RESOLUTION
New Delhi , the 11th September 1970
S.O. 3004. The Drug ( Prices Control ) Order , 1970 , was issued by the Central Government on the 16th May 1970 , in exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955. Under para 5 of the said Order , selling prices of all bulk drugs , other than essential bulk drugs whose prices have been fixed , have been frozen at the levels prevailing on the 15th May, 1970. It is considered necessary to examine the cost structure of the more important of the remaining bulk drugs for the purpose of fixing fair selling prices therefor . Govern- ment had also to issue , at short notice , norms for conversion costs and packaging for the purpose of circulating revised prices of formulations in accordance with the formula prescribed for the purpose . Representations have been received against the norms which require to be considered . These have to be reviewed . Government have , therefore , decided to constitute a working Group functioning under the Chairman , Bureau of Industrial Costs and Prices with the following composition and terms of reference: urpose

TERMS OF REFERENCE
( 1) To study cost structure of the 25 bulk drugs shown in the annexure and to recommend fair selling prices therefor;
( ii) To review the norms for conversion costs and packaging as prescribed by Government and to recommend the extent to which these require to be modified having regard to the representations received and the objectives of the Drugs (Prices Control ) Order , 1970 ;
( ili ) To study any other item germane to the study of the above matters
The Working Group will adopt such procedure as may be considered sultable by them and will make their report as early as possible
ORDER
Ordered that this Resolution be communicated to all the State Governments , the several Ministries of Government of India , Prime Minister's Secretariat , Cabinet Secretariat , Parliament Secretariat , the Private and Military Secretaries to the President , the Planning Commission , the Directorate General of Technical Develop- ment , the Comptroller and Auditor General of India, the Accountant General , Commerce , Works and Miscellaneous .
Ordered also that this Resolution be published in the Gazette of India for general information .

ORDER
New Delhi . the 11th September , 1970
S.O. 3005. In pursuance of paragraph 25 of the Drugs ( Prices Control ) Order , 1970 , the Central Government hereby exempts small scale drugs manufacturing units , with an annual turn over exceeding Rs . 5 lakhs as recorded in the last accounting period , from the operation of paragraph 9 of the said Order so far as it relates to the submission of detailed calculations regarding retail price in Form No. 3 , except in respect of the following formulations , namely : ---
( 1 ) formulations in respect of which the mark - up adopted exceeds 150 ; and
( ii ) formulations , the retail prices of which calculated and fixed under the said Order are more than their prices prevailing on the 15th May , 1970 .
Explanation .- For the purposes of this order . a small scale drugs manufacturing unit means a unit with the capital investment in plant and machinery only , of not more than Rs . 750 lakhs , írrespective of the number of persons employed therein .
