New Delhi , the 19th May 1969
G.S.R. 1233 ,-In exercise of the powers conferred by sub - rule ( 1) of rule 2 of the Cenual Excisc Rules , 1944 , read with sub- section ( 3 ) of section 3 of the Additional Duties of Excise ( Goods of Special Importance ) Act , 1957 (58 of 1957 ) , the Central Government being satisfied that the scarcity conditions due to recent ſamine in the State of Rajasthan are in the nature of a maojr calamity , hereby exempts cotton fabrics donated till 31st July , 1969 , toi relief work in that State from the whole of the duty of excise and the additional duty of excise , it any , leviable thereon and also the duty of excise on cotton yarn contents in respect of cotton fabrics :
Provided that ---
(a) it is certified by the manufacturer of such goods on the relevant clearance documents that the goods are intended to be donated for the relief of famine affected people in the said State without discrimination on grounds of religion , race or caste or any of them and distributed free and without making any charge therefor ,
(1) good , are sent directly from the factory of manufacture to any officer or erganisation specified in the Schedule hereto annexed , and

(c) the manufacturer produces before the Central Excise Officer - in -Charge of his factory within two months of the date of removal of the goods from. the factory or such extended period as the Collector may allow , a certificate from the officer or organisation specified in the said schedule ( to whom the goods were consigned) that the goods have been received by such officer or organisation for famine relief work .

नई दिल्ली, 19 मई , 1969
सा० का ० नि० 1234:-- अतिरिक्त उत्पाद शुल्क ( विशेष महत्व का माल ) अधिनियम , 1957 ( 1957 का 58) की धारा 3 की उपधारा ( 3 ) के साथ पठित केन्द्रीय उत्पाद- शुल्क नियम , 1944 के नियम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, अपना यह समाधान हो जाने पर कि राजस्थान राज्य में हाल के दुभिक्ष के कारण उत्पन्न हुई दुर्लभता की दशाएं घोर विपत्ति स्वरूप हैं , उस राज्य में सहायता कार्य के लिए 31 जुलाई , 1969 तक संदान में दिये गये सूती वस्त्रों पर से , उन पर उदग्रहणीय समस्त उत्पाद शुल्क और अतिरिक्त उत्पाद- शुल्क, यदि कोई हो, और उन कपड़ों में जितना सूनी धागा लगा है उस पर उत्पाद शुल्क की,. एतद्वारा , छूट देती है :
परन्तु यह तब जब कि:-
( क ) ऐसे माल के विनिर्माता ने निकासी संबंधी सुसंगत दस्तावेजों के आधार पर यह प्रमाणित किया हो कि वह माल उस राज्य में दुर्भिक्ष पीड़ित लोगों के सहातार्थ धर्म, मूलवंश या जाति या इनमें से किसी के आधार पर भी विभेद किये बिना, संदान किये जाने के लिये तथा उसके लिये कोई प्रभार लिये बिना मुफ्त वितरित किये जाने के लिये आशयित है;
( ख ) माल सीधे विनिर्माण-कारखाने से, एतदुपाबद्ध अनुसूची में विनिर्दिष्ट किसी आफिसर या संगठन को भेजा गया है ; और
( ग) विनिर्माता, कारखाने से माल को हटाने की तारीख से दो मास के भीतर या बढ़ाई गई ऐसी कालावधि के भीतर जिसे कलेक्टर अनुज्ञात करे , अपने कारखाने के केन्द्रीय उत्पाद- शुल्क भारसाधक आफिसर के समक्ष , उबत अनुसूची में विनिर्दिष्ट श्राफि.सर SEC. 3 (F) ]

या संगठन का (जिसे माल प्रेषित किया गया है ) इस आशय का एक प्रमाणपत्र पेश करे कि ऐसे आफिसर या संगठन ने वह माल दुभिक्ष सहायता कार्य के लिये प्राप्त किया है ।
