SUBJECT: -Import olicy for Registered Exporters for the year 1970-71 ( Amendment No. 39) No. 150-1TC ( PN)/ 70 Attention is invited to the Import Trade Control Hand Book of Rulas and Procedure 1970 , published under the Ministry of Foreign Trade Public Notice No. 66 - ITC ( PN)/ 70, dated 4-5-1970 .
2. After declaration ( ii ) given at the end of page 342 of the said Hand Book , the following may be added:
" ( 111 ) I/ We declare that the exports have been made at a price not less than the minimum floor price fixed by the registering authority."

विषयः-पंजीकृत निर्यातकों के लिए वर्ष 1970-71 के लिए श्रायाप्त - नीति ( संशोधन संख्या 39)
सं ० 150 -पाई ० डी ०सी ० पी ०एन ०)/ 70.-विदेश व्यापार मंत्रालय की सार्वजनिक सूचना संख्या 66 - आईटीसी ( पीएन ) / 70 , दिनांक 4-5-1970 के अन्तर्गत प्रकाशित झायात व्यापार नियंत्रण मीति नियम तथा कार्यविधि पुस्तक ( हैंडबुक ) , 1970 की पोर ध्यान आकृष्ट किया जाता है ।
2. उक्त पुस्तक ( हँडनुफ ) के पृष्ठ 342 के अन्त में वी गई घोषणा ( 2 ) के बाद निम्नलिखित को जोड़ा जाएः-
" ( iii ) मैं/ हम घोषणा करता हूं/ करते हैं कि जिस मूल्य पर निर्यात किया गया है, यह मूल्य पंजीकरण करने वाले प्राधिकारी द्वारा स्थिर किए गए निम्नतम मूल्य से कम नहीं है ।

No. 151 - ITC ( PN) / 70 Attention is invited to the Import Policy for Registered Exporters contained in Volume II of the Import Trade Control Policy Book for the year April 1970-March 1971 , issued under the Ministry of Foreign Trade Public Notice No. 48 ( ITC ) ( PN) 70 dated the 31st March 1970 as amended from time to time .
2. The following amendments may be made at the appropriate places as indicated below:-

"Out of the total replenishment of 65 % of the fob export value registered exporters may be allowed to import direct upto 55 % . ofthe fob value and the remaining 10 %0 % will be through release orders on NMDC . In the event of non - availability certificate from NMDC, the exporter may be allowed to import direct to the extent of full value .

1. "Within the value limit of 5 % indicated in Col. 4 replenishment ofdiamonds uncut and unset will be allowed only through relcase orders on NMDC Ltd. In the case of items at (c) in Col. 4 , however , direct imports may be allowed .

Existing remark at ( 4) may de substituted by the following :-

4. Replenishment within the value limits indicated in Col. ofrough diamonds unset or uncut , precious /semi - precious stone unset real or cultured pearls unset will be allowed only if tho Jewellery exported contained diamonds , precious or semi precious stones and pearls respectively . In such cases , face value restriction of 50 % will apply in respect of each individual component . Where jewellery contained only any one of thes items namely diamonds or precious stones / semi precious stone orreal / cultured pearls then face value restriction will not apply Replenishment o diamonds uncut and unset will be allowes only through the release orders on NMDC Ltd. As for other items , direct imports may be allowed ."

Following remark may be added as No. (8 ) :-

8. Replenishment of diamonds uncut and unset to the extent permitted as per remarks No. 4 will be only through release orders on NMDC Ltd. and not by direct imports . The other permissible items however may be allowed to be imported directly.
N.B.: ( 1 ) These amendments will apply to all exports , payment for which is realized on or after 1-10-1970 .
(2) In the event of non - availability certificate from NMDC for the purpose of release of diamonds uncut and unset direct import of the material to the permissible extent may 'be allowed .

" जहाज पर्यन्त निःशुल्क श्रायात मूल्य के 65 प्रतिशप्त की कुल पुनः पूति मैं पंजीकृत निर्यातकों को जहाज पर्यन्त निःशुल्क आयात मूल्य के 55 प्रतिशत तक को सीधे भायाप्त करने की स्वीकृति दी जाएगी और शेष 10 प्रतिशत एन एम डी सीके बंटन आदेश पर उसके माध्यम से होगा । एम एम डी सी से अनुपलब्धता प्रमाण पत्र प्राप्त करने की स्थिति में, निर्यातक को पूरे मूल्य तक के लिए सीधे आयात करने के लिए स्वीकृति दी जा सकती है ।"

(4) पर की वर्तमान टिप्पणी को निम्नलिखित द्वारा बदला जायेः-

" अपरिष्कृत हीरों अजड़ाऊ या बिना तराशे, बहुमूल्य /माध्यम- बहुमूल्य पत्थर अजड़ाऊ वास्तविक या संद्धित ( कल्चर्ड ) मोती अजड़ाऊ के कालम 4 में संकेतित मूल्य सीमा के भीतर पुनः पूर्ति की स्वीकृति दी जाएगी , किन्तु केवल तब , जब निर्यात किए गए जवाहरातों में क्रमशः हीरों, बहुमूल्य या मध्यम बहुमूल्य पत्थरों और मोतियों को अन्तर्विष्ट किया गया था । ऐसे मामलों में, प्रत्येक अलग अलग संघटक के सम्बन्ध में , 50 प्रतिशत की अंकित मूल्य प्रति- बंधता लागू होगी । किन्तु जब जवाहरात इन मदों में से जैसे हीरों या बहुमूल्य पत्थरों/ मध्यम बहुमूल्य पत्थरों या वास्तविक/ संद्धित मोतियों में केवल किसी एक को अन्विष्ट करते हैं तो अंकित मूल्य प्रतिबन्धता लागू नहीं होगी । बिना तराशे और अजड़ाऊ हीरों की पुनःपूर्ति की स्वीकृति केवल एन एम डी सी के बंटन आदेश के भाध्यम से ही दी जाएगी । जहां तक अन्य मदों का सम्बन्ध है , सीधे आयात की स्वीकृति वी जा सकती है । "

8. संख्या 4 की टिप्पणियों के अनुसार स्वीकृत सीमा तक बिना तराशे और अजड़ाऊ हीरों की पुनःपूर्ति केवल एन एम डी सीलि ० के बंटन आदेश के माध्यम से होगी और न कि सीधे आयातों द्वारा लेकिन अन्य स्वीकार्य मदों के लिए सीधे आयात करने की स्वीकृति दी जा सकती है ।

विशेष ध्यान दीजिएः
( 1) ये संशोधन उन सभी निर्यातों , भुगतान के लिए लागू होंगे जो 1-10-1970 को या उसके बाद पूरा किया गया है ।
( 2) बिना तराशे और अजड़ाऊ हीरों के बंटन कार्य के लिए एन एम डी सी से अनुपलब्ध प्रमाण- पत्न प्राप्त करने की स्थिति में, माल के सीधी आयात के लिए स्वीकार्य सीमा तक के लिए स्वीकृति षी जा सकती है ।
