ORDER
New Delhi, the 5th October 1968
S.O. 3515. In exercise of the powers conferred by section 5 of the Essential Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby directs that the powers conferred on it by sub - section ( 1 ) of section 3 of the said Act to make orders to provide for the matters specifted in clauses ( c ) , ( d ) , ( e ) , ( f ) , ( g ) , ( h ) , ( i ), ( ii ) and ( 1 ) of sub - section ( 2 ) thereof shall , in relation to all commodities other than foodstuffs and fertilisers ( whether inorganic , organic or mixed ) , be exer- cisable also by the Government of the State of Jammu and Kashmir subject to the following conditions , namely.-
1 ( I ) in regard to delegation of powers under the said clause ( c ) : ---
( i ) where the price at which any essential commodity may be bought or sold is controlled by or under any other law for the time being in force , no order shall be made in pursuance of the powers hereby de- legated;
( in ) where the price is not so controlled , no order shall be made in pursuance of the powers hereby delegated in respect of any essential commodity ,
(a) if the wholesale prices , or retail prices , or both , of such commodity have been fixed by the manufacturers or producers thereof with the approval of the Central Government , except on the basis of such prices;
(b) in any other case except with the prior concurrence of the Central Government ;

(2) powers under the said clause ( c ) shall be exercised by the Government of the State of Jammu and Kashmir or an officer authorised by that Government 2. in regard to orders under the sald clause ( f ) , prior Central Government shall be obtained , concurrence of the 3. in making an order relating to any of the matters specified in the said clause (1 ) , the Government of the State of Jammu and Kashmir shall authorise only an officer of that Governrcent ;
4. no order shall be issued in pursuance of the powers hereby delegated if It is inconsistent with any order issued by the C'entral Government under the said Act .

एस ० श्रो ० 3516:- आवश्यक वस्तु अधिनियम 1955 ( 1955 का 10 ) की धारा 5 द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एसद्वारा निदेश देती है कि उक्त अधिनियम की धारा 3 की उपधारा ( 2) के खण्ड ( ग ) , ( घ ) , ( ङ ) , ( च) , ( छ) , ( अ) , ( स) , ( शश ) और ( प) में विनिर्दिष्ट विषयों के लिए उपबन्ध करने के हेतु श्रादेश करने के लिये उक्त अधिनियम की धारा 3 की उपधारा ( 1 ) द्वारा उसे प्रदत्त शक्तिया खाद्य पदार्थों और उर्वरकों से ( चाहे वे कार्बनिक हों, अकार्बनिक हों या मिश्रित हों ) भिन्न सब वस्तुभों के सम्बन्ध में जम्मू-कममीर राज्य की सरकार द्वारा भी निम्नलिखित शर्तों के अध्यधीम प्रयुक्त की आ सकेगी, अर्थात्
1. खण्ड ( ग ) के अधीन शक्तियों के प्रत्यायोजन के बारे में यह है कि--
( i ) जहां वह मूल्य , जिस पर कोई आवश्यक वस्तु खरीदी या बेची जा सकती है, किसी अन्य तत्समय प्रवृत्त विधि के द्वारा या अधीन नियंत्रित हो , वहां एतद्वारा प्रत्यायोजित शक्तियों के अनुसरण में कोई आदेश नहीं किया जायेगा ;
( ii ) जहां मूल्य ऐसे नियंत्रित न हों यहां किसी आवश्यक वस्तु के सम्बन्ध में एतद्वारा प्रत्यायोजित शक्तियों के अनुसरण में कोई आदेश-
( क) यदि उस वस्तु के थोक मूल्य अथवा फुटकर मूल्य, अथवा दोनों , उसके विनिर्माताओं अथवा उत्पादकों द्वारा केन्द्रीय सरकार के अनुमोदन से नियत किए गए हों तो ऐसे मूल्यों के आधार पर के सिवाय नहीं किया जायेगा ।
(ख ) किसी अन्य मामले में, केन्द्रीय मरकार की पूर्व सहमति के सिवाय नहीं किया जाएगा ।
( 2 ) खण्ड ( ग ) के अधीन शक्तियां जम्मू- कश्मीर राज्य सरकार अथवा उस सरकारद्वारा प्राधिकृत किसी आफिसर द्वारा प्रयुक्त की जायेगी ।
2. खण्ड ( च ) के अधीन आदेशों के बारे में , केन्द्रीय सरकार की पूर्व सहमति अभिप्रा की जायेगी;

3. खण्ड ( क ) में विनिर्दिष्ट किसी भी मामले के सम्बंध में आदेश करने में जम्मू- कममीर राज्य की सरकार फेवल उस सरकार के आफिसर को ही प्राधिकृत करेगी;
4. एतद्वारा प्रत्यायोजित शक्तियों के अनुसरण में कोई आदेश जारी नहीं किया जायेगा यदि वह उक्त अधिनियम के अधीन केन्द्रीय भरकार द्वारा जारी किये गये किसी आदेश से असंगत है ।
