ORDER
New Delhi , the 16th March 1970
G.S.R. 444. In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following Order further to amend the Foodgrains ( Prohibition of Use in Manufac- ture of Starch ) Order , 1966 , namely: -
1. ( 1 ) This Order may be called the Foodgrains ( Prohibition of Use in Manu- facture of Starch ) Amendment Order , 1970 .
(2) It shall come into force at once .
2. In the Foodgrains ( Prohibition of Use in Manufacture of Starch ) Order , 1966 ,-
( 1 ) For clause 4A . the following clause shall be substituted , namely: -
"4A . Manufacture of Starch out of Demaged or Deteriorated or Contaminated Foodgrains . ( 1 ) Notwithstanding anything contained in clause 3 or clause 4, no person shall use damaged, deteriorated or contaminated foodgrains in the manufacture of starch except under and in accord- ance with a permit issued by the Central Government or a State Gov- ernment or an officer authorised by such Government , and unless such foodgrains have been certified by the said authority as unfit for hurman consumption .

(2) Before a permit is issued under sub - clause ( 1 ) , representative samples of the suspect foodgrains shall be drawn and got analysed in a recognised foodgrains laboratory by the authority Issuing the permit .
(2) After clause 4A , the following clause shall be inserted , namely : - 4. B. Supervision of conversion of contaminated foodgrains into Inedible starch. ( 1 ) The conversion of contaminated foodgrains into inedible starch, in a starch factory , shall be supervised by an officer authorised for this purpose by the Central Government or a State Government .
(2) For the purpose of sub- clause ( 1 ) , the permit issued under clause 4A shall specify whether or not the foodgrains used in the manufacture of starch are contaminated . If the foodgrains are contaminated , then the authority granting the permit shall accordingly inform the officer authorised to supervise under sub - clause ( 1 ) .
Explanation . Contaminated foodgrains are foodgrains which are compounded of toxic elements that cannot be removed and have become unfit or unsate for human consumption .

सा० फा ० नि० 444 :-आवश्यक वस्तु अधिनियम , 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार खाद्यान्न ( स्टार्च के विनिर्माण में उपयोग का प्रतिषेध ) आदेश , 1966 में और आगे संशोधन करने के लिए एतद्वारा निम्नलिखित आदेश बनाती है, भर्थात्:-
1. ( 1 ) यह श्रादेश बाद्यान (स्टार्च के विनिर्माण में उपयोग का प्रतिषेध ) ( संशोधन ) प्रादेश , 1970 क ा जा सकेगा ।
(2 ) यह तुरन्त प्रवृत हो आएगा ।
2. खाद्यान (स्टार्च के विनिर्माण में उपयोग का प्रतिषेध ) ग्रादेश, 1966 में--
( 1 ) खण्ड 4क केस्थान पर निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा , श्रर्थात्:-
" 4क. नुकतानप्रस्त या खराब हुए अथवा सं दूषित खाद्यानों से स्टावं का विनिर्माण:-
( 1 ) खण्ड 3 या खण्ड 4 में किसी बात के होते हुए भी कोई भी व्यक्ति स्टार्च के विनिर्माण में नुकसानग्रस्त, खराब या संदूषित खाद्यान्नों का, फेन्द्रीय सरकार या राज्य सरकार या ऐसा सरकार द्वारा प्राधिकृत अधिकारीद्वारा जारी किए अनुज्ञापन के अधीन और उसके अनुसार के सिवाय , और तब तक जब तक कि ऐसे खाद्यान्नों की बाबत उक्त प्राधिकारी ने यह प्रमाणित न कर दिया हो कि वे मानवीय उपभोग के लिए अयोग्य हैं, उपयोग नहीं करेगा ।

( 2 ) उपखण्ड ( 1 ) के अधीन अनुज्ञापत्र जारी करने से पूर्व अनुज्ञापत्र जारी करने वाले प्राधिकारी द्वारा संदिग्ध खाद्यात्रों के प्रतिनिधायी नमूने लिए जायेंगे और किसी मान्यता प्राप्त खाद्यान प्रयोगशाला में उनका विश्लेषण कराया जाएगा । "
( 2) खण्ड 4क के पश्चात् निम्नलिखित खण्ड अन्तःस्थापित किया जाएगा, अर्थात्:-
4 ख . संदूषित खाद्याओं के श्रखाद्य स्टार्च में संरिवर्तन का पर्यवेक्षणः-( 1 ) किसी स्टार्च कारखाने में , संदूषित खाद्यानों के अखाद्य स्टार्च में संपरिवर्तन का पर्य- वक्षण केन्द्रीय सरकार या राज्य सरकार द्वारा इस प्रयोजन के लिए प्राधिकृत अधिकारी द्वारा किया जाएगा ।
( 2) उप -खण्ड ( 1 ) के प्रयोजन के लिए, खण्ड 4 क के अधीन जारी किए गए प्रनुज्ञापत्र में यह विनिर्दिष्ट होगा कि स्टार्च के विनिर्माण में प्रयुक्त खाश्चाप्न संदूषित हैं या नहीं । यदि खाद्यान्न संदूषित हों , तो अनुज्ञापन देने वाला प्राधिकारी , उपखंड ( 1) के अधीन पर्यवेक्षण करने के लिए प्राधिकृत अधिकारी को तदनुसार सूचित करेगा ।
स्पष्टीकरण -संदूषित खाद्यान्न वे खाद्याप्त हैं जो उन विषैले तत्वों का यौगिक है जिन्हें हटाया नही जा सकता भौर जो मानवीय उपभोग के लिए अयोग्य और अक्षेमकर हो गए हैं ।
