PUBLIC NOTICE

IMPORT TRADE CONTROL

New Delhi, the 14th November 1969

SUBJECT.—lmport of Capital Goods from U.S-A. under the U.S. Aid Private Sec-

tor Capital Equipment Loan, 1970 (AID Loan No. 386-H-200):

No. 181-ITC(PN)/69.—This Public Notice sets out the conditions governing imports of capital goods under the United States Agency for International Deve- lopment Private Sector Capital Equipment Loan, 1970 (AID Loan No. 386-H-200).

2. Import Licences issued against the above loan for Capital Goods shall be governed by the Ministry of Foreign Trade & Supply Public Notice No 94-ITC- (PN)/69 dated the 12th June, 1969 as amended from time to time except for the following modifications:—

(1) The list of item eligible for import under the loan will be the capital goods indicated in Annexure I to this Public Notice

(2) Impart of captal goods will be permitted under the Loan only to units

in which the private sector has the majority capital participation-

(3) Import will be permitted only to units which ore engaged la the Indus-

tries and activities listed in Annexure II to this Public Notice.

(4) The minimum value for which a licence will be issued is Rs 1,12,500/-

($115,000/-).

(5) The importers must stipulate in the contracts placed by them with the TJ.S. Suppliers and the letters of credit subsequently opened that the validity of the contracts will be subject to the approval of commodity eligibility being given by AID, Washington in AID form 11.

(6) The flexibilities in regard to the quantities ordered for import, mentioned in Clause (VIII) of the Appendix to Public Notice No- 94-ITL (PN)/69 dated the 12th June, 1969, will not be admissible.

(7) Orders should be placed within nino months from tho date of issue of the licence. Importers unable to comply with this requirement must approach the Department of Industrial Development (AID Section) with reasons for delay in placing orders and full justification lor al- lowing additional time. Request for authorisation letters for opening letters of credit against orders placed after the expiry of this time limit will be entertained by the Ministry of Finance (Department of Economic Affairs) only upon production of a true copy of a letter from the P"oartment of Industrial Development (AID Section) granting extension of time for placement of orders.

(8) No authorisation letters for openinR letters of credit will be issued by the Ministry of Finance (Department of Economic Affaire) against Import licences of value B's. 750,000/- or more after 15th September, 1071
