स१० का० ति० 688 (प्र) राष्ट्ररति जाग जारी की गई निम्न- लिखित उद्घोषणा सर्वनाधारण के सूयनार्थ प्रकागिन की जा रही है:--
यतः मुझे, भारत के राष्ट्रपति नीलम संजीव रेड्डी को असम राज्य के राज्यपाल से एक रिपो प्राप्त हुई है, श्रीर इम रिपार्ट तथा मुझे प्राप्त अन्य सूचना पर विचार करने के बाद मेरा समाधान हो गया है कि ऐसी स्थिति उत्पन हो गई है, जिसमें राज्य का शासन भारत के सविधान (जिसे इसमें इसके पश्चात् " संविधान" कहा गया है ) के उपबंधों के अनुसार नहीं चलाया जा सकता है ;
अतः अथ मैं, संविधान के अनुच्छेद 356 द्वारा प्रदन शक्तियों का तया उत्त निमित्त मुझे ममर्थ बनाने शनी अन्य सभी शक्तियों का प्रधोग करते हुए एनद्वारा उद्घोषणा करता हूँ कि मैं:-
(क) उक्त राज्य की सरकार के सभी कृत्य और इम राज्य के राज्यपाल में निहिन, नथा उनके द्वारा प्रयोयतथ्य गभी शक्तियां, भारत के गट्रपति के रूप में स्वय सभालता हूं ;
(प्र ) गावित करना हूं कि उव। गज्य के विशन मंडन को शक्तियां संसद द्वारा था उनके प्राधिकेशन प्रथाक्नश्य होंगी : श्रीर
(ग) निम्नलित्रि। श्रनुर गेत और पारिणाभिक उपबंध करता हूं जो इस उद्द्घोषणा के उद्देश्यों को प्रभायी भनाने के लिए मुझे आवश्यक या वांछनीय प्रनात होते हैं ; अर्थात्

(i) इम उद्गषणा के उपर्युक्त खंड (क) के आधार पर मेरे द्वारा संजाले गए कृत्यों प्रोर शक्तियों का प्रयोग करने में, मेरे लिए भारत के राष्ट्रपति के रूप में उस मीना तक जिम तक मैं ठीक ममज्ञं उक्त राज्य के राज्यपान के माध्यम से कार्य करना विधिपूर्ण होगा ;
( ii ) उक्त राज्य के मंत्र में संविधान के निम्नलिखित उपबंधों के प्रनंन को एतद्वारा निलंधित किया जाता है,
अनुच्छेद 3 के परन्तुक का उतना भाग जितने का मंत्रच राष्ट्रपति द्वारा राज्य के विधान मंडल को निवेश करने से है ;
अनुच्छेद 151 के खंड ( 2 ) का उतना भाग जितने का संबंध भारत के नियंत्रक और महालेखा परीक्षक द्वारा राज्यपाल' के समक्ष प्रस्तुत किए गए प्रतिवेदमों को राज्य के विधानमंडल के समक्ष रख्ने जाने से है ; अनुच्छेद 163 और 164 ;
अनुब्छेद 166 के खंड ( 3 ) का उतना भाग जितने का संबंत्र राज्य भरकार के कार्य के मंत्रियों के बीच बटवारे में है ;
अनुच्छेद 167 श्रोर 169;
धनुच्छेद 174 का रंड ( 1 ) अनुच्छेद 175 , 176, और 177 ;
धनुच्छेद 179 का खड (ग) श्री उम अनुच्छेद का प्रथम परन्तुक ;

अनुच्छेद 181 , 188 , 189, 193, 194, 196 ौर 198;
which the Government of that State cannot be carried on in accordance with the provisions of the Constitution of India (hereinafter referred to as " the Constitution " ) ;
अनुच्छेद 199 का खंड ( 3) और खंड ( 4 ) ;
Now, therefore, in exercise of the powers conferred by article 356 of the Constitution and of all other powers enabling me in that behalf, I hereby proclaim that I-
अनुच्छेद 208 से 211 (जिसमें ये दोनों सम्मिलित 含) ;
(a) assume to myself as President of India all functions of the Government of the said State and all powers vested in or exercisable by the Governor of that State;
अनुच्छेद 213 के खंड ( 1 ) का परन्तुक और खंड (3 ) का परन्तुक; और
(b) declare that the powers of the Legislature of the said State shall be exercisable by or under the authority of Parliament ; and
मनुच्छेद 323 के खंड ( 2 ) का उतना भाग जितने का संबंध ज्ञापन सहित रिपोर्ट को राज्य के विधान मंडल के समक्ष रखे जाने से है ;
(c) make the following incidental and consequential pro- visions which appear to me to be necessary or desic- able for giving effect to the objects of this Procla- mation, namely : --
(i) in the exercise of the functions and powers assumed to myself by virtue of clause ( a) of this Procla- mation as aforesaid , it shall be lawful for me as President of India to act to such extent as I think fit through the Governor of the said State ;
(il) the operation of the following provisions of the Constitution in relation to that State is hereby sus . pended , namely : -
so much of the proviso to article 3 as relates to the reference by the President to the Legislature of the State;
(iii ) संविधान में राज्यपाल के प्रति किसी निदेश का अर्थ उस राज्य के संबंध में राष्ट्रपति के प्रति निवेश लगाया जाएगा और उनमें राज्य के अधीन मंडल या विधान सभा के प्रति किसी निदेश का, जहां तक उसका संबंध उसके कृत्यों और उसकी शक्तियों से है , अर्थ, जब तक कि संदर्भ द्वारा अन्यथा अपेक्षित न हो, संसद के प्रति निवेश लगाया जाएगा और विशिष्टतया अनुच्छेद 213 में राज्यपाल और राज्य के विधान मंडल या उसके सदनों के प्रति निदेशों का अर्थ, क्रमशः राष्ट्रपति और संमद या उसके मदनों के प्रति निवेश लगाया जाएगा ;
so much of clause ( 2) of article 151 as relates to the laying before the Legislature of the State of the reports submitted to the Governor by the Comptroller and Auditor-General of India ; articles 163 and 164 ;
so much of clause ( 3 ) of article 166 ás relates to the allocation among the Ministers of the business of the Government of the State : articles 167 and 169;
परन्तु इसमें की कोई बात अनुच्छेद 153 , अनुच्छेद 155 से लेकर अनुच्छेद 159 तक ( जिसमें या दोनों सम्मिलित है ) , अनुच्छेद 299 और अनुच्छेद 361 तथा द्वितीय अनुसूची के पैरा 1 से लेकर पैरा 4 तक ( जिसमें ये दोनों सम्मिलित है ) के उपबंधों पर प्रभाव नहीं डालेगी और न राष्ट्रपति को उस खंड के उपखंड ( i ) के अधीन उस सीमा तक जहां तक वह ठीक समझे उक्त राज्य के राज्यपाल के माध्यम से कार्य करने से निवारित करेगी ;
clause ( 1) of article 174; articles 175 , 176 and 177 ; clause ( c) of article 179 and the first proviso thereto ; articles 181 , 188, 189 , 193, 194, 196 and 198 ; clauses (3 ) and (4) of article 199 ; articles 208 to 211 ( both inclusive ) ;
the proviso to clause ( 1) and the proviso to clause (3) of article 213 ; and
so much of clause (2) of article 323 as relates to the laying of the report with a memorandum before the Legislature of the State;
(iii) any reference in the Constitution to the Governor shall , in relation to the said State, be construed as a reference to the President , and any reference there- in to the Legislature of the State or the Houses thereof, shall, in so far as it relates to the functions and powers thereof, be construed, unless the con- text otherwise requires , ag a reference to Parlla ment, and in particular , references in article 213 to the Governor and the Legislature of the State or the Houses thereof , shall be construed as refer- ences to the President and to Parliament or the Houses thereof respectively ;
(iv) संविधान में राज्य के विधान मंडल के या एतद्वारा बनाए गए अधिनियमों या विधियों के प्रति किसी निर्देश का ऐसे श्रर्थ लगाया जाएगा मानो उसके अन्तर्गत इस उद्घोषणा के भाधार पर संसद द्वारा या राष्ट्रपति या संविधान के अनुच्छेद 357 के खंड ( 1 ) के उपखंड (क) और असम साधारण खंड अधिनियम, 1915 (1915 का असम अधिनियम 2 ) जैसा कि वह असम राज्य में लागू है, में निविष्ट अन्य प्राधिकारी द्वारा राज्य के विधान मंडल की शक्तियों का प्रयोग करते हुए बनाए गए अधिनियमों या विधियों के प्रति निर्देश है, और साधारण खंड अधिनियम 1897 ( 1897 का 10) का उतना भाग जितना राज्य विधियों पर लागू है, ऐसे किसी अधिनियम या विधि के बारे में ऐसे प्रभावी होगा मानो यह उस राज्य के विधान मंडल का अधिनियम हो ।

Provided that nothing herein shall affect the provistons of article 153 , articles 155 to 159 (both inclusive) ; article 299 and article 61 and paragraphs 1 to 4 (both inclusive) of the Second Schedule or prevent the President from acting under sub - clause ( i ) of this clause to such extent as he thinks fit through the Governor of the said State ;

G.S.R. 688 (E) . The following Proclamation by the Presi- dent is published for general information :-
Whereas , I, Neelam Sanjiva Reedy, President of India have received a report from the Governor of the State of Assam and after considering the report and other information received by me , I am satisfied that a situation has arisen in
(iv) any reference in the Constitution to Acts or laws of ormade by the Legislature of the State shall be construed as including a reference to Acts or laws made, in exercise of the powers of the Legislature of the State, by Parliament by virtue of this Pro- clamation, or by the President or other authority referred to in sub - clause (a) of clause ( 1 ) of article 357 of the Constitution and the Assam General Clauses Act 1915 (Assam Act 2 of 1915 ) as in force in the State of Assam and so much of the -[भाग II-खण्ड 3 ( 1) ]
भारत का राजपत्र असाधारण
feneral Clauses Act, 1897 (10 of 1897) as applies State laws, shall have effect in relation to any uch Act or law , as if it were in Act of the Legis- Jature of the State .

सा० फा० ति० 689( प्र):-राष्ट्रपति द्वारा जारी किया गया निम्नलिखित आवेश सर्वसाधारण के सूचनार्थ प्रकाशित किया जा रहा है:--
भारत के संविधान के अनुच्छेद 356 के अधीन मेरे द्वारा भाज दिसम्बर, 1979 के बारहवें दिन जारी की गई उद्घोषणा के खंड (ग ) के उपखंड ( 1 ) का अनुसरण करते हुए मैं एतद्वारा निवेश देता हूं कि असम राज्य सरकार के सभी कृत्य और संविधान के अधीन या उस राज्य में प्रवृत्त किसी विधि के अधीन उस राज्य के राज्यपाल में निहित या उसके द्वारा प्रयोक्तव्य सभी शक्तियां , जिनको राष्ट्रपति ने उक्त उद्घोषणा के खंड (क ) के आधार पर राष्ट्रपति के अधीक्षण, निवेशन और नियंत्रण स्वयं संभाल लिया है, के अध्याधीन रहते हुए, होगी । उक्त राज्य के राज्यपाल द्वारा भी प्रयोक्तव्य

G.S.R. 689(E) .-The following Order by the President is published for general information :-
In pursuance of sub -clause (i) of clause ( c) of the Proclama- tion issued on this the 12th day of December, 1979, by me under article 356 of the Constitution of India, I hereby direct that all the functions of the Government of the State of Assam and all the powers vested in or exercisable by the Governor of that State under the Constitution or under any law in force in that State, which have been assumed by the President by virtue of clause (a) of the said Proclamation shall , subject to the superintendence , direction and control of the President, be exercisable also by the Governor of the said State.
