अधिसूचना क्र.-GENCOR-11928/एफ4-404/एस-2/31/अ.वि./ग्राउण्ड वॉटर एक्ट/19(पार्ट).  1. भूगर्भ जल घरेलू, कृषि और औद्योगिक उपयोगों के लिए जल का एकल सर्वाधिक महत्वपूर्ण स्त्रोत है। राज्य सरकार के संज्ञान में यह लाया गया है कि, भू-जल के अनियन्त्रित और तीव्र निष्कर्षण के फलस्वरूप राज्य के अनेक क्षेत्रों में भूजल के स्तरों में गिरावट और भूजल जलाशयों में ह्रास होने की भयावह स्थिति उत्पन्न हो गयी है। अतः राज्य में गम्भीर भू-जल संकट और भू-जल संदूषण की स्थिति से निपटने के लिए एवं राज्य में दोनों, परिणात्मक एवं गुणात्मक भूजल का अविरल प्रबन्धन सुनिश्चित करने हेतु तथा भू-जल की सुरक्षा, संरक्षा, नियंत्रण तथा विनियमन करने के लिए एक विधि बनाने का विनिश्चय किया गया।

2. उक्त तथ्य को दृष्टिगत रखते हुए छत्तीसगढ़ शासन द्वारा भू-जल संसाधन के प्रबंधन और विनियमन हेतु 'छत्तीसगढ़ भू-जल (प्रबंधन और विनियमन) अधिनियम, 2022' (जिसे इसमें इसके पश्चात्‌ 'अधिनियम' कहा गया है) एवं 'भू-जल (प्रबंधन और विनियमन) नियम, 2024' (जिसे इसमें इसके पश्चात्‌ 'नियम' कहा गया है) को क्रमशः अधिसूचना दिनांक 16 जनवरी 2024 एवं 20 जनवरी 2025 से, छत्तीसगढ़ (असाधारण) राजपत्र में प्रकाशन उपरांत अधिसूचित कर दिया गया है।

3. उपरोक्त तारतम्य में, छत्तीसगढ़ शासन एतद्‌ द्वारा 'छत्तीसगढ़ भू-जल (प्रबंधन और विनियमन) नियम, 2024' के नियम 4, 5 एवं 6 में नीहित प्रावधानों के अनुरूप, राज्य स्तर पर 'छत्तीसगढ भू-जल प्रबंधन एवं विनियामक प्राधिकरण', जिला स्तर पर 'जिला भू-जल प्रबंधन परिषद्‌' तथा विकासखंड स्तर पर 'विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति' का गठन करने का विनिश्चय करता है।

4. {नियम 4 (एक)} - छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण -

(1) 'छत्तीसगढ राज्य भू-जल प्रबंधन और विनियामक प्राधिकरण' को संक्षिप्त नाम ''छत्तीसगढ़ भू-जल प्राधिकरण (सीजीजीडब्ल्यूए)'' के रूप में भी जाना जाएगा एवं इस अधिसूचना को जारी करने की तिथि से कार्यशील माना जायेगा।

(2) छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण में निम्नलिखित पदाधिकारी शामिल होंगे-

2. भारसाधक सचिव, जल संसाधन विभाग - सदस्य

3. भारसाधक सचिव, वित्त विभाग

15. भू-जल के क्षेत्र में कार्य करने वाला सार्वजनिक/गैर सरकारी संगठन/सामाजिक क्षेत्र का एक प्रख्यात व्यक्ति (राज्य सरकार द्वारा नाम निर्दिष्ट किये जायेंगे)

(3) सार्वजनिक/गैर-सरकारी संगठन/सामाजिक क्षेत्र से विषय विशेषज्ञों एवं प्रतिष्ठित व्यक्तियों की पदावधि और रिक्तियों को भरने की रीति और सेवाओं की अन्य शर्तें ऐसी होंगी, जैसा कि 'नियम' 9 और 10 में परिभाषित है। (4) प्रमुख अभियन्ता, जल संसाधन विभाग, छत्तीसगढ़, 'छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण' की ओर से नोडल कार्यपालिक अधिकारी होगा।

(5) कार्यालय प्रमुख अभियन्ता, जल संसाधन विभाग छत्तीसगढ़, शिवनाथ भवन, नवा रायपुर, छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण के सचिवालय के रूप में कार्य करेगा।

(दो) छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण के कार्य निम्नानुसार होंगे :-

(1) (क) 'अधिनियम' की धारा 8 के अधीन यथा उपबंधित भू-जल संसाधनों के प्रबंधन और विनियमन हेतु क्षेत्रों को अधिसूचित करना;

(ख) 'अधिनियम' की धारा 10 के अधीन यथा उपबंधित भू-जल संसाधनों के प्रबंधन और विनियमन हेतु क्षेत्रों को गैर अधिसूचित करना ;

(ग) 'अधिनियम' की धारा 13 के अधीन यथा उपबंधित भू-जल निष्कर्षण की सीमाओं को नियत करना;

(घ) अधिसूचित और गैर-अधिसूचित क्षेत्रों में औद्योगिक, वाणिज्यिक/खनन उद्‌देश्य के लिए भू-जल निष्कर्षण हेतु अनुमति देना ;

(ङ) भू-जल निष्कर्षण के लिए कर (लेवी) एकत्र करना ;

(च) भू-जल उपयोग की निगरानी और प्रबंधन तंंंंंंंंंंंंंत्र हेतु नवीनतम तकनीक विकसित करना एवं अपनाना ;

(छ) कुशल और सुचारू कामकाज के लिए राज्य भू-जल प्रबंधन और विनियामक प्राधिकरण, इस खण्ड में उल्लेखित कार्यों को करने के लिए ऐसी शक्तियां प्रत्यायोजित कर सकेगा, जैसा कि वह उचित समझे;

(ज) यदि उपयुक्त समझा जाए तो, निकाले जा रहे जल, उसके उपभोग और उपयोग को मापने और निगरानी करने के लिये, भू-जल माप उपकरणों की संस्थापना और संचालन को अनुपूरित (सप्लीमेंट) करना (और आदेशित करना, यदि आवश्यक हो) ;

(झ) संसाधन उपलब्धता, उपयोग और स्थिरता को समेकित करने के लिए जल संसाधन डेटा बेस (यदि आवश्यक समझा जाए तो विशेष रूप से भू-जल पर ध्यान केंद्रित करना) के सृजन को अनुपूरित करना (और आदेशित करना, यदि आवश्यक हो);

() निगरानी और परिसंपत्ति प्रबंधन में सहायता के लिए सेंसर और मैपिंग टूल का उपयोग करके विशेष भू-जल अध्ययन की सुविधा प्रदान करना;

(ट) जिला भू-जल प्रबंधन परिषद और विकासखंड स्तरीय प्राधिकरणों के समन्वय से, एक भू-जल संसाधन प्रबंधन कार्य योजना तैयार करना, भू-जल संसाधन की दीर्घता, युक्तियुक्त खपत और संरक्षण/उपचार हस्तक्षेप सुनिश्चित करने के लिए संवहनीय हस्तक्षेप की योजना बनाना और तैयार करना;

(ठ) जहां भी संभव हो, भू-जल और सतही जल के संयुक्त उपयोग को प्रोत्साहित करना;

(ड) जहां भी संभव हो, सिंचाई प्रयोजनों और वैकल्पिक स्रोतों के माध्यम से अनुपूरित करने के लिए उपयोग किए जाने वाले भू-जल की मात्रा का निर्धारण करना;

(ढ) एकी—त जल संसाधन प्रबंधन योजनाओं, जल सुरक्षा योजनाओं, जल संरक्षण के लिए रोडमैप और अन्य स्थिर उपायों की व्यवहार्यता का पता लगाने के लिए अन्य विभागों के साथ तालमेल रखना;

(ण) भू-जल स्वामित्व पर भूमि-आधारित विवादों की निगरानी करना और यदि आवश्यक हो तो हस्तक्षेप करना। (2) छत्तीसगढ भू-जल प्रबंधन एवं विनियामक प्राधिकरण के कर्मचारीगण, -

(क) छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण को अपने कार्यों को समुचित रूप से निष्पादित करने या इस अधिनियम के तहत शक्तियों का प्रयोग करने में सक्षम बनाना, राज्य सरकार, सभी संस्थागत सहायता, सुविधाएं और बजट सहित उतनी संख्या में तकनीकी कर्मियों और अन्य कर्मचारियों की नियुक्ति/प्रतिनियुक्ति कर सकेगी, जितनी वह आवश्यक समझे;

(ख) छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण, राज्य सरकार के समग्र नियंत्रण और पर्यवेक्षण के तहत कार्य करेगा।

(तीन) छत्तीसगढ भू-जल प्रबंधन एवं विनियामक प्राधिकरण की निधि -

छत्तीसगढ भू-जल प्रबंधन और विनियामक प्राधिकरण को अपने कार्यों को समुचित रूप से करने या इस अधिनियम के तहत शक्तियों का प्रयोग करने में सक्षम बनाने के लिए, राज्य सरकार, आवश्यक सुविधाएं और बजट प्रदान करेगी।

5. {नियम 5 (एक)} जिला भू-जल प्रबंधन परिषद्‌ -

(1) जिला भू.जल प्रबंधन परिषद्‌ का गठन किया जायेगा, जो जिला स्तर पर भू.जल संसाधनों के प्रबंधन के लिए एक समग्र इकाई होगी, जिसमें निम्नलिखित पदाधिकारी शामिल होंगे-

(क) अध्यक्ष - कलेक्टर

(ख) उपाध्यक्ष - मुख्य कार्यपालन अधिकारी, जिला पंचायत

(ग) सदस्य-सचिव - कार्यपालक अभियंता, जल संसाधन संभाग, जिला मुख्यालय

(घ) भू-जल के क्षेत्र में दीर्घकालिक कार्यानुभव/ज्ञान रखने वाले विषय विशेषज्ञ के रूप में दो सदस्य, जिनका जिला कलेक्टर द्वारा नाम निर्दिष्ट किया जायेगा

(ड.) अन्य सदस्य, जिला स्तरीय प्रतिनिधि (प्रत्येक से एक)

• संभागीय वन अधिकारी, वन

• सहायक भू-जलविद, जिला भू-जल सर्वेक्षण इकाई,

• क्षेत्रीय अधिकारी, छत्तीसगढ़ पर्यावरण संरक्षण मंडल,

• उप निदेशक, —षि विभाग,

• जिला मुख्यालय के आयुक्त/सीएमओ, नगर निगम/नगरपालिका (स्थानीय निकाय),

• महाप्रबंधक/उप-निदेशक, जिला उद्योग केंद्र

• कार्यपालन अभियंता, लोक स्वास्थ्य एवं अभियांत्रिकी विभाग

(2) भू-जल के लिये नामांकित विषय विशेषज्ञ सदस्यों की सेवा की शर्तें, ऐसी होंगी, जैसा कि 'नियम' 9 एवं 10 में परिभाषित है।

(दो) जिला भू-जल प्रबंधन परिषद्‌ का कार्य निम्नानुसार होगा, -

(क) मैक्रो-वाटरशेड –ष्टिकोण के आधार पर और यथा निर्धारित दिशानिर्देशों के अनुसार जिला स्तरीय भू-जल सुरक्षा योजना को समेकित करना;

(ख) जिला भू-जल सुरक्षा योजना का कार्यान्वयन;

(ग) जिला भू-जल सुरक्षा योजना के कार्यान्वयन की निगरानी करना;

(घ) जल से संबंधित जागरूकता कार्यक्रम संचालित करना;

(ड.) अधिसूचित और गैर-अधिसूचित क्षेत्रों में सभी मौजूदा वाणिज्यिक, औद्योगिक, अधोसंरचना और थोक उपयोगकर्ताओं को पंजी—त करना;

(च) अधिसूचित/गैर-अधिसूचित क्षेत्रों में भू-जल निष्कर्षण के लिए अनुमति प्रदान करने की सिफारिश करना;

(छ) ड्रिलिंग एजेंसियों/ड्रिलिंग रिग मशीन का पंजीकरण करना;

(ज) ऐसे अन्य कार्य करना, जैसा कि राज्य भू-जल प्रबंधन और विनियामक प्राधिकरण द्वारा विहित या समनुदेशित किया जाये;

(झ) जिला मजिस्ट्रेट/जिला भू-जल प्रबंधन परिषद्‌ के अध्यक्ष, संबंधित नगरीय स्थानीय निकाय में सभी मौजूदा/नए घरेलू/पेय/—षि भू-जल उपयोगकर्ताओं के पंजीकरण के संबंध में संबंधित जिले के क्षेत्रीय अधिकारिता के भीतर नगरीय स्थानीय निकाय की समिति का गठन करेंगे तथा जल स्तर की निगरानी के लिए निगरानी नेटवर्क (पीजोमीटर का निर्माण और डीडब्ल्यूएलआर टेलीमेट्री की संस्थापना) स्थापित करना। पीजोमीटर की संख्या, नगरीय निकाय के क्षेत्र के अनुसार संबंधित नगरीय स्थानीय निकाय द्वारा विनिश्चित की जाएगी।

() जिला भू-जल प्रबंधन परिषद्‌ द्वारा राज्य भू-जल प्रबंधन और विनियामक प्राधिकरण के साथ समन्वय करना।

(तीन) जिला भू-जल प्रबंधन परिषद्‌ की निधि- जिला भू-जल प्रबंधन परिषद को अपने कार्यों को समुचित रूप से करने या इस अधिनियम के तहत शक्तियों का प्रयोग करने में सक्षम बनाने के लिए, राज्य सरकार/स्थानीय प्रशासन, आवश्यक सुविधाएं और बजटीय सहायता प्रदान करेगा।

6. {नियम 6 (एक)} 'विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति' - विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति का गठन किया जाएगा, जो विकासखंड में सभी मौजूदा/नए घरेलू और —षि भू-जल उपयोगकर्ताओं को पंजी—त करेगी, जिसमें निम्नलिखित पदाधिकारी शामिल होंगे,-

(क) अध्यक्ष - विकासखंड के मुख्य कार्यपालन अधिकारी, जनपद पंचायत

(ख) सदस्य सचिव - विकासखंड के अनुविभागीय अधिकारी, जल संसाधन उप प्रभाग

(ग) अन्य सदस्य-—षि, पंचायत और ग्रामीण विकास, उद्योग, लोक स्वास्थ्य और अभियांत्रिकी एवं वन विभाग से विकासखंड स्तर के प्रतिनिधि (प्रत्येक से एक) होंगे।

यह समिति, अपने कार्यों के सुचारू निर्वहन के लिए संबंधित अनुविभागीय अधिकारी (एसडीएम) से मार्गदर्शन और निर्देश लेगी और रिपोर्ट करेगी।

(दो) 'विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति' का कार्य निम्नानुसार होगा-

(क) जल से संबंधित जागरूकता कार्यक्रम संचालित करना;

(ख) विकासखंड के गैर-अधिसूचित और अधिसूचित क्षेत्रों की सभी मौजूदा/नए घरेलू, —षि भू-जल उपयोगकर्ताओं को पंजी—त करना, और

(ग) ऐसे अन्य कार्य करना, जैसा कि प्राधिकरण द्वारा विहित या समनुदेशित किया जाये।

(तीन) 'विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति' की निधि- विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति को अपने कार्यों को समुचित रूप से करने या इस अधिनियम के तहत शक्तियों का प्रयोग करने में सक्षम बनाने के लिए, राज्य सरकार/स्थानीय प्रशासन, आवश्यक सुविधाएं और बजटीय सहायता प्रदान करेगा।

7. जिला/स्थानीय प्रशासन द्वारा सहायता प्रदान करना-'अधिनियम' की धारा 24 और 'नियम' 28, 33 और 35 में परिभाषित कर्तव्यों और कार्यो के कुशल और सुचारू निर्वहन के लिए 'सीजीजीडब्ल्यूए' और इसके जिला, विकासखंड और नगरीय स्तर के निकायों को, सभी प्रशासनिक और कानून व्यवस्था संबंधी मुद्‌दों के समाधान हेतु जिला/स्थानीय प्रशासन द्वारा सहायता प्रदान की जायेगी।

8. मानदेय- समुचित निकाय के नामांकित सदस्यों को ऐसे मानदेय का भुगतान किया जायेगा जैसा कि, राज्य सरकार द्वारा विनिश्चत/विनिर्दिष्ट किया जाये। 9. बैठके- समुचित निकाय की बैठके, ऐसे समय पर होंगी, जैसा कि निकाय के अध्यक्ष द्वारा निर्देशित किया जायें, बशर्ते की लगातार दो बैठकों के बीच की अवधि, अधिक न हो,-

(क) विकासखंड स्तरीय भू-जल उपयोगकर्ता पंजीकरण समिति के मामले में, तीस दिन ;

(ख) जिला भू-जल प्रबंधन परिषद्‌ के मामले में, साठ दिन या जैसा कि आवश्यक समझा जाए ;

(ग) छत्तीसगढ़ भू-जल प्रबंधन और विनियामक प्राधिकरण के मामले में, 180 दिन या जैसा कि आवश्यक समझा जाए ;

तथापि समुचित निकाय, आवश्यकतानुसार अधिक बैठके आहूत कर सकेगा।

NOTIFICATION

No. GENCOR/11928//F 4-404/S-2/31/AV/ Ground Water Act/19 (Part.1. Ground Water is the single most important source of water for domestic, agricultural and industrial uses. It has been brought to the notice of State Government that uncontrolled and rapid extraction of ground water has resulted in alarming situation of declining ground water levels and depletion of ground water reservoirs in several areas of the state. In order to deal with the situation of serious ground water crisis in the state, it has been decided to make a law to provide for protecting, conserving, controlling and regulating ground water to ensure its sustainable management, especially in stressed rural and urban areas.

2. On the basis of above facts "Ground Water (Management and Regulation) Act 2022" (hereafter called Act) and "Chhattisgarh Ground Water (Management and Regulation) Rules 2024" (hereafter called Rule), Chhattisgarh Government has published and notified vide Chhattisgarh Gazette (Extraordinary) respectively on 16th January 2024 and 20th January 2025 for Management and Regulation of Ground Water Resources.

3. In the above context, as per rule 4, 5 and 6 of Chhattisgarh Ground Water (Management and Regulation) Rule 2024, Government of Chhattisgarh have decided to constitute 'Chhattisgarh Ground Water Management and Regulatory Authority', "District Ground Water Management Council" for all districts and "Block Level Ground Water User Registration Committee" for all blocks of Chhattisgarh.

4. {Rule 4 (1)} Chhattisgarh Ground Water Management and Regulatory Authority.-

(1) "Chhattisgarh Ground Water Management and Regulatory Authority" will be abbreviated as "CGGWA" will be functionl with effect from the date of issuance of this notification.

(2) The Chhattisgarh Ground Water Management and Regulatory Authority shall consist of following officials- 1. The Chief Secretary -Chairperson

2. The Secretary In charge, Water Resources Department -Member

3. The Secretary In charge, Finance Department - Member

4. The Secretary In charge, Public Health Engineering -Member Department

5. The Secretary In charge, Agriculture Department -Member

6. The Secretary In charge, Industries Department -Member

7. The Secretary In charge, Mineral Resources Department -Member

8. The Secretary In charge, Urban Administration -Member Development Department.

9. The Engineer-in-Chief, Water Resources Department -Member-Secretary

10. The Engineer-in-Chief, Public Health Engineering -Member Department 11. The Member Secretary, State Environment Conservation - Member Board 12. The Regional Director, Central Ground Water Board -Member (NCCR) Raipur

13. The Principal Chief Conservator of Forest -Member

14. Three Subject Experts having long standing working -Member Experience of ground water in the State of Chhattisgarh (to be nominated by the State Government)

15. An eminent person from Public/Non- Government -Member Organization/ Social Sector working in the field of ground water (to be nominated by the State Government)

(3) The term of office and the manner of filling the vacancies and other conditions of services of the Subject Experts and Eminent Persons from Public/Non- Government Organization/ Social Sector shall be such as defined in rule 9 and 10.

(4) Engineer-in-Chief, Water Resources Department, Chhattisgarh shall be the Nodal Executive Officer on behalf of the State Ground Water Management and Regulatory Authority.

(5) The office of the Engineer-in-Chief, Water Resources Department, Chhattisgarh, Shivnath Bhawan, Nava Raipur shall work as the Secretariat of the State Ground Water Management and Regulatory Authority.

(2) Functions of the State Ground Water Management and Regulatory Authority shall be –

(1) (a) to notify the areas for management and regulation of ground water resources as provided under Section 8;

(b) to de-notify the areas for management and regulation of ground water resources as provided under Section 10;

(d) to grant permission for ground water abstraction for industrial/ commercial / mining purposes in non- notified/notified areas;

(e) to collect levy for ground water abstraction;

(f) to develop and adopt updated technology for monitoring and Management mechanism for ground water uses;

(g) State Ground Water Management and Regulatory Authority for efficient and smooth working may delegate powers to exercise functions mentioned in this clause as it may deem fit;

(h) to supplement (and mandate, if needed) the installation and operation of ground water measurement devices if deemed suitable, in order to measure and monitor water being withdrawn, consumed and utilized;

(i) to supplement (and mandate, if needed) the creation of a water resource data base (focusing specifically on ground water if deemed necessary) to consolidate resource availability, usage and sustainability;

(j) to facilitate special ground water studies using sensors and mapping tools to help in monitoring and asset management;

(k) to prepare a Ground Water Resource Management Action Plan in coordination with District Ground Water Management Council and block-level authorities, to plan and prepare for sustainable interventions to ensure ground water resource longevity, judicious consumption and conservation / treatment interventions;

(l) to promote the conjunctive usage of ground water and surface water, wherever feasible;

(m) to adjudge the quantum of ground water being used for irrigation purposes and supplement through alternate sources, wherever deemed feasible;

(n) to converge with other Departments in order to ascertain the viability of Integrated Water Resource Management Plans, Water Security Plans, Roadmaps for Water Conservation and other sustainability measure;

(o) to monitor land-based disputes over ground water ownership and intervene if needed.

(2) Staff of the State Ground Water Management and Regulatory Authority, - (a) To enable the State Ground Water Management and Regulatory Authority to perform its functions properly or exercise the powers under this Act, the State Government may appoint/depute such number of technical personnel and other staff as it may consider necessary including all institutional support, facilities and the budget;

(b) The State Ground Water Management and Regulatory Authority shall function under the overall control and supervision of the State Government.

(3) Fund of the State Ground Water Management and Regulatory Authority,-

To enable the State Ground Water Management and Regulatory Authority to perform its functions properly or exercise the powers under this Act, the State Government shall provide necessary facilities and the budget.

5. {Rule 5 (1)} District Ground Water Management Council–

(1) District Ground Water Management Council shall be constituted and will be an overall unit for management of ground water resources at district level, which shall consist of, -

(a) Chairperson – Collector

(b) Vice Chairperson – Chief Executive Officer, Jila Panchayat

(d) Two Members as subject Expert having longstanding working experience/knowledge in the field of Ground water, to be nominated by the Chairperson;

(e) Other Members shall be the District Level Representatives (one each)

• Divisional Forest Officer, Forest

• Assistant Geohydrologist, District Ground Water Survey Unit,

• Regional Officer, Chhattisgarh Environment Conservation Board,

• Deputy Director, Agriculture Department,

• Commissioner / CMO, Nagar Nigam/Nagar Palika of District HQ (Local Body),

• General Manager/ Deputy Director, District Industry Center,

• Executive Engineer, Public Health & Engineering Department.

(2) The terms and conditions of the service of the nominated subject expert of ground water members shall be such as defined in rule 9 and 10.

(2) Functions of the District Ground Water Management Council shall be, -

(a) To consolidate District level Ground Water Security Plan, based on macro- watershed approach and as per the guidelines as may be prescribed;

(b) Implementation of District Ground Water Security Plan;

(d) To conduct water awareness program;

(e) To register all existing commercial, industrial, infrastructure and bulk users in notified and non-notified areas;

(f) To recommend grant of permission for ground water abstraction in notified /non-notified areas;

(g) Registration of Drilling Agencies / Drilling Rig Machine;

(h) To carry out such other functions, as may be prescribed or assigned by the State Ground Water Management and Regulatory Authority;

(i) District Magistrate/Chairman of District Ground Water Management Council shall constitute committee of Urban local body within the territorial jurisdiction of respective district regarding registration of all existing/ new domestic/drinking/agriculture ground water users in the concerned Urban local body and to establish monitoring network (Construction of Piezometer and installation of DWLR Telemetry) for monitoring of water level. Number of Piezometers will be decided by concerned Urban local body according to area of Urban body;

(j) Co-ordinate District Ground Water Management Council with the State Ground Water Management and Regulatory Authority.

(3) The fund of District Ground Water Management Council –To enable the District Ground Water Management Council to perform its functions properly or exercise the powers under this Act, the State Government/Local Administration shall provide necessary facilities and the budgetary support.

6. {Rule 6(1)} Block Level Ground Water User Registration Committee, – A Block-Level Ground Water User Registration Committee, shall be Constituted which will register all existing/ new domestic and agriculture ground water users in the block, which shall consist of, -

(a) Chairperson – Chief Executive Officer Janpad panchayat of the block ;

(b) Member- Secretary – Sub-Divisional Officer, Water Resources Sub-Division of block;

Panchayat and Rural Development, Industries, Public Health & Engineering and Forest;

This committee shall take guidance and instructions from concerning Sub- Divisional Magistrate (SDM) for smooth discharge of its functions and report to the SDM.

(2) Function of Block-Level Ground Water User Registration Committee shall be–

(a) to conduct water awareness programs;

(b) to register all existing / new domestic, agriculture Ground water user

of non-notified and notified areas of block; and

(3) Fund of Block Level Ground Water User Registration Committee – To enable the Block-Level Ground Water User Registration Committee to perform its functions properly or exercise the powers under this Act, the State Government/Local Administration shall provide necessary facilities and the budgetary support.

7. To provide support by the District/Local Administration.-For efficient and smooth discharge of duties and functions defined in Section 24 of the Act and rule 29, 31 and 33 of these rules, the CGGWA and its District, Block and Urban level bodies shall be supported by District/local administration to deal with all administrative and law and order related issues.

8. Honorarium.- Honorarium , as decided / specified by State Government, will be paid to the Nominated Members of the appropriate body.

9. Meetings.- The meetings of the appropriate body shall be at such time as may be directed by Chairperson of Body provided that the period between two consecutive meetings shall not exceed.

(a) Thirty days, in the case of Block Level Ground water User Registration Committee,

(b) Sixty days or as may be deemed necessary in the case of District Ground water Management council.

However, Appropriate Body may meet as many times as they deem fit.
