यकता नहीं है।''

NOTIFICATION

No. RULE-8/65/2026-LABOUR.— In exercise of the powers conferred by Section 28 of the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 (No. 21 of 2018), the State Government hereby makes the following further amendments to the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2021, namely:—

AMENDMENT

In the said rules,-

1ण् For rule 4, the following shall be substituted, namely:-

श्4ण् त्महपेजतंजपवद ब्मतजपपिबंजम व िस्ंइवनत प्कमदजपपिबंजपवद छनउइमतण्. ;1द्ध A Labour Identification Number Registration Certificate shall be issued within 24 hours through the web portal in Form-2 upon receipt of an online application, necessary documents and fee deposited through e-challan under the revenue head: 0203 Labour and Employment (800) Revenue and other receipts by the employer in the prescribed format.

(2) A register of shops and establishments with respect to the Labour Identification Number issued through the web portal shall be maintained online on the portal of Labour Department by the Facilitator's Office in Form-3.

(3) The Labour Identification Number certificate issued online under this rule shall be considered valid under the Act and Rules.

(4) The employer shall be fully responsible if the information/facts/ documents provided in the application are found to be incorrect, erroneous or misleading.

(5) It shall be responsibility of the employer of every shop and establishment to compulsorily display the registration certificate in addition to the name of the shop and establishment at a conspicuous place in the shop and establishment, which should be legible."

(1) The application in Form-4 shall be submitted online by the employer of shop and establishment on the portal of Labour Department along with the payment receipt of amendment fee ₹ 100/- through e-challan regarding amendment/ change in name and address of employer/partner, number of workers, address of shop and establishment, nature of work etc. in the registration certificate.

(2) A Labour Identification Number Registration Certificate shall be issued within 24 hours through the web portal in Form-2 upon receipt of an online application, necessary documents, fee deposited through e-challan and amendment application by the employer in the prescribed format."

It is certified that the shop/establishment, the details of which are given above, based on the information/declaration/facts submitted by the employer along with the online application, is issued an information based labour identification number registration certificate on date….../...../............ under the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 (No. 21 of 2018) read with Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2021. This certificate shall not confer any right to claim any property, shop, establishment or name.
