NOTIFICATION
New Delhi , the 19th June 1965
G.S.R.866. In exercise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Central Excise Rules , 1944 , the Central Government hereby exempts staple fibre of cellulosic origin of 1.51.5 denier and above (falling ununder Item No. 18 of the First Schedule to the Central Excises and Salt Act , 1944 ( 1 of 1944 ) used in the spinning of yarn containing such staple fibre and cotton from so much of the duty of excise leviable thereon under the said Act as is in excess of 10 paise per kilogram:
Provided that-
(a) that procedure laid down in rule 56A of the said Rules is followed in relation to the spinning of such yarn;
(b) the manufacturer claiming exemption under this notification shall not spin yarn made wholly out of such staple fibre while such yarn is being spun;
Provided further that nothing contained in this notification shall apply to such staple fibre if the yarn ( spun out of it and cotton ) also falls under the said Item No. 18 .
