NOTIFICATION
New Delhi , the 13th August 1969
G.S.R. 1974.- In exercise of the powers conferred by sub - section ( 1 ) of section 11 of the Salaries and Allowances of Ministers Act , 1952 ( 58 of 1952 ) , the Central Government hereby makes the following rules further to amend the Ministers ' (Allowances , Medical Treatment and other privileges ) Rules , 1957 , namely :-
1. These rules may be called the Ministers' ( Allowances , Medical Treatment and other privileges ) Amendment Rules , 1969 .
2.In rule 3 of the Ministers ' ( Allowances , Medical Treatment and other privi- :leges ) Rules , 1957-
( i ) for sub - rule ( 2 ) , the following sub - rule shall be substituted , namely : - "( 2) There shall be granted to the Minister of Irrigation and Power , a sumptuary allowance of Rs . 250.00 per mensem. " ;
(11) after sub - rule (2 ) , the following sub - rule shall be inserted, namely:-
" (3 ) There shall be granted to-
( a) the Minister of State in the Ministry of Steel , Mines and Metals , for the period commencing from the 28th April , 1968 and ending with the 14th February , 1969 , a sumptuary allowance of Rs . 250.00 per mensem;

(b) the Minister of State in the Ministry of Petroleum and Chemicals for the period commencing from the 23rd August, 1968 and end- ing with the 14th February , 1969 , a sumptuary allowance of Rs . 250.00 per mensem;
( c) the Minister of Parliamentary Affairs and Shipping & Transport , with effect from the 15th February , 1969 , a sumptuary allowance of Rs . 400.00 per mensem. "

Memorandum
Sumptuary allowance given to Ministers who are not members of the Cabinet , is determined in each case having regard to the requirements of the particular assignment of the Minister . Formulation and consideration of proposals in this behalf takes time and the amendment of the rules in such cases has necessarily to be given retrospective effect . No one's interest is prejudicially affected by reason of the retrospective effect , as is being given in this Notification.

सा० का ० नि० 1875- मंत्रियों के वेतन और भले अधिनियम , 1952-( 1952 का 58) की धारा 11 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार , मंत्रियों के (भत्ते , चिकित्सीय उपचार और अन्य विशेषाधिकार ) नियम 1957 में और आगे संशोधन करने के लिए एतद्धारा निम्नलिखित नियम बनाती है, अर्थात्ः--
1. ये नियम मंत्रियों के भत्ते , चिकत्सीय उपचार और अन्य विशेषाधिकार) संशोधन नियम, 1969 कहे जा सकेंगे ।
2. मंत्रियों के ( भत्ते , चिकित्सीय उपचार और अन्य विशेषाधिकार) नियम, 1957 , के नियम 3में-
(i) उप- नियम ( 2 ) के स्थान पर निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, श्रर्थात्:-
" ( 2 ) सिचाई और विद्युत मंत्री को 250.00 रु० प्रतिमास का भातिथ्य भत्ता दिया जाएगा । "
( ii) उप- नियम ( 2 ) के पश्चात् निम्नलिखित उप-नियम भन्तःस्थापित किया जाएगा, अर्थात्:--
" ( 3 ) ( क ) इस्पात्त , खान और धातु मंत्रालय में राज्य मंत्री को 28 मप्रैल , 1968 से प्रारम्भ होने वाली और 14 फरवरी , 1969 को समाप्त होने वाली काला- बधि के लिए 250.00 रु ० प्रति मास का श्रातिथ्य भत्ता;
(ख) पेट्रोलियम और रसायन मंत्रालय में राज्य मंत्री को 23 अगस्त , 1968 से प्रारम्भ होने वाली और 14 फरवरी , 1969 को समात्त होने बाली कालावधि के लिए 250.00 रु ० प्रतिमास का आतिथ्य भता;

(ग ) संसदीय कार्य तथा पोतपरिवहन और परिवहन मंत्री को 15 फरवरी , 1969 से 400.00 रु ० प्रति मास का आतिथ्य भत्ता दिया जाएगा । "

उन मंत्रियों को , जो मंत्रिमंडल के सदस्य नहीं हैं , दिया गया श्रातिथ्य भत्ता , प्रत्येक मामले में , मंत्री को विशिष्ट रूप से सौंपे गए कार्य की अपेक्षाओं को ध्यान में रखकर अवधारित किया जाता है । इस निमित्त प्रस्तावों को बनाने और उन पर विचार करने में समय लगता है और ऐसे मामलों में नियमों के संशोधन को आवश्यक रूप से भूतलक्षी प्रभाव देना होता है । उस भूतलक्षी प्रभाव से , जैसा कि इस अधिसूचना को दिया जा रहा है , किसी के भी हित पर प्रतिकूल प्रभाव नहीं पड़ता है ।
