No. 2 ( 12 ) /62 / Control-In exercise of the powers con- ferred on me by sub - clause ( 5 ) of Clause 21 of the Cotton Textile (Control ) Order, 1948 , I hereby direct that the following amendment shall be made in the Noti- fication No. 2 ( 2 ) / 62- Control, dated 4th May 1963 , namely :-
In the said Notification , the following shall be added , namely :-
"Provided that where the period specified in the foregoing paragraph does not apply to any pro- ducer by reason of the fact that his spinning plant came into existence or commenced work- ing only during or after the expiry of the said period or for any other sufficient reason , the Textile Commissioner may , by an order in writ- ing, fix a quantity of yarn to be packed in hank form every month by such producer , which , in the opinion of the Textile Commissioner is reasonable having regard to the machinery and other equipment installed by such producer and to the other circumstances of the case .
Provided further that if any producer satisfies the Textile Commissioner that such producer should be exempted from compliance with this direc- tive or that it should be modified in its applica- tion to him on account of one or more of the following reasons , namely :-
1. Variation in production of yarn due either to variation in the availability of cotton , power or pattern of production;
2. Any other reason including strike or lockout affecting the production and / or availability of yarn;
