The following Bill was introduced in the Rajya Sabha on the 10th March , 1970 :-
BILL NO . V OF 1970
A Bill further to amend the Prevention of Food Adulteration Act, 1954.
BE it enacted by Parliament in the Twenty-first Year of the Republic of India as follows :-
1. (1) This Act may be called the Prevention of Food Adulteration (Amendment) Act , 1970 .
Short title and com. mence- ment.
(2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette , appoint .

Amend- ment of section 1 .
2. In section 1 of the Prevention of Food Adulteration Act , 1954 (here- inafter referred to as the principal Act) , in sub- section (2) , the words "except the State of Jammu and Kashmir " shall be omitted .
3. After section 2 of the principal Act , the following section shall be inserted, namely:-
Insertion of new section 2A.
Rule of construc- tion .
"2A. Any reference in this Act to a law which is not in force in the State of Jammu and Kashmir shall , in relation to that State, be construed as a reference to the corresponding law , if any, in force in that State." .

4. In section 25 of the principal Act, in its application to the State of Jammu and Kashmir, after sub-section (2 ) , the following sub-section shall be inserted, namely:----
Amend- ment of section 25.
" ( 3) ( a) References to the commencement of this Act in this sec- tion shall be construed as references to the commencement of the Prevention of Food Adulteration (Amendment) Act, 1970.

(b) For the avoidance of doubt, it is hereby declared that the provisions of sub -section (2) shall be without prejudice to the pro- visions contained in section 6 of the General Clauses Act , 1897 which shall also apply to the repeal of the corresponding law in force in the State of Jammu and Kashmir as if such corresponding law had been an enactment ." .

STATEMENT OF OBJECTS AND REASONS
The Prevention of Food Adulteration Act , 1954 , extends to the whole of India except the State of Jammu and Kashmir .
2. To secure uniform application of the Act which would enable the Government of Jammu and Kashmir to prevent the sale of sub - standard food containing substances which are harmful and poisonous and thereby protect the health of the general public it has been decided , with the concurrence of the Government of Jammu and Kashmir, to extend the Prevention of Food Adulteration Act , 1954, to the State of Jammu and Kashmir .
3. The Bill seeks to give effect to the above proposal .
