NOTIFICATION
New Delhi , the 11th April , 1969
S.K.O. 3E.- Whereas the Central Government is of opinion that it is neces- sary to appoint a Commission of Inquiry for the purpose of making an inquiry into definite matters of public importance hereinafter specifted;
Now, therefore , in exercise of the powers conferred by Section 3 of the Com- missions of Inquiry Act , 1952 ( 60 of 1952 ) , the Central Government hereby appoints a Commission of Inquiry consisting of a single member , namely , Shri Sudhanshu Kumar Das , Retired Judge, Supreme Court of India , to inquire into the following matters:-
(1 ) The facts and circumstances relating to the firing by the Defence Secu- rity Corps personnel at the Gun and Shell Factory , Cossipore , 8th April , 1969 ; and on
( il) whether the said firing was justified in the circumstances of the case .
2. The Commission shall make its report to the Central Government not later than the 31st July , 1969 .
3. The Central Government , being of opinion that , having regard to the nature of the inquiry to be made and other circumstances of the case, all the provisions of sub - section ( 2 ) , sub - section ( 3 ) , sub- section ( 4) and sub - section ( 5 ) of section 5 of the Commissions of Inquiry Act , 1952 ( 60 of 1952 ) , should be made applicable to the said Commission , hereby directs under sub - section ( 1 ) of the said section 5 that all the said provisions shall apply to the said Commission .
