NOTIFICATION

New Delhi , the 3rd March 1969

S.O. 837. Whereas a vacancy nas been caused in the Council of States by the death of Shri Niranjan Singh , a member elected to the Council of States by the elected members of the Legislative Assembly of the State of Madhya Pradesh , before the expiration of his term of office;

Now, therefore , in pursuance of the provisions of sub - section ( 1 ) of section 147 of the Representation of the People Act, 1951 , the Election Commission hereby calls upon the elected members of the Legislative Assembly of the State of Madhya Fradesh to elect , in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person to fill the vacancy so caused before 26th March . 1969 .

S.O. 838. In pursuance of the provisions of sub - section ( 1 ) of sectionion 39 of the Representation of the People Act , 1951 , the Election Commission hereby ap- points for the election to the Council of States to be held in pursuance of its notification No. 100/ CS- MP/ 6 / 68 ( 1 ) , dated the 3rd March , 1969 :-

(a) the 10th March . 1969 , as the last date for making nominations;

(b) the 11th March , 1969 , as the date for the scrutiny of nominations;

(d) the 22nd March , 1969 , as the date on which a poll shall , if necessary, be taken ; and

(e) the 26th March , 1969 , as the date before which the election shall be completed .

S.O. 839. In pursuance of section 56 of the Representation of the People Act, 1951 , the Election Commission hereby fixes the hours from 10.00 a.m. to 4.00 p.m. as the hours during which a poll shall , if necessary , be taken for the election to the Council of States to be held in pursuance of its notification No. 100 / CS- MP / 6/68 ( 1 ) , dated the 3rd March , 1969 .

S.O. 840.- In exercise of the powers conferred by section 21 of the Represen- tation of the People Act , 1951 , the Election Commission , in consultation with the Government of Madhya Pradesh , hereby designates the Secretary , Madhya Pradesh Vidhan Sabha . Bhopal , to be the Returning Officer for the election to the Council. of States to be held in pursuance of its notification No. 100 / CS - MP / 6 / 68 ( 1 ) , dated the 3rd March , 1969 .

S.O. 841. In exercise of the powers conferred by sub - section ( 1 ) of section 22 of the Representation of the People Act , 1951 , the Election Commission hereby appoints the Deputy Secretary , Madhya Pradesh Vidhan Sabha . Bhopal , to assist the Returning Othcer for the election to the Council of States to be held in pur- suance of its notification No. 100 / CS - MP / 6 / 68 ( 1 ) , dated the 3rd March , 1969 , in the performance of his functions .

ए०५० ओ ० 842. यतः मध्य प्रदेश विधान सभा के निर्वाचित सदस्यों द्वारा राज्य सभा के लिए निर्वाचित सदस्य श्री निरजन सिह की पदावधि के अवसान से पूर्व मृत्यु हो जाने से राज्य सभा में एक स्थान रिक्त हो गया है।

श्रतः , अत्र , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 147 की उपधारा ( 1 ) के उपबन्धों के अनुसरण में निर्वाचन आयोग मध्य प्रदेश राज्य की विधान सभा के निर्वाचित सदस्यों से एतद्वारा अपेक्षा करता है कि वे ऐसे हुई रिक्ति को भरने के लिये 26 मार्च, 1969 से पूर्व, उक्त अधिनियम कें और तद्धीन बनाए गए नियमों और श्रादेशों के उपबन्धों के अनुसार एक व्यक्ति निर्वाचित कर दें ।

ए १० श्रो० 843.-लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 39 की उप - धारा ( 1 ) के उपबन्धों के अनुसरण में निर्वाचन आयोग अपनी अधिसूचना सं ० 100/ रा ० स ० -म ० प्र ०/ 6/68 ( 1 ) , तारीख 3 मार्च, 1969 के अनुसरण में राज्य सभा के लिये होने वाले निर्वाचन के बारे में---

(क ) नाम निर्देशन करने के लिये अन्तिम तारीख-- 10 मार्च , 1969 ;

(ख) नाम निर्देशनों की समवीक्षा की तारीख-11 मार्च , 1969 ;

(ग ) अभ्यथिता वापस लेने की अन्तिम तारीख- 13 मार्च , 1969 ;

(ष ) वह तारीख जिसको यदि आवश्यक हो, तो मतदान होगा-22 मार्च , 1969;

तथा ( ङ) यह तारीख जिसके पूर्व निर्वाचन समाप्त कर दिया जाएगा 26 मार्च , 1969 एतद्वारा नियत करता है ।

ए५० श्रो०. 844-लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 56 के अनुसरण में निर्वाचन आयोग अपनी अधिसूचना संख्या 100 ( रा ० स ० -म० प्र ०/ 6/ 68 ( 1 ) , तारीख 3 मार्च, 1969 के अनुसरण में राज्य सभा के लिए होने वाले निर्वाचन के लिए 10 बजे ( र्वात से 4 बजे अपराह्न तक का समय उस समय के रूप में एतद्वारा नियत करता है जिसके दौरान यदि आवश्यक होतो, मतदान होगा ।

एस ० प्रो० 845.-लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 21 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निर्वाचन आयोग , मध्य प्रदेश सरकार के परामर्श से , अपनी अधिसूचना सं ० 100/ रा ० - स ० / म ० प्र०/ 6/ 68 ( 1) , तारीख 3 मार्च, 1969 के अनुसरण में राज्य सभा के लिए होने वाले निर्वाचन के लिए मध्य प्रदेश विधान सभा , भोपाल के सचिव को रिटर्निंग आफिसर के रूप में एतद्वारा पदाभिहित करता है ।

एस ० प्रो ० 846.--लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 22 की उप-धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निर्वाचन आयोग अपनी अधिसूचना सं ० 100/ रा ० स०- म ० प्र०/ 6/ 68 ( 1 ) , तारीख 3 मार्च , 1969 के अनुसरण में राज्य सभा के लिए होने वाले निर्वाचन के लिए रिटर्निंग आफिसर को उसके कृत्यों के पालन में सहायता करने के लिए मध्य प्रदेश विधान सभा के उप -सचिव की एत द्वारा नियुक्ति करता है ।
