No. 72 - ITC ( PN ) / 64 .--Attention is invited to Public Notice No. 52 - ITC ( PN ) / 64, dated the 24th June , 1964 , as amended by Public Notice No. 60 - ITC ( PN ) /64 , dated the 18th July , 1964 setting out the conditions applicable to import licences under U.S. AID Loan No. 103 .
2. The following amendments to the aforesaid Public Notice are hereby notified :-
I. In Annexure I ( List of Eligible Items ) , after Note 2 insert the following additional note :-

SUBJECT . Imports- Imports from U.S.A. under Aid Loan Nos . 217 and 082- Definition of U.S. source and origin .
No. 73 - ITC ( PN ) /64.-Import licences for machinery , components , raw materials etc. against U.S. Aid Loan No. DLF 217 or Aid Loan No. 082 have been issued from time to time subject to the terms and conditions set forth in Public Notice No. 74- ITC ( PN ) / 62 , dated the 26th June , 1962 and Public Notice No. 62- ITC ( PN ) / 63 , dated the 21st June , 1963 respectively . One of the conditions is in regard to the source and origin of the goods . It has been decided that the following definition of United States source and origin shall apply to procure- ment under the subject loans :-
"Goods shall be considered to be of US . source and origin when :-
( a) Such goods are shipped from a United States port , or from a free port or bonded warehouse if shipped from said port or bonded warehouse in the form in which received when shipped there from a United States port;
(b) Such goods are mined , grown , or produced through manufacturing , processing, or assembly in the United States;
( c) Not more than 10 percent of the lowest price ( excluding ocean trans- portation and marine insurance ) at which the supplier makes the goods available for export sale represents the cost ( delivered to point of production ) of imported components ;
(d) All imported components of such goods were imported from certain free-world countries ( AID Geographic Code 899 ) ; and
(e ) Neither the commodity nor the transaction may be one which is pro- hibited by the Foreign Assets Control Regulations ( Communist China) ."

This definition shall apply to all orders placed on or after the 1st October , 1964 against licences under AidAid Loan No. DLFDLF 2217 or under Aid Loan No 082 as the case may be .
2. In respect of orders placed on or after the 1st October , 1964 for goods to be imported against the import licences under aid Loan No. DLF 217 or under Ald Loan No. 082 , as the case may be , the importer shall ensure that the U.S.U.S. Supplier attaches to or endorses on each invoice presented for payment certificate on source and origin as in the form reproduced below:-

" I ( We ) hereby certify that the " source " ( as defined by A.1.D. ) of the com- modities listed on the attached invoice or invoiced herein is as shown below and in the source block of the A.I.D. suppliers' certificate form and that such invoiced commodities were mined, grown , or produced in a country or countries covered by AID Geographic Code ( Insert the Geographie Code number specified by the importer ) .
" I ( We) further certify , that to the best of my ( our ) information and belief, with respect to any produced commodity invoiced ( a ) the cost of components (delivered to point of production ) acquired by the pro- ducer of the commodity in the form in which imported into the country of production from free - world countries other than countries covered by A I.D. Geographic Code (Insert the Geographic Code number specified by the importer ) , does not exceed in total cost 10 per cent of the lowest price ( excluding the cost of ocean transportation and marine insurance ) at which 1 ( We ) make the commodity available for export sale ( whether or not financed by A.I.D. ) , and ( b ) the produced commodity does not contain any com- ponents imported from countries not included under A.I.D. Geographic Code 899 or prohibited by the Foreign Assets Control (FAC) or Cuban Assets Control ( CAC ) Regulations of the U.S. Treasury Deptt. , or ( c ) if A.I.D. has excepted the commodity from any of the foregoing requirements , the commodity meets all con- ditions specified by A.I.D. in connection with such excer.on .

The above certificate must be signed by the supplier or his authorised representative . The invoices with certificates of source and origin duly endorsed on or attached to them should be submitted by the importer along with other documents to the Ministry of Finance ( Department of Economic Affairs ) , New Delhi .
3. Public Notice No. 55 - ITC ( PN ) / 64, dated the 9th July , 1964 issued earlier on the subject shall be treated as cancelled .
SUBJECT . Imports from U.S.A. under U.S. AID Loan No. 103 - Amendments to Public Notice No. 52 - ITC ( PN ) / 64 , dated the 24th June , 1964 .
No. 74 - ITC ( PN ) /64.-Attention is invited to Public Notice No. 52 - ITC ( PN ) /64 , dated the 24th June , 1964 , as amended by subsequent Public Notices ( i ) No. 60- ITC ( PN ) / 64, dated the 18th July 1964 and ( ii ) No. 72 - ITC ( PN ) /64, dated 2nd September 1964, setting out the conditions applicable to import licences under U.S. AID Loan No. 103 .

2. The following further amendments to the aforesaid Public Notice No. 52- ITC ( PN ) / 64, dated the 24th June , 1964 are notified :-
I. In the Appendix :
(a) In clause ( 1 ) for the existing provisions against items 1 to 5 thereof , substitute revised provisions as in Enclosure I to this Public Notice .
(b) In Clause ( vili ) , after the words , " itemised invoice duly marked 'paid' " , occurring in the seventh sentence thereof , insert the following: -
"and supported by the certificate of source and origin as in the Annexure II" .
(c) In clause (viii ) , at the end , insert the following as a separate sub - para: ---
"All invoices and AID Suppliers' certificate should be made out in terms of U.S. dollars only and all payments to the foreign suppliers etc. should be effected in that currency only . "
(d) In clause ( xii ) , delete the third sub - paragraph which requires the importer to apply to the Reserve Bank of India , Bombay for release of necessary foreign exchange for the payment of ocean freight to third country vessels and in its place substitute the following :-
"In order to facilitate remittance of ocean freight in cases where third country vessels are used in the circumstances and under the con- ditions set forth in the preceding two sub - paragraphs of this clause, the importer should , at the time of opening letters of credit against Ifcences issued under AID Loan No. 103 , ensure that it is stipulated that in addition to the shipping documents etc. required for pur- poses of negotiation , the suppliers or shippers should produce the prescribed certificate regarding non - availability of Indian vessels , in the event of goods upto 40 per cent tonnage limit being trans- ported by third country vessels , for drawing the freight amount under the Letter of Credit . "
II . In Annexure II :
for the existing form of certificate regarding source and origin , substitute the revised form of certificate as given in Enclosure II to this Public Notice . This amendment shall take effect from the 1st October , 1964 .
III . In Annexure VI ( Documents required from suppliers ) :
renumber item ( 5 ), ie the last item , as item ( 6 ) and insert the following as item No. 5 .

3. The certificate on source and origin in the revised form as given in Enclosure II to this Public Notice will apply to all orders placed on or after the 1st October , 1964 against the Import Licences .
