IMPORT TRADE CONTROL
New Delhi , the 15th October 1970
SUBJECT -Consideration of hard cases by the Special Committee .
No. 155 - ITC (PN) /70.- Attention is invited to para IIO of the Import Trade Control Policy ( Red Book- Vol.I ) for the period "April 70- March7t which lays down that cases of actual users in which it is established that the operation of the existing policy creates undue hardship which is likely to effect indus'r'al development will be consi- dered on merus by a Special Committee under the Chief Controller of Imports and Exports on the recommendation of the sponsoring authorities concerned .
2. With a view to streamline the procedure , it has been decided that the requests for consideration by the Special Committee should be made to the Chief Controller of Imports and Exports ( Policy Cell ) through the sponsoring authorities concerned in the proforma annexed to this Publ e Notice . Small scale units should make applications in triplicate while appli- cations from other units including D.G.T.D. units should be made in duplicate.

3. The applications will be scrutinised by the sponsoring authority concerned . If the sponsoring authority does not support the request , it will forward the application to the CCI &E , New Delhi recommending rejection . If the sponsoring authority supports the firm's request for consideration by the Special Committee , it will forward the application with its recommenda- tion in Part II of the application to the CCI & E , New Delhi . In the case of small scale units , the sponsoring authority will forward one copy of the application to the Development Commi- ssioner ( SSI ) , New Delhi and the other copy to the CCI & E , New Delhi (Policy Cell) . Development Commissioner ( SSI ) will examine the application and forward the same with his recommendation to the CCI & E , New Delhi for consideration by the Special Committee . In cases where the DC ( SSI ) does not consider it necessary to recommend the firm's request for consideration by the Special Committee , he will inform the sponsoring authority concerned under intimation to the CCI & E , New Delhi . विषयः-विशेष समिति द्वारा कठिन मामलों पर विचार विमर्श ।
सं ० 155- प्राई ० टी ० सी० पी ० एन ० ) / 70. अप्रैल 1970 मार्च 1971 अवधि के लिए आपात व्यापार नियंत्रण नीति ( रैड बुक-वालुम -1 ) की कंडिका 110 की श्रोर ध्यान आकृष्ट किया जाता है जो यह निर्धारित करती है कि वास्तविक उपभोक्ताओं के उन मामलों में, जिससे यह प्रमाणित होता है कि वर्तमान नीति के परिचालन में अनावश्यक कठिनाइयां उत्पन्न होती हैं , जिनका प्रभाव उद्योगिक विकास पर पड़ने की संभावना है उन पर पात्रता के अनुसार , संबंधित उत्तर दायी प्राधिकारियों की सिफारिश के आधार पर मुख्य नियंत्रक , आयात- निर्यात के अधीन विशष समिति द्वारा विचार किया जाएगा ।
2. कार्यविधि को सरल और कारगर बनाने के विचार से यह निश्चय किया गया है कि विशेष समिति द्वारा विचार - विमर्श करने के लिए प्रार्थना पत्न प्रस्तुत सार्वजनिक सूचना में अनुबन्धित प्रपक्ष में सम्बन्धित उत्तरदायी प्राधिकारियों के माध्यम से मुख्य नियंत्रक , आयात - निर्यात , ( पालिसी सैल ) को भेजे जाने चाहिए । लघु पैमाने के एककों को अपने आवेदन-पत्न तीन प्रतियों में भेजने चाहिए जबकि अन्य एकक जिसमें डी० जी ० टी० डी० के एकक भी शामिल हैं , उनके द्वारा आवेदन- पत्त दो प्रतियों में भेज जाने चाहिए ।
3. सम्बन्धित उत्तरदायी प्राधिकारियों द्वारा आवेदन- पत्त्रों का संवीक्षण किया जाएगा । यदि सम्बन्धित उत्तरदायी प्राधिकारी आवेदन का समर्थन नहीं करते तो वह आवेदन - पत्त्र को रद्दीगी की सिफारिश के लिए मुख्य नियंत्रक , आयात- निर्यात , नई दिल्ली को भेजेगा । यदि उत्तरदायी प्राधिकारी विशेष समिति द्वारा फर्म की प्रार्थना पर विचार करने का समर्थन करता है तो वह आवेदन पत्त्र के भाग 2 में अपनी सिफारिश के साथ श्रावेदन- पत्न को मुख्य नियंत्रक , आयात- निर्यात, नई दिल्ली 1003 THE GAZETTE OF INDIA EXTRAORDINARY

को भेजेगा । लघु पभाना एककों के मामले में , उत्तरदायी प्राधिकारी आवेदन -पत्त्र की एक प्रति विकास आयुक्त ( लघु पैमाना उद्योग ) नई दिल्ली को तथा दूसरी प्रति मुख्य नियंत्रक, श्रायात - निर्यात , नई दिल्ली (पालिसी सैल ) को भेजेगा । विकास आयुक्त ( लघु पैमाना उद्योग ) आवेदन पत्ता की जांच करेमा और फिर उसे अपनी सिफारिश के साथ विशेष समिति द्वारा विचार - विमर्श के लिए मुख्य नियंत्रक , श्रायात - निर्यात , नई दिल्ली को भेजेगा । ऐसे मामलों में, जहां उपायुक्त ( लघु पमाना उद्योग ) फर्म की प्रार्थना को विशेष समिति द्वारा विचार - विमर्श के लिए भेजना आवश्यक नहीं समझेगा तो वह मुख्य नियंत्रक, आयात-निर्यात , नई दिल्ली को अवगत कराते हुए सम्बन्धित उत्तरदायी प्राधिकारी को सूचित करेगा ।

3. क्या वह डी० जी ० टी ० डी० एकक है अथवा
एस ० एस ० आई ० ? ( एस ० एस ० आई ० एकक की स्थिति में पंजीकरण सं ० का संकेत करें । )
4. लाइसेंसिंग अवधि (यां ) जिससे आवेदन-पत्त संबंधित है ।
5. अन्तिम उत्पाद ( दें ) जिस के लिए आयातित कच्चा माल तथा संघटकों की मांगें की जाती हैं ।
6. कालम 5 के लिए उल्लिखित अन्तिम उत्पाद ( दों) के लिए वर्तमान आयात नीति ।
7. अपेक्षित उत्पाद के निर्माण के लिए कच्चे माल तथा संघटकों की जो मुख्य मदें हैं उनका उल्लेख करें ।
8. अन्तिम उत्पाद के निर्माण के लिए एक पारी के आधार पर माता / मूल्य के अनुसार उत्पादन क्षमता ।
9. जिस अवधि के लिए आवेदन- पत्न दिया गया है तत्काल पूर्वगत ऐसे अन्तिम उत्पाद की तीन लाइसेंसिंग श्रवधियों का वास्तविक उत्पादन ।

10. आयात लाइसेंस का मूल्य/ श्रायातित कच्चे माल के लिये बंटन आदेश तथा ऐसे अन्तिम उत्पाद के निर्माण के लिए प्राप्त हुए संघटक तथा किये गये आयात/ पूर्वगत तीन अवधियों के दौरान उसके अन्तर्गत प्राप्त की गई दातियां ।
