NOTIFICATIONS.

New Delhi, the 2nd March 1937.

No. F. 23-10/37-H.—In exercise of the powers conferred by section 7 of the Delhi Laws Act, 1912 (XIII of 1912), the Governor General in Council is pleased to extend to that part of the Province of Delhi which is described in the Schedule the United Provinces Town Improvement Act, 1919 (United Provinces Act VIII of 1919), with the following modifications, namely:—

In the said Act, as so extended,—

1. (i) For the words "Local Government" whereever they occur, the

words 'Chief Commissioner" shall be substituted,

(ii) For the words "the municipal board"

(a) wherever they occur in sections 29, 30, 38, 39 and 46 and in

sub-section (3) of section 54, and

(b) where they occur for the first time in sub-section (1) of section

45 and sub-section (1) of section 54,

the words ''a Municipal Committee or Notified Area Committee" shall be substituted.

(iii) For the words "the municipal board"—

(a) wherever they occur in sections 34, 36, 37 and 47, in sub- section (2) of section 51 and in clause (d) of sub-section (2) of section 103, and

(b) wherever they occur, otherwise than for the first time, in sub- section (7) of section 45 and sub-section (1) of section 54, ihe words "the Municipal Committee or Notified Area Committee" shall be substituted.

(iv) For the words "any municipal board" in section 87 the words "a Municipal Committee or Notified Area Committee" shall be substituted.

2. In section 1—

(i) sub-section {2) shall be omitted; and

(it) for sub-section (3) the following sub-section shall be substituted,

namely: —

"(2) It shall come into force at once".

" 3. Creotion and incorporation of Trust.—The duty of carrying out the provisions of this Act in the local area to which the Aot has heen extended shall, subject to the conditions and limitations hereinafter contained, bo vested in a Board to be called "The Delhi Improvement Trust" (hereinafter culled tho Trust), and such Board shull be u body corporate und have 2Jerpetual snecession und n commoti seal, and shall by (he said name sue or be sued."

5. Kor nei'.tioii 4 the following section shall be substituted, namely: —

"4. (htiwLitution of Tru.nl.—{1) The Trust shall consist of seven Trustees, namely: —

(a) a Chairman;

(b) an officer of dhe Central J'ublie Works Department;

((_•) Uiu Assiatant Director of Public lluultl, Delhi;

(d) a Vinuncial Adviser;

(e) two members ol the Municipal Committee ol Delhi;

(/) one other person.

(2) The Chairman and the persons referred to in clauses (/;), ((/) mid (f) of yub-seetion (1) shall be ap|)omted by the Chief Commissioner by notification,

(.?) The Assistant Director of Public Health, Delhi, shall be an cj-offifiu member of the Trust.

(4) The two members of the Municipal Committee referred to in clause (c) of sub-section (7) shall be elected by the Municipal Committee.

(/j) If the Municipal Committee does not, by such date as may be fixed by the Chief Commissioner, nlect a person to be a Trustee, the Chief Commissioner shall, by notification, appoint ti rrwrnbor of the Municipal Committee to be ii Trustee and any person so appointed shall he deemed to be a Trustee as if hn had been duly elected by the Municipal Com- mittee.''

6. In section 1—

(/) for the brackets and letter (v) the brackets and letter (c) shall be

substituted ;

(/(') for the brackets and letter ((/) tho following shall be substituted,

namely : —

"(!>), (d), or (/)"; and

(in) for the words "municipal board" the words "Municipal Com-

mittee" ahull bo substituted.

(i) at which a quorum is present and business is transacted ; imd (ii) which ho attends from the beginning' to the end thereof, or for such period as the person presiding ut the meeting may consider sufficient to juHtify the payment of the fee :

Provided that the aggregate amount of foes payable to unv person in respect of meetings of any kind held during am month shall not exceed mieli sum as the Chief Commissioner may by order in writing prescribe."

8. In sub-section (3) of section 10, for the words "its opinion" the

words "the opinion of the Chief Commissioner" shall lie substituted.

9. ]n section 12—

No. T, 23-10/37-H.—In exercise of the powers oonferred by section 7 of the Delhi Laws Act, 1912 (XIII of 1912), the Governor Goneral in Council is pleased to extend to that part of the Province of Delhi whieh is described in the Schedule sections £12, f>9, and B6 of the Rangoon Develop- ment Trust Act, 1920 (Burma Art V of 1920), with the following modifications, namely:—

1. In the said sections, as so extended, for the words "Local Govern- ment", and for the words "the Board", wherever they occur, the words "Chief Commissioner", and the words "tho Trust", shall, respectively, be substituted.

2. In section 32, as so extended—

(i) the words "and the provisions of this Act" shall be omitted;

and

(ii) for the words "expansion or development of the city or of any urea in the vicinity thereof to which the Local Government may, by notification, declare this Act to apply" the words "or development of the area to which this Aot has been oxtended'' shall be substituted.

3. Section 32, as so modified, find so extended, shall be read together

with, and as Chapter IIIA, entitled "GENERAL POWERS OF TRUST.", and as section 22A, of, tho United Provinces Town Improvement Act, 1919, as extended to the Province of Delhi,

4. In section 59, as go extended—•

(t) for sub-section (1) the following sub-section shall bo substituted,

namely: —

"Power of Trust to hold Government property.—(1) The Gov- ernment may, upon such terms as may be agreed upon between the Government and the Trust, place at the disposal of the Trust any properties, or any funds or dues, of the Government and thereupon the Trust shall hold or realise such properties, funds and dues in accordance with such terms."; and

(JV) in sub-section (2)—

(a) for the words "vested in the Board is roquired by tho Imperial or Local" tho words "hold by the Trust under sub-section (1) is required by the" shall be substituted; and

(b) for tho words "the rate of six per cent, per annum" the

words "such rate as may be fixed by the Chief Commie sioner" shall be substituted.

•5. In section 80, as so extended—-

(i) in sub-section (2)—

(a) the words "or any tax or fee" shall be omitted; and (b) before the words "may be recovered", the words "in res- pect of any properties, funds or dues placed at the dis- posal of the Trust under nub-section (1) of section 54A" shall be inserted; and

(ii) in sub-section (S)-the words "tax or foe" shall be omitted.

6. Sections 59 nnd 86, as so modified, and so extended, phall be read together with, and as Chapter VA, entitled "GOVEENMENT PEOPEETY HELD BY TBU8T", and as sections 54A and 64B, of, the United Provinces Town Improvement Act, 1919, aa extended to the Province of Delhi.

(it) in sub-soction (2), for the word "them" the words "the Trust"

New Delhi, the 2nd March 1937.

No. D./1303-F.—In exercise of the powers conferred by section 4 of the Local Authorities Loans Act, 1914 (IX of 3914), the Governor General in Council is pleased to direct that the following further amendment shall be ruiide- in the Loual Authorities Loana Rules, 1916".—

In rule 8-A of the said Bulcs, after the words, figure and brackets

"of sub-section (7)", the following shall bo inHerted, ntimely: —

"(or, iri the oase of the Delhi Improvement Trust, mentioned in

Hub-aeotion (1))"-
