New Delhi , the 7th March 1970
G.S.R. 423. In exercise of the powers conferred by clause ( 1 ) of article 371 of the Constitution , the President hereby makes , with respect to the State of Andhra Pradesh , the following Order further to amend the Andhra Pradesh Regional Committee Order , 1958 , namely : -
1. (1 ) This Order may be called the Andhra Pradesh Regional Committee (Amendment ) Order , 1970 .
( 2) It shall come into force on the 9th day of March , 1970 .
2. In paragraph 7 of the Andhra Pradesh Regional Committee Order , 1958 (hereinafter referred to as the " principal Order" ) , for the words "does not involve any fimancial commitment other than expenditure of a routine and incidental character" the words " is in conformity with the over - all financial arrangements contemplated in the annual budget or in the Five Year Plan pertaining to the Telengana region " shall be substituted .

3. After paragraph 10 of the principal Order , the following paragraphs shall be inserted , namely : -
" 11. The Governor shall annually , or whenever so required by the President , make a report to the President on the working of the Regional Committee .
12. The State Government shall forward to the Regional Committee half- yearly reports of the progress of action taken on the recommendations made by the Regional Committee .
13. The State Government shall forward to the Regional Committee periodical reports giving the progress of implementation of Central Government's decisions in matters relating to the integration of the Services in the State consequent on the States reorganisation in 1956. "
4. In the First Schedule to the principal Order ,-
(1) for item 3 , the following item shall be substituted , namely : -
" 3. Primary , secondary and university education . " ;
( 2) for item 7 , the following item shall be substituted , namely:-
" 7. Cottage , small - scale , medium and heavy industries falling under entry 24 of the State List in the Seventh Schedule to the Constitution . " ; and
(3 ) for item 9 , the following items shal ' be substituted , namely : -
"9 , Development and economic planning within the plan allocations for the Telengana region as formulated by the State Legislature .
10. Methods of recruitment , and the principles to be followed in making appointments to subordinate services and posts ( that is to say , services and posts appointments to which are not notified in the Official Gazette but not including any service of tehsildars ) under the State Govern- ment in the Telengana region .
11. Securing provision of adequate employment opportunities to the people of the Telengana region in the State Government , quasi-Government institutions , statutory authorities and corporate bodies in the Telen- gana region . "
5. In the Second Schedule to the principal Order ,-
(1) after item 3B , the following item shall be inserted , namely : -
" 3 - C . in Chapter XVIII, in rule 154 , after sub - rule ( 1 ) , the following sub- rule shall be inserted , namely : -
" ( 1A) in the annual financial statement , details regarding the receipts and expenditure in relation to the Telengana region and rest of the State shall be shown in separate columns for facility of reference and consideration by the Regional Committee . " ;
(2) in item 4 , rule 164 -M of Chapter XVIII - A shall be renumbered as sub- rule (1) thereof and-
(a) in sub - rule ( 1 ) as so renumbered . for the words "does not involve any financial commitment other than expenditure of a routine and incidental character " , the words " is in conformity with the over - all financial arrangements contemplated in the annual budget or in the Five Year Plan pertaining to the Telengana region " shall be substituted;
(b) after sub- rule ( 1 ) as so renumbered the following sub - rule shall be inserted, namely :-
" ( 2 ) The Chairman of the Regional Committee or . in his absence , any member of the Regional Committee shall lay before the Assembly-
(a) a copy of every resolution referred to in sub - rule ( 1 ) as soon as may be after it is passed and forwarded to the State Government;
(b) a copy of the report . if any , of the Regional Committee or a sub- committee in the matter;

(c) a periodical report showing the action taken by the State Government on such resolutions together with the views of the Regional Committee ."
6. In the Third Schedule to the principal Order , in rule 8 -A, inserted by clause ( ii) , for the words " the matter shall be referred by the Chief Minister to the Governor" the words " the Chief Minister shall first endeavour to arrive at an agreed conclusion by discussion with the Chairman of the Regional Committee and in default of such agreement , refer the matter to the Governor " shall be substi- tuted.

सा० फा० ति ० 423:-संविधान के अनुच्छेद 371 के खण्ड ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रपति, आंध्र प्रदेश प्रादेशिक समिति आदेश , 1958 में और आगे संशोधन करने के लिए आंध्र प्रदेश राज्य के बारे में एतद्वारा निम्नलिखित आदेश बनाते हैं , अर्थात्: --
1. ( 1 ) यह आदेश आंध्र प्रदेश प्रादेशिक समिति ( संशोधन ) श्रादेश , 1970 कहा जा सकेगा ।
( 2 ) यह मार्च 1970 की 9 तारीख के दिन को प्रवृत्त होगा ।
2. आंध्र प्रदेश प्रावेशिक समिति श्रादेश , 1958 ( जिसे इसमें इसके पश्चात् " मूल आदेश " कहा गया है ) "और विधायी या कार्यपालिका कार्यवाई में नेमी और आनुषंगिक स्वरूप के व्यय से भिन्न कोई वित्तीय वायदा अन्तवलित न हो " शब्दों के स्थान पर "और विधायी या कार्यपालिका कार्यवाई तेलंगाना प्रदेश सम्बन्धी वार्षिक बजट में या पंच वर्षीय योजना में अनुध्यात व्यापक वित्तीय प्रबन्धों के अनुरूप हो " शब्द प्रतिस्थापित किए जाएंगे ।
3. मूल श्रादेश के पैरा 10 के पश्चात् , निम्नलिखित पैरा अन्तःस्थापित किया जाएगा , अर्थात्:-
" 11. राज्यपाल प्रतिवर्ष , या जब कभी राष्ट्रपति ऐसा अपेक्षित करें, प्रादेशिक समिति के कार्यकरण के विषय में ; राष्ट्रपति को एक रिपोर्ट देगा ।
12. प्रादेशिक समिति द्वारा की गई सिफारिशों पर की गई कार्यवाई की प्रगति की अर्ध-वार्षिक रिपोर्ट, राज्य सरकार प्रादेशिक समिति को भेजेगी ।
13. 1956 में राज्यों के पुर्नस्संगठन के परिणामस्वरूप राज्य की सेवाओं के एकीकरण से सम्बद्ध विषयों के बारे में केन्द्रीय सरकार के विनिश्चयों के क्रियान्वयन की प्रगति बनाते हुए , राज्य सरकार प्रादेशिक समिति को कालिक रिपोर्ट भेजेगी । " THE GAZETTE OF INDIA EXTRAORDINARY

4. मूल भावेश की प्रथम अनुसूची में,-
( 1) मद 3 के स्थान पर निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थात्:-
" 3. प्राथमिक , माध्यमिक और विश्वविद्यालय शिक्षा । "
( 2) मब 7 के स्थान पर निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थात्: -
" 7. संविधान की सप्तम अनुसूची में राज्य सूची की प्रविष्टि 24 के अन्र्गत आने वाले कुटीर , लघु, मध्यम और भारी उद्योग, " और
( 3 ) मद 9 के स्थान पर निम्नलिखित मर्दे प्रतिस्थापित की जाएंगी, अर्थात्:-
" 9. राज्य विधान मण्डल द्वारा यथासूत्रित तेलंगाना प्रदेश के लिये योजना आवटन के भीतर विकास और आर्थिक योजना ।
10. तेलंगाना प्रदेश में राज्य सरकार के अधीन अधीनस्थ सेवाओं और पदों पर ( अर्थात् उन सेवाओं और पदों पर जिनपर की नियुक्तियां शासकीय राजपत्न में अधिसूचित नहीं होती हैं किन्तु इसमें तहसीलदारों की सेवा सम्मिलित नहीं है ) नियुक्तियां करने में अपनायी जाने वाली भर्ती की पद्धतियां और सिद्धान्त ।
11. तेलंगाना प्रदेश में राज्य सरकार, अर्धसरकारी संस्थाओं, कानूनी प्राधिकरणों और निगमित निकायों में तेलंगाना प्रदेश के लोगों के लिए पर्याप्त नियोजन के अवसरों की व्यवस्था सुनिश्चित करना । "
5. मूल आदेश की द्वितीय अनुसूची में,-
( 1 ) मद 3 ख के पश्चात् निम्नलिखित मद अन्तःस्थापित की जाएगी, अर्थात्:-
" 3 - ग प्रध्याय 18 में , नियम 154 में उपनियम ( 1 ) के पश्चात् निम्नलिखित उप -नियम अन्तःस्थापित किया जाएगा, अर्थात्:-
" ( 1 क ) वार्षिक वित्तीय विवरण में तेलंगाना प्रदेश और शेष राज्य के बारे में आय और व्यय सम्बन्धी व्यौरे प्रादेशिक समिति द्वारा देखे जाने वाले विचार करने की सुविधा के लिए पृथक स्तम्भों में शित किए जाएंगें । "
( 2) मद 4 में , अध्याय 18-क के नियम 164-ड को उसके उप - नियम ( 1 ) के रूप में पुनः संख्यांकित किया जाएगा और--
(क ) इस प्रकार पुनः संख्यांकित उप -नियम ( 1 ) में " और विधायी कार्यपालिका कार्यवाई में नेमी और आनुषंगिक स्वरूप के व्यय से भिन्न कोई वित्तीय वायदा भन्त र्वलित न हो । " शब्दों के स्थान पर " और विधायी या कार्यपालिका कार्यवाई तेलंगाना प्रदेश सम्बन्धी वार्षिक बजट में या पंचवर्षीय योजना में अनुध्यात व्यापक वित्तीय प्रबन्धों के अनुरूप हों" शब्द प्रतिस्थापित किए जाएंगे ;

( ख) इस प्रकार पुनः संख्यांकित उप- नियम ( 1 ) के पश्चात् निम्नलिखित उप - नियम अन्तः स्थापित किया जाएगा , अर्थात्:-
"( 2) प्रादेशिक समिति का अध्यक्ष या उसकी अनुपस्थिति में; प्रादेशिक समिति का कोई सदस्य सभा के समक्ष निम्नलिखित रखेगा:-
(क) उप-नियम ( 1 ) में निविष्ट प्रत्येक संकल्प की, उसके पारित किए जाने और राज्य सरकार को भेजे जाने के पश्चात् यथासम्भव शीघ्र एक प्रति ;
( ख ) यदि उस विषय में प्रादेशिक समिति या किसी उप -समिति की कोई रिपोर्ट हो तो उसकी एक प्रति ;
( ग ) ऐसे संकल्पों पर राज्य सरकार द्वारा की गई कार्यवाई और उसके साथ प्रादेशिक समिति के विचार दर्शित करने वाली एक कालिक रिपोर्ट । "
6. मूल आदेश की तृतीय अनुसूची में , खण्ड ( ii ) द्वारा अन्तःस्थापित नियम 8-- क में , " वह विषय मुख्य मंत्री द्वारा राज्यपाल को निर्दिष्ट किया जायगा" शब्दों के स्थान पर " मुख्य मंत्री पहले प्रादेशिक समिति के अध्यक्ष के साथ विचार विमर्श द्वारा करार पाए गए परिणाम पर पहुंचने का प्रयास करेगा और ऐसे करार के अभाव में उस विषय को राज्यपाल को निर्दिष्ट करेगा " शब्द प्रतिस्थापित किए जाएंगें ।
