NOTIFICATION
New Delhi-I, the 28th May, 1965
S.O. 1729.—In pursuance of sub-section (2) of section 9 of the Delimitation Commission Act, 1962, the Delimitation Com- mission hereby publishes its proposals in respect of the distribution of the seats allotted to the State of Gujarat in the House of the People and the seats assigned to the Legislative Assembly of that State to territorial constituencies and the delimitation thereof and specifies the 3rd July, 1965 as the date on or after which the proposals will be further considered by it.
Any objections or suggestions in regard to these proposals should reach the Secretary of the Delimitation Commission (Talkatora Road, New Delhi-I), before the said date. It will facilitate prompt consideration if they are in English.

1. The territorial constituencies into which the State of Gujarat shall be divided for the purpose of elections to (a) the Legislative Assembly of the State and (b) the House of the People and the extent of each constituency and the constituencies which are reserved for the scheduled castes or the scheduled tribes as the case may be, shall be as shown in Table A and Table B, respectively.
2. Where the name of a constituency as shown in the Tables is distinguished by the brackets and letters "(SC)", the seat in that constituency is reserved for the Scheduled Castes; and where such name is distinguished by the Brackets and letters "(ST)", the seat in that constituency is reserved for the Scheduled Tribes.

DISSENTING PROPOSALS OF ASSOCIATE MEMBERS
We believe that certain principles should have been uniformly taken as the basis for delimitation. One such principle should be that as far as possible an administrative unit should not be disturbed and if at all that unit is not able by itself to form a constituency, only the minimum population should be added to it. And the second such principle should be that the reservation of either the Schedule Caste or Schedule Tribe seat should be on the basis of the highest percentage of the particular community in any constituency.
We find that these principles are not observed in delimitation of Consti- tuencies in the Gujarat State. Though the percentage of Schedule Caste is higher in Surendranagar and Banaskantha Parliamentary Consti- tuencies, Patan has b3en allotted a Schedule Caste reserved seat- We think that the reservation should be in Surendranagar Constituency which hae the highest percentage of Schedule Caste population.
Similarly, while allocating Schedule Caste assembly reserved seat for a district in a State, the percentage of Schedule Caste in the district should be the basis. We find that here also this principle is not adhered to. Though Kutch District with a percentage of Schedule Caste of 0-51, and Surendranagar with a percentage of 0-54 are allotted a reserved Schedule Caste seat each, Rajkot District with a concentration of 0-57 percentage is not allotted any. Moreover such a seat has been allotted to Amreli District with only a Schedule Caste percentage of 0-37. We think that this is not fair. We submit that the reservation of Schedule Caste reserved seat should be in Rajkot District i.e., of Wankaner Assembly Constituency and that the Dhari-Kodinar Assembly Constituency In Amreli District should not be so reserved.
Thirdly we submit that though Cambay Taluka has an administrative unit in Kaira District has th<; highest percentage of Schedule Caste
53a THE GAZETTE OF INDIA EXTRAORDINARY [PAW H-fcO. "(li)]population, in allocation of a Scheduled Caste reserved seat, it is the Matar Assembly Constituency that gets this reservation. It will be observed that Matar Assembly Constituency gets the highest percentage of Schedule Caste only because of additional population that is put in that constituency from Cambay Taluka. Though the Cambav Consti- tuency itself has been formed with 121,052 persons, Matar has been given 26,292 persons from Cambay Taluka and thus this Constituency has a population of 127,611, thus artificially raising its percentage of Schedule Caste. If the average population per seat in this district is 123,506 and that minimum and maximum required is 111,237 and 135,955 respectively, we submit that the number of persons added to Matar to form Assembly Constituency should have been only sufficient for minimum requirement. If that is done, the Schedule Caste reserved seat will not be artificially shifted to an administrative unit with a lower Schedule Caste percentage. Therefore, we submit that Matar Assembly Constituency should be formed with only minimum requirement and if that is not possible, then as a second alternative, with only average population for a seat in this district and only thereafter the percentage of Schedule Caste should be calculated. The reserved Schedule Caste seat then should be allotted to the Constituency with higher percentage.
