NOTIFICATION
New Delhi, the 4th December 1968
S.R.O. 17E.—In exercise of the powers conferred by section 3 of the Canton- ments (Extension of Rent Control Laws) Act, 1957 (46 of 1957), the Central Gov- ernment hereby extends, to the Cantonment of Nasirabad, the Rajasthan Premises (Control of Rent and Eviction) Act, 1950 (Rajasthan Act XVII of 1950), as in force, on the date of this notification, in the State ci Rajasthan with the following modifications, namely: — In the said Act,—
(1) (a) for the words "a local authority", wherever they occur, except in section "8, the words "the Cantonment Board" shall toe substituted;
(b) for the words "State Government", wherever they occur, except in sections 3, 19A and 22, the words "Central Government" shall be sub- stituted;
(2) in section 2—
(a) for sub-section (1), the following sub-section shall be substituted,
namely: —
"(1) This Act extends to the Cantonment of Nasirabad";
(b) in sub-section (2) —
38 THE GAZtlTE OF INDIA EXTRAORDINARY |TART 11- Si <\ 4i (ii) in the provisp lor clause (e), the following clause shall be suuslmu- ed, namely: —"(e) to any house within the Cantonment which is, or may be, appro- priated by the Central Government on lease under the canton- ments (House—Accommodation) Act, 1923 (6 of 1923,);"
(3j in section 3—
(a) clause (i) shall be relettered as clause (ii) an in the clause as so re- lettered, the words "or sueh other Magistrate as the State Government may empower in this behalf" shall be omitted;
(b) before clause (ii) as so relettered, the following shall be inserted as clause (i), namely: —
"(i) "Cantonment Board" means the Cantonment Board constituted for the Cantonment of Nasirabad under the Cantonments Act, 1924 (2 ol 1&24)";
(c) clause (via) shall be omitted;
(4) in section 6, in sub-section (2), the second proviso shall be omitted;
(5) in section 8, in sub-section (3), for the words "a local authority having jurisdiction", the words "the Cantonment Board" shall be substituted;
(6) section 13A shall be omitted;
(7) in section 19, for the words "municipal bye-laws", the words "bye-laws of the Cantonment Board" shall be substituted;
(8) In section 19A, for the Explanation, the following Explanation shall be sub- stituted, namely: —
"Explanation.—For the purposes of this section and sections 19B and 19C, "the court" means— "(i) the court of the Munsif, and (ii) the court of the Civil Judge, where there is no court of Munsif having jurisdiction over the area.";
(9) in section 22, in sub-section (3), the words "or such authority as the State Government may from time to time appoint in that behalf" shall tjajjwrttted';
(10) in section 26, for the words "in areas to wHIcTi lints Act extends for the time being", the ^vorda "in the Cantonment of Nasirabad" shall be substituted;
(11) in section 11—
(i) in sub-section (1), for the words and figure "in areas to which this Act has been extended under section 2, pending on the date specified trt the notification under that section"; the words "in the Cantonment of Nasirabad pending on the date of commencement of this Act" shall be substituted;
(ii) sub-sections (2), (3) and (4) shall be omitted;
(12) in section 28, for the words "in the whole or any part of Ttajasthan", the words "in the Cantonment of Nasirabad" shall be substituted.
(13) sections 30 and 81 shall be omitted;
(14) the Schedule shall be omitted.
