2. In accordance with the provisions contained in para 18 of the aforesaid policy, the Regis- tered Exporters of items other than gem and jewellery and exposed cinematographic films are required to submit, among other document.1), the following documents along with the applications for grant of replenishment licences to establish the fact of export:—
(a) Shipping bill duly authenticated by Customs (except in case of exports by pott or V. P. P.);
(6) Bill of lading/airway bill duly attested by the Shipping Company/Airway Company (Postal receipt in case of export by post);
(c) Invoices duly attested by the negotiating banks.
3. It has been represented on behalf of the exporters that the production of the above-men- tioned documents entails an avoidable waste of time and energy on their part and thnt some means should be found to obtain certification of the exports effected by them from the Authorised Dealers in Foreign Exchange, through whom their shipping documents have necessarily to pass in accor- dance with the Foreign Exchange Regulations, The position has accordingly been reviewed by the Government and it has been decided that in respect of exports made on or after 1-10-1967, and on which replenishment licences are to be claimed, the Registered Exporters should get such exports certified by the Authorised Dealer in Foreign Exchange in the process of passing their shipping documents through him. For this purpose, the following procedure has been laid down:—
(t) Simultaneously with handing over his shipping documents to the Authorised Dealer in Foreign Exchange, the exporter should present to the latter in triplicate declara- tions as in Form 1 for exports made on outright sale basis and in Form 2 for ex- ports on consignment basis. The specimen Forms. 1 and 2 are given at Anncxuic I and II to this Public Notice;
(w) The Bank will certify and countersign the declaration after necessary verification with reference to the shipping documents. The document will then serve as a bank certificate,
(iu) Thereafter the Bank will pass on one copy of the certificate along with a copy of the invoice to the licensing authority named in the declaration-ewm-ccrtificatc, one copy to the exporter., and retain the third copy for its own record;
356 THI GAZETTE OF INDIA EXTRAORDINARY [PART I - S EC 1](iv) The exporter at the lime of submitting his application for grant of import reple- nishment licence in accordance with the prescribed time schedule, will quote in the application, which will be commoJity group-wise, the number and date of the certificates issued by the Bank for each of the shipments covered in the application.
4. In the case of exports made on consignment basis, the Authorised Dealer in l'Oreifin Ex- change will countersign and pass on the Bank certificate on Form 2, to the licensing authority only 4fter realisa-i'in of foreign exchange. The exporters in such cases will he required to sub- mi: tn;ir applications f.Jr grant of replenishment licences during the month succeeding the iju"rter of pjyimn!:. To this extent para 16 of Part "B", Section III of the Import Trade Control Policy Book for April, I957-M"rch, 195s ani para 10^(3) of the Import Trade Control Ilavid Honk of Rubs & Procedure, 1967, may be deemed to have been amended.
5. With the introduction of above procedure, the requirement regarding production (along with the application; of copies of the various documents mentioned in para 2 above has been daae away with. However, the applications, as usual, will be accompanied by T. R. 5 copies of ilist of itetrii applied for, nomination and A. U. licence, if any.
6. Notwithstanding the above, the licensing Authority may, wherever considered neces- sary, call for any export document from the exporter.
