SUBJECT : -Imports from the U.S.A. under the U.S. AID Loan No. 103- Armend- ment of Public Notice No. 52 - ITC ( PN ) / 64 , dated 24-6-1964.
No. 60 - ITC ( PN ) / 64 .-Attention is invited to Public Notice No. 32 - ITC ( PN ) / 64 , dated the 24th June , 1964 setting out the conditions applicable to import licences under U.S. AID Loan No. 103 .
2. The following amendments to the aforesaid Public Notice are notified:
I. In Annexure I-List of Eligible items , insert the following new item: --- 54-Sulphur .
II . In Annexure IV- List of items for which submission of "Notice to U.S. Business" is not necessary , add the following new item: - 36-Sulphur .
III . In Annexure V- List of U.S. Suppliers , add Sulphur as a new item 34 with the names of U.S. Suppliers and their Indian Agents as shown in Annexure to this Public Notice .

SUBJECT : -Import of Copper unwrought against S. Nos . 42/1 and 47/1 , Garage tools [ S. No. 275 ( 6 ) / IV ] , Motor vehicle parts ( S. Nos . 293 , 295 and 297 / IV ) , All other grades of sulphursulphur [ S. No. 25 ( b ) /V ] ,(V ] , Spare parts of earth- moving machinery [ S. No. 65 ( 5 ) ( ii ) ( a ) / V ] and Machine tools ( Part VI) from the U.S.A. under U.S. Aid Loan No. 103- April 1964- March 1965 .
No. 61-1TC ( PN ) /64 . Attention of the importers is invited to the import policies Indicated against the above items in the Red Book for the year April 1964- March 1965 , according to which quota /supplementary / other licences issued for specific items will be valid for imports from U.S.A. only . It has also been stated that the procedure to be followed for imports of the specific items from U.S.A. will be announced separately .
2. It has now been decided that quota/supplementary /other licences for import of the specific items from U.S.A. under U.S. Aid Loan No. 103 will be issued by the licensing authorities at ports / Chief Controller of Imports and Exports , New Delhi for the year April 1964-March 1965 on the basis indicated in the Annexure to this Public Notice .
3. The quota/ supplementary / other licences for import of the specific items under U.S. Aid will be granted subject to the terms and conditions laid down in Appendix to Ministry of Commerce Public Notice No. 52 - ITC ( PN ) / 64, dated 24th June 1901964 as amendeamended . TheThe quota/supplementary / other licences for import of the specific items will be issued onlyissued only on receipt of an intimation from the importers accepting the terms and conditions indicated in Appendix to Ministry of Commerce Public Notice No. 52 - ITC ( PN ) / 64 , dated 24th June 1964 as amended.

4. The quota/ supplementary / other licences issued for import of the specific items from U.S.A. under U.S. Aid Loan No. 103 will also be subject to the same conditions / restrictions / concessions mentioned in the relevant remarks against these items in the Red Book for April 1964 March 1965 .
5. As laid down in Ministry of International Trade Public Notice No. 27 - ITC ( PN ) /64 , dated 31st March 1964 the licences issued for import of specific items from U.S.A. under U.S. Aid on an annual basis will not be subject to the condi- tions applicable to annual licences issued for the year April 1964-- March 1965. It will also not be necessary for the licenseesthe licensees to present the licences for endorse- ments to the licensing authorities for validation of the second half of the licences and the licensees can utilise the licences issued under U.S. AID Loan No. 103 for the full value within the validity period of the licences .
6. Applications for quota/ supplementary / other licences for import of specific items from U.S.A. under U.A. Aid for the year April 1964-March 1965 should be superscribed as 'Under U.S. Aid Loan No. 103 ' and should be submitted in the usual form and manner to the licensing authorities concerned so as to reach them not later than the 31st August , 1964 .

( iii) Supplementary licences issued to established importers for import of garage tools for value upto ard including Rs . 5,000/ - will be ex- empted from the operation of the condition laid down in foot note-- Appendix 25 to the current Red Book according to which at least 25 % of the face value of licences issued for garage tools should be utilised for import of any or all the items starred in Apperdix 25 to the current Red Book .

Supplementary licerces for import of this item will be issued to established importers on a quota of 5 % as already indicated in para 2 of Apper dix 26 to the Current Red Book. The mini- mum value of licences in each in- dividual case willbe Rs . 1,000 / - .

(i) Supplementary licerces will be issued by the licensing authorities at ports to established importers forimport of spare parts of earth- moving machinery on a quota of 10 %
(ii) Licences to accredited agents of manufacturers will be issued by CCI &E for import of spare parts of earthmoving equipment within a limited ceiling.
(iii) Applications fromtions from accredited agents of manufacturers should be supported by the following docu- ments :-
(a) A certificate from the manufac- turers indicating the various models and the modelwi quantities of the equipment grouped under S. No. 65 ( 1-4) (vii ) (b) / V, actually shipped by them to India yearwise begi- ning from 1-1-1948 upto the Calendar year ending 31-12-58 .
(b) A Chartered Accountants . Certi- ficate certifying the notiot al c.i.f. prices of the yearwise imports of the equipment in question ard this evaluation should be based on the follow- ing formula:
(i) The quantitics actually ship- ped will be evaluated firstly on the basis of the current list prices in the U.S. cur- rency less distributors ' dis- count in full so as to arrive atthe nett current ex - factory prices.
( ii) To the rett current ex- factory price thus arrived at , 20 % should be added to Cover port charges, insurar cc , ocean freight , etc. so as to arrive at a rotional c.l.f. price . This rotional c.i.f. price should be con- verted into Irdian rupees at the following rate of ex- change:-
U.S.A. $ 1.00 Rs.4.77nP . (c) Information about servicing obligation and servicing faci- lities available at the disposal ofapplicants .

Quota licerces for import Eighteen months .
of machine tools other than those mentioned in Schedule B to Appendix II to the currert Red Book will be issued to established importers on a quota of 10 % of half of their best year's imports as already indicated in para 3 of Apperdix 11 to the current Red Book. The minimum value of quota licerces in each individual case will be Rs . 1,000 / - .
( i) The quota percentage indicated agairst the above items pertain to half yearly quota entitlement . The value of annual licences issued for these items urder U.S. Aid will be for double the value of halfycarly er titlement .
( it) The face value restriction/ the mirimum value licerces indicated agairst the above items will also be doubled in the case of annual licences issued for these items ur der U.S. Aid .
