G.S.R. 1875.- In exercise of the powers conferred by sub - section ( 2 ) of section 79 of the Customs Act , 1962 ( 52 of 1962 ) , the Central Government hereby makes the followoing rules further to amend the Baggage Rules , 1970 , namely : -
1. These rules may be called the Baggage ( Second Amendment ) Rules , 1970 .
2. In rule 8 of the Baggage Rules , 1970 ( hereinafter referred to as the said rules ) , after the words " in respect of officers and members of the crew " , the brackets , words , figure and letter " ( other than those specified in rule 8A ) " shall be inserted .
3. After rule 8 of the said rules , the following rule shall be inserted , namely: -
" 8A . Special concession to certain category of officers and members of the crew . ( 1 ) Rules 4 and 9 shall not apply to any officer or member of the crew who was engaged prior to the 27th May , 1970 , in a foreign - going vessel and who on or after that date had declared for the first time his baggage to the Master of the Vessel in accordance with the directions issued by such Master .
( 2) Any officer or member of the crew aforesaid may be allowed to import free of duty articles not exceeding eight hundred rupees in value , if the proper officer is..

satisfied that such articles are for the use of the person Importing them or his family or for making gifts or souveniers :
Provided that in the case of an officer or a member of the crew aforesaid who is finally paid off on termination of his engagement for a period exceeding three months , the value of the articles which he may be allowed to import free of duty shall subject to a maximum of one thousand and six hundred rupees in all , be increased by one hundred and sixty rupees for each completed month in excess of three months. "

सा० का० नि ० 1875 - सीमा शुल्क अधिनियम, 1962 ( 1962 का 52 ) की धारा 79 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार सामान नियम , 1970 में और * मागे संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्: -
1. ये नियम सामान ( द्वितीय संशोधन ) नियम , 1970 कहे जा सकेंगे ।
..2 . सामान नियम , 1970 ( जिससे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 8 मैं "अधिकारियों और कर्मीदल के सदस्यों की बाबत " शब्दों के पश्चात् " नियम 8 -क मैं विनिर्दिष्ट से भिन्न ) " कोष्ठक, शब्द, अंक और अक्षर अन्तःस्थापित किए जाएंगे ।
3. उक्त नियमों के नियम 8 के पश्चात् निम्नलिखित नियम श्रन्तःस्थापित किया जाएगा, अर्थात्: -
8 -फ कतिपय प्रर्वग के अधिकारियों और कर्मीवल के सदस्यों को विशेष रियायत- (1) नियम 4 और 9 किसी उस अधिकारी या कर्मीदल के सदस्य को लागू नहीं होंगे जो 27 मई , 1970 से पूर्व विदेश जाने वाले जलयान मैं नियुक्त था और जिसने उस तारीख को या उसके पश्चात् जलयान के मास्टर को उस मास्टर द्वारा जारी किए गए निदेशों के अनुसार अपना सामान प्रथम बार घोषित किया था ।
( 2) पूर्वोक्स किसी अधिकारी या कर्मीदल के सवस्य को आठ सौ रूपए से अनधिक मूल्य की वस्तुएं निशुल्क आयात करने की अनुज्ञा दी जा सकती है, यदि समुचित अधिकारी का यह समाधान हो जाए कि ऐसी वस्तुएं उन्हे श्रायात करने वाले व्यक्ति के या उसके कुटुम्ब के उपयोग के लिए या वान या स्मृति उपहार देने के लिए हैं :

परन्तु उस पूर्वोक्त अधिकारी या कर्मीदल के सदस्य की दशा में जिसका तीन मास से अधिक की कालावधि के लिए उसके नियुक्ति के पर्यवसान पर अन्तिम रूप से हिसाब कर दिया गया है उन वस्तुओं का मूल्य जिन्हे उसे निशुल्क आयात करने की अनुज्ञा दी जाए , तीन मास से अधिक प्रति पूर्ण श्वास के लिए एक सौ साठ रुपए बढ़ा दिया जाएगा । जो कुल मिलाकर अधिकतम एक हजार छह सौ रुपए हो सकता है ।
