No. DRA BACK/ PN - 4 / 72 -Under rule 4 of the Customs and Central Excise Duties Drawback Rules , 1971 ( Notification No. 52 /F.No . 602 / 2 / 71 - DBK , published in the Gazette of India , Extraordinary , dated the 25th August , 1971 ) , the Central Government hereby makes the following further amendment in the Table published in the Public Notice No. DRAWBACK/ PN- 1 , dated the 15th October , 1971 , with immediate effect :-

अधिसूचना सं ० 52 / फा ० सं ० 602/ 2/ 70-प्र ० अ० ) के नियम 4 के अन्तर्गत केन्द्रीय सरकार सार्वजनिक सूचना स ० प्रतिअदायगी/पी० एन०-1 , दिनांक 15 अक्तूबर , 1971 में प्रकाशित सारणी में एतद्वारा निम्नलिखित अतिरिक्त संशोधन करती है, जो तत्काल लागू होगा ---
उप - क्रमांक सं ० 1002 तथा उससे सम्बन्धित प्रविष्टियो को निकाल दिया जायेगा ।
No. DRAWBACK/PN - 5 / 72.-Under rule 4 of the Customs and Central Excise Duties Drawback Rules , 1971 (Notification No.52 / F.No . 602 / 2 /71 - DPK , dated the 25th August, 1971) the Central Government hereby makes the following amendments in the Table published in the Public Notice No. DRAWBACK/PN - 1 , dated the 15th October , 1971 with immediate effect :-
1. Sub - serial No. 3848 and the entries realating thereto the following shall be substi- tuted, namely :-

( a) Whole of the duty paid under item 46 of the First Schedule to the Central Ex- cises it Salt Act , 1944 , plus
3848 Metal containers all sorts ( other than those made of aluminium ) ordinarily intended for packaging of goods for sale , ( including casks , drums , cans; boxes , gas cylinders and pressure containers) filled in with export goods (but excluding open top sanitary, cans and tin containers of 11 34 Kg . capacity used for export of cashew kernels) . (b) The drawback at the ap- propriate rate if any in res- pect of the material of which the container is made .
Provided that :-
(1) The drawbak at the rate specified in item ( a) will be granted where the exporter pro- duces evidence to the satisfaction of the Assistant Collector of Customs of having paid duty on the metal containers .
) Where the exporter has not availed of the procedure under rule 12 or rule 191-A (ii of the Central Excise Rules , 1944 , the drawback at the rate specified at items (a) and (b) shall apply in toto and where the exporter has availed of the proce- dure under the said rules the rate of drawback at the rates ( specified in item (d ) alone shall apply

1. उप - क्रम सं ० 3848 तथा उससे सम्बन्धित प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जायेगा , अर्थात् --

3848 सभी किस्मों के धातु के डिब्बे ( एल्यूमीनियम से (क) केन्द्रीय उत्पादन शुल्क तथा नमक अधिनियम , 1944 को प्रथम अनुसूची की मद 46 के अधीन अदा किया गया सम्पूर्ण शुल्क, तथा
( ख ) जिस वस्तु का डिब्बा बनाया गया है उस पर समुचित दर पर प्रति अदायगी, यदि कोई हो ।
निर्मित डिब्बों से भिन्न) जो साधारणतया बिक्री के लिये वस्तुओं को पैक करने के लिये आश्शयित होते हैं (जिसमें निर्यात को जाने बाली वस्तुम्रों से भरे हुये पोपे , ड्रम , डिब्बे , बक्ये , गैस सिलिन्डर तथा प्रेशर डिब्बे शामिल हैं लेकिन जिसमें आार से खुले हुगे सफाई के डिब्बे ( सेौनेटरी कॅन्स ) तथा काजू को गिरी के निर्यात किये जाने में उपयोग किये जाने वाले 11.35 किलो ग्राम की क्षमता के टीन के डिब्बे सम्मिलित नहीं हैं ) ।
बशर्ते कि
(i ) मद (क ) में उल्विखित प्रतिअदायगी की दर उन मामलों में स्वीकार की जायेगी जिसमें निर्यात- कर्ता धातु के डिब्बों पर शुल्क श्रदा किये जाने का सन्तोषजनक प्रमाण सीमा-शुल्क के सहायक समाहर्ता को देता है ।
( ii ) जहां निर्यात-कर्ता ने केन्द्रीय उत्पादन शुल्क नियमावली, 1944 के नियम 12 अथवा नियम 191 - ऊ के अधोन कार्य- विधि का लाभ नही उठाया है , भष (क) तथा ( ख ) में उल्लिखित प्रति श्रदायगी की दर पूर्ण रूप से लागू होगी तथा जहां नियमकर्ता ने उक्त नियमों के अधीन कार्यविधि अपनायो है, केवल मद ( ख) में उल्लिखित दरां पर हो प्रति अदायगी की दर लागू होगी ।
2. उप- क्रम १० 3843 तथा उपन सम्बन्धित प्रविष्टियों के स्थान पर निम्नलिखित
प्रतिस्थापित किया जाएगा, अर्थात् :--
