NOTIFICATION
New Delhi, the 4th December 1970
S O. 3894.—Whereas the Election Commission has under clause (d) of sub- section (1) of section 39 of the Representation of the People Act, 1951 (43 of 1951), appointed the 15th December, 1970, as the date on which a poll shall, if necessary, be taken in the bye-election to the Council of States by the elected members of the Legislative Assembly of Bihar to fill up the vacancy in that House caused by the death of Shri Shrikant Mishra;
And whereas the Commission has received a representation that it would be difficult for the persons who would be elected from 29-Mairwa, 257-Govindpur, 269-Chatra and 297-Torpa constituencies of the Bihar Legislative Assembly in the bye-elections in those constituencies for which the poll will be taken on the 13th December, 1970, to participate in the above said-bye-election to the Council of States and the Commission considers that the representation is valid.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 39 of the said Act and other powers enabling it in this behalf, the Election Commission hereby amends its notification No. 100/CS-BR/4/70(2), dated the 27th November, 1970. as follows:—
For the existing entry (d), the following entry shall be substituted, namely: "(d) the 17th December, 1970 (Thursday), as the date on which a poll shall, if necessary, be taken: and"
