सूचना

क्रमांक RULE/170/2025-HOUSING. छत्तीसगढ़ भूमि विकास नियम, 1984 में और संशोधन का निम्नलिखित प्रारूप, जिसे राज्य सरकार, छत्तीसगढ़ नगर तथा ग्राम निवेश अधिनियम, 1973 (क्र. 23 सन्‌ 1973) की धारा 85 की उप-धारा (1) सहपठित धारा 24 की उप-धारा (3) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है, उक्त अधिनियम की धारा 85 की उप-धारा (1) के अधीन अपेक्षित किये गये अनुसार, उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है, की जानकारी के लिये एतद्‌द्वारा प्रकाशित किया जाता है तथा एतद्‌द्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से पन्द्रह दिवस के अवसान के पश्चात्‌ विचार किया जायेगा।

कोई आपत्ति या सुझाव, जो उक्त प्रारूप के संबंध में किसी व्यक्ति से विनिर्दिष्ट कालावधि के पूर्व, सचिव, आवास एवं पर्यावरण विभाग, छत्तीसगढ़ शासन, कक्ष क्रमांक एस-2-23, मंत्रालय, महानदी भवन, नवा रायपुर अटल नगर, जिला रायपुर के कार्यालय में, कार्यालयीन समय में प्राप्त हो, पर छत्तीसगढ़ शासन द्वारा विचार किया जायेगा।

संशोधन प्रारूप

उक्त नियमों में-

1. नियम 37 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाये, अर्थात्‌ :-

''37. उपयोग श्रेणी वर्गीकरण एवं गतिविधियों की सूची. -विभिन्न भू-उपयोग अंतर्गत उपयोग श्रेणियों, उप श्रेणियों एवं गतिविधियों की सूची निम्नानुसार होगी -

2. नियम 38 के उप-नियम (1) के शीर्षक सहित निम्नलिखित प्रतिस्थापित किया जाये, अर्थात्‌ :-

''(1) भू-उपयोग अनुसार प्रतिबंधित उपयोग उप श्रेणियां. - विभिन्न भूमि उपयोगों के अंतर्गत प्रतिबंधित उप श्रेणियों (नकारात्मक) की सूची निम्नानुसार होगी :-

3. नियम 49 के सारणी 4 की टीप के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाए, अर्थात्‌ :-

''(1) उपरोक्त कॉलम (5) में वर्णित विभिन्न सुख सुविधाओं के लिए अपेक्षित न्यूनतम भूमि केवल निर्देर्शित है। भूखण्ड का आकार सुसंगत स्कूल शिक्षा बोर्ड या किसी नियामक प्राधिकारी या भूखण्ड का न्यूनतम आकार विहित करने के लिए सक्षम प्राधिकारी द्वारा विहित किए गए अनुसार होगा। सारणी तदनुसार परिवर्तित हो जाएगी।

(2) निम्न आय वर्ग के लिए अनिवार्य सुविधाओं की आवश्यकताएं परिशिष्ट (ड) में दिये अनुसार होंगी। 4. नियम 56 के उप-नियम 6 के सारणी 5 के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाए, अर्थात्‌ :-

''सारणी 5 [नियम 56 (6)] विभिन्न ऊँचाइयों वाले भवनों के लिए खुले स्थान

5. नियम 61 के सारणी 7 के सरल क्रमांक 1 के कॉलम (3) में, प्रविष्टी ''त.क्षे.अ. तथा घनत्व संबंधित स्थान के विकास आयोजना में उपबंधित किए अनुसार अपनाया जा सकेगा।'' के स्थान पर, अंक ''1.50'' प्रतिस्थापित किया जाये। 6. नियम 61 के सारणी 7 के सरल क्रमांक 3 के कॉलम (3) में, अंक ''1.00'' के स्थान पर अंक ''1.50'' प्रतिस्थापित किया जाये।

क्रमांक RULE/170/2025-HOUSING. भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में छत्तीसगढ़ भूमि विकास नियम, 1984 में संशोधन संबंधी इस विभाग की समसंख्यक सूचना दिनांक 09/06/2026 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्‌द्वारा प्रकाशित किया जाता है।

छत्तीसगढ़ के राज्यपाल के नाम से तथा आदेशानुसार,

देवेन्द्र सिंह भारद्वाज, विशेष सचिव.

NOTICE

No. RULE/170/2025-HOUSING . The following draft of further amendment in the Chhattisgarh Bhumi Vikas Niyam, 1984, which the State Government proposes to make in exercise of the powers conferred by sub-section (3) of Section 24 read with sub-section (1) of Section 85 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973), is hereby, published as required under sub-section (1) of Section 85 of the said Adhiniyam, for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after expiry of 15 days from the date of publication of this notice in the Official Gazette.

Any objection or suggestion, regarding the said draft received from any person before the specified period, during office hours, in the office of the Secretary, Department of Housing and Environment, Government of Chhattisgarh, Room No. S-2-23, Mantralaya, Mahanadi Bhawan, Nava Raipur Atal Nagar, District Raipur, shall be considered by the Government of Chhattisgarh.

DRAFT AMENDMENT

In the said rules,-

1. For rule 37, the following shall be substituted, namely:-

"37. Use Category Classification and List of Activities.- The list of use categories, sub-categories, and activities under various land uses shall be as follows–

2. Along with Heading for sub-rule (1) of rule 38, the following shall be substituted, namely:-

"(1) Restricted Use Sub-categories according to Land use.- The list of Restricted sub-categories (Negative categories) under various land uses shall be as follows -

3. For Note of Table 4 of rule 49, the following shall be substituted, namely:-

"(1) The minimum land required for various facilities described in column (5) above is only indicative. The plot size shall be as prescribed by the relevant School Education Board or any regulatory authority or the competent authority empowered to prescribe the minimum plot size. The table shall be modified accordingly.

(2) The requirements for mandatory facilities for Low Income Group housing shall be as given in Appendix M." 4. For Table 5 of sub-rule (6) of rule 56, the following shall be substituted, namely:–

"TABLE 5 [Rule 56 (6)] OPEN SPACES FOR BUILDINGS OF DIFFERENT HEIGHTS

5. In column (3) of serial number 1 of Table 7 of rule 61, for the entry "F. A. R. and Density may be adopted as provided in the Development Plans of respective places.", the figure "1.50" shall be substituted.

6. In column (3) of serial number 3 of Table 7 of rule 61, for the figure "1.00", the figure "1.50" shall be substituted.
