In section 3.7 of the principal Act, after sub-section (2), the following sub-section shall be inserted, namely: — "(3) Nothing in this section shall apply to any work referred to Amend- ment of section 37. in section 35A.", ( 1 1 9 7) 1198 THE GAZETTE OF INDIA EXTRAORDINARY [PART II—SEC. 2

STATEMENT OF OBJECTS AND REASONS

The works which may be carried out by the Commissioners for the port of Calcutta are set out in section 35 of the Calcutta Port Act, 1890. The scope of this section is restricted and it does not permit the Port Com- missioners to carry out any works or services on behalf of other autho- rities. The West Bengal Government are anxious that the Port Com- missioners should undertake the construction of the second bridge across the Hooghly. It is, therefore, proposed to amend the Act to enable the Port Commissioners to undertake such works. At the same time, it ia proposed to make it clear that the provisions of section 37 of the Act which enable the Central Government to repair or complete any work constructed or undertaken by the Commissioners do not apply in rela- tion to works which may be constructed or undertaken by the Commis- sioners on behalf of other authorities.

2. The Bill seeks to achieve the above objects.
