INCOME - TAX
New Delhi , the 23rd October 1970
G.S.R. 1822. In exercise of the powers conferred by sub - section ( 3 ) of section 280ZE of the Income - tax Act , 1961 (43 of 1961 ) , and of all other powers enabling It in this behalf, the Central Government hereby makes the following Scheme to amend the Tax Credit Certificate ( Equity Shares ) Scheme , 1965 , namely : --
1. This Scheme may be called the Tax Credit Certificate ( Equity Shares ) Amendment Scheme , 1970 .
2. In paragraph 6 of the Tax Credit Certificate ( Equity Shares ) Scheme , 1965 (hereinafter referred to as the said Scheme ) , for sub - paragraph ( 3 ) , the following sub - paragraph shall be substituted , namely: -
" ( 3 ) Any public company in whose favour an authorisation has been issued in respect of an issue of capital which is an eligible issue of capital shall forward along with the share certificate ,-
(1 ) to every shareholder who has been allotted any ordinary share forming part of such issue , on the allotment thereof ,

( ii) to every individual who has applied for entering his name in the register of shareholders of the company in respect of any such share acquired by him from the underwriter , on the date when his name is so entered ,
an intimation in Form C contalning the particulars specified theicin." ;
3. After paragraph 6 of the said Scheme , the following paragraph shall be Inserted , namely : -
" 6A . Transmission of intimation by registered shareholder to beneficial owner . A registered shareholder of any share forming part of an eligible issue of capital who is not himself the beneficial owner of such share shall , in a case where the beneficial owner is an individual or a Hindu undivided family , transmit the intimation referred to in sub- paragraph ( 3 ) of paragraph 6 pertaining to the said share to such beneficial owner together with a certificate in Form C1 . "
4. In paragraph 8 of the said Scheme , in sub- paragraph ( 2 ) , for the words , "received by him from the company " , the words , figure and letter " received by him from the company or, as the case may be , from the registered shareholder in pursuance of paragraph 6A" shall be substituted.
5. In the Appendix to the said Scheme,-
(a) after Form C, the following Form shall be inserted , namely : -
"FORM C1
Tax Credit Certificates
Declaration by a registered shareholder who is not the beneficial owner of the shares.
[See paragraph 6A of the Tax Credit Certificates ( Equity Shares ) Scheme , 1965 ]
This is to certify that the equity shares bearing number- to number in covered by share certificate (Name of company )
No. to -dated mentioned in the enclosed intimation in Form C belong the beneficial owner and are held by me/ us for

safe custody / as security for loan .

(b) in Form E ,-
(1 ) for the words " registered shareholder " , wherever they occur , the words "registered shareholder / beneficial owner " shall be substituted ;
(11 ) after item 5 and the table thereunder , the following item shall be inserted , namely : -
"6. ( To be filled in where the applicant is the beneficial owner of the shares but not the registered shareholder thereof ) :
( i ) Name of the registered shareholder and address .
( 11 )' Name of the beneficial owner and address .
( iii) Reasonsons why the registered shareholder subscribed to the eligible applicant .. issue of capital on behalf ofof the app ( iv) Source of investment ,.
(v ) Relationship between registered shareholder and applicant .
( vi) Date of written instructions given to registered shareholder for subscribing to the shares ( copy attached ) .
(iii) in the certificate to be filled in by the authorised bank for the words , letter , figures and brackets " claimed and by the intimationtion inin FormForm C SEC . 3 ( 1 ) ]

referred to in paragraph 6 ( 3 ) of the Scheme " , the following shall be substituted , namely:--
" clairned , the intimation in Form C referred to in paragraph 6 ( 3 ) , and (where appropriate ) the declaration in Form C1 referred to in paragraph 6A , of the Scheme" ;
( c) in Form El , for the words , brackets and letters " and intimation ( s ) in Form C" , the words , brackets , lettersers an'l figure " intimation( s)n ( s ) in Form C and declaration ( s ) in Form C1 " shall be substituted .

फा ० प्रा ० 1822.- यायकर अधिनियम , 1961 ( 1961 का 43 ) की धारा 280 य ज ० की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का और इस निमित्त उसे समर्थ बनाने वाली सभी अन्य शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एनद्वारा प्रतिदेय कर प्रमाण पत्र ( साधारण शेयर ) स्कीम , 1965 , में संशोधन करने के लिए निम्नलिखित स्कीम बनाती है , अर्थात्ः--
1. यह स्कीम प्रतिदेय कर प्रमाणपत्र ( साधारण शेयर ) संशोधन स्कीम, 1970 कही जा सकेगी ।
2. प्रतिदेय प्रमाणपत्र ( साधारण शेयर) स्कीम , 1965 ( जिसे इसमें इसके पश्चात् उषत स्कीम कहा गया है ) के पैरा 6 में ( उप पैरा ( 3 ) के स्थान पर, निम्नलिखित उप पैरा प्रतिस्थापित किया जाएगा , श्रर्थात्ः--
" ( 3 ) कोई भी पब्लिक कम्पनी जिसके पक्ष में किसी पूंजी पुरोधा की बाबत , जो पात्त्र पूंजी-पुरोधरण है , कोई प्राधिकार जारी किया गया है , शेयर प्रमाणपत्र के साथ साथ
( i ) प्रत्येक शेयर धारक को जिमे ऐसे पुरोधरण के भाग रुप कोई साधारण शेयर आबंटित किया गया है , उसके आबंटन पर ,
( ii ) प्रत्येक व्यक्ति को जिसने उसके द्वारा निम्नांकक से अर्जित में किसी ऐसे शेयर की बाबत कम्पनी के शेयर धारकों के रजिस्टर में नाम दर्ज कराने के लिए आवेदन दिया है , उस तारीख को जब उसका नाम इस रुप में दर्ज किया जाए ,
प्ररुप ग में एक प्रज्ञापना भेजेगा जिसमें विनिदिष्ट विशिष्टियां होंगी । " THE GAZETTE OF INDIA EXTRAORDINARY

3. उक्त स्कीम के पैरा 6 केपश्चात् निम्नलिखित पैरा अन्तः स्थापित किया जाएगा , अर्थात्ः--
" 6. क रजिस्ट्रीकृत शेरबारक द्वार। फायदाग्राही स्वामी को प्रज्ञापना का प्रेषणः पात्र पूर्वी पुरोत्ररण के भाग रुप किसी शेयर का रजिस्ट्रीकृत शेयरधारक जो शेयर का स्वंय फायदाग्राही स्वामी नहीं है , उत्त मामले में जिसमें फायदाग्राही स्वामी व्यष्टि या हिन्दू श्रविभक्त कुटुम्ब है, उक्त शेयर से संबंधित , पैरा 6 के उप पैरा ( 3 ) में निदिष्ट प्रज्ञापना को प्ररुप ग में प्रमाणपत्र सहित ऐसे फायदाग्राही स्वामी को प्रेषित करेगा । "
4. उक्त स्कीम के पैरा 8 में , उप पैरा ( 2 ) में , " उसके द्वारा कम्पनी से प्राप्त" शब्दों के स्थान पर" " उसके द्वारा पैरा 6 के अनुसरण में यथास्थिति कम्पनी या रजिस्ट्रीकृत शेयरधारक से प्राप्त" शब्द अंक और अक्षर प्रतिस्थापित किए जाएंगे ।
5. उक्त स्कीम के परिशिष्ट में ,-
( क) प्ररुप ग के पश्चात् निम्नलिखित प्ररुप अन्तः स्थापित किया जाएगा, अर्थात्ः-- प्ररुप ग
रजिस्ट्रीकृत शेयरधारक द्वारा जो शेयरों का फायदाग्राही स्वामी नहीं है , घोषणा
[प्रतिदेय कर प्रमाणपत्र ( साधारण शेयर ) स्कीम, 1965 का पैरा 6 क देखें ]
यह प्रमाणित किया जाता है कि से कम्पनी का नाम में साधारण शेयर जिनकी संख्या - तक है प्ररुप ग में संलग्न प्रज्ञापना में वर्णित शेयर प्रमाण पत्र संख्या तारीखक अन्तर्गत हैं
(नाम और पता) फायदाग्राही स्वामी के हैं और मेरे/ हमारे द्वारा ऋण के लिए प्रतिभूति/ निरापद श्रभिरक्षा के लिए धारण किए गए हैं

रजिस्ट्रीकृत शेयरधारक के हस्ताक्षर
(ख ) प्ररुप में, -
(i ) " रजिस्ट्रीकृत शेयर धारक " शब्दों के स्थान पर जहां कहीं वे आते हों रजिस्ट्रीकृत शेयर धारक /फायदाग्राही स्वामी " शब्द प्रतिस्थापित किए जाएंगे ।
(ii) मद 5 के पश्चात् और उसके नीचे की सारणी में निम्नलिखित मद अन्तः स्थापित की जाएगी, अर्थात्ः-
" 6 ( उस दशा में भरा जाना है जहां आवेदक फायदाग्राही स्वामी है किन्तु उसका रजिस्ट्रीकृत शेयर धारक नहीं है ) :
(i) रजिस्ट्रीकृत शेयर धारक का नाम और पना
( ii ) फायदाग्राही स्वामी का नाम और पला
( iii ) कारण कि रजिस्ट्रीकृत शेयर धारक ने आवेदक की ओर से पूंजी का पात्न पुरोधरण क्यों प्रतिश्रुत कियाः
(iv) विनिधान के स्त्रोत SEC . 3 ( 1 ) ]

(v ) रजिस्ट्रीकृत शेयर धारक भौर आवेदक मैं सम्बन्धः
(vi) रजिस्ट्रीकृत शेयर धारक को शेयरों को प्रतिश्रुप्त करने के लिए दिए गए लिखित अनुदेशों की तारीख (प्रतिसंलग्न ) : ;
( iii ) प्राधिकृत बैकं द्वारा भरे जाने वाले प्रमाणपत्र मैं " आवेदन के साथ पात्र पू'जी पुरोधरण --प्ररुप ग में प्रज्ञापना होनी चाहिए " शब्दों, अक्षर , भंकों और कोष्ठकों के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्ः--
" ग्रावेदन के साथ पात्र पूंजी पुरोधरण ( पुरोधरणों ) से सबंधित मूल शेयर प्रमाण पत्र जिनकी बाबत प्रतिदेय कर प्रमाण पत्त्र का संबंधित दाया किया गया है पैरा 6 ( 3 ) में निर्दिष्ट प्रश्न व में बज्ञानता, और ( जहां मनुचि हो) ऐसे प्रत्येक पूंजी पुरोधरण को बाबत स्कीम के पैरा 6 क में निर्दिष्ट प्ररुप ग में घोषणा होनी चाहिए । "
(ग) प्ररुन ङ । में "और प्रश्न ग में प्रशापना (प्रज्ञापनाए ) के ' शब्दों कोष्ठकों और प्रक्षरों" स्थान पर " प्ररुप ग में प्रज्ञापन (प्रज्ञापनाएं ) और प्ररुप ग । मैं घोषणा (घोषनाएं ) " शब्द, कोष्ठक अक्षर और अंक प्रतिस्थापित किए जाएंगे ।
