New Delhi , the 19th December 1970

G.S.R. 2049. In exercise of the powers conferred by sub - section ( 1 ) of section 6 of the Police - Forces ( Restriction of Rights ) Act , 1966 ( 33 of 1966 ) , the Central Government heręby makes the following rules further to amend the Police - Forces ( Restriction of Rights ) Rules , 1966 , namely : -

1. ( 1 ) These rules may be called the Police - Forces ( Restriction of Rights ) Amendment Rules , 1970 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Police- Forces ( Restriction of Rights ) Rules , 1966 ,-

( a) for rule 2 , the following rule shall be substituted , namely: - " 2. Definitions . In these rules unless the context otherwise requires ,- ( i ) " Act " means Police Forces ( Restriction of Rights ) Act . 1966 ( 33 of 1966) ;

(ii ) " Inspector General of Police " includes a functionary exercising similar powers " ;

(b) for the provision to clause ( q) of rule 3 , the following shall be substitut- ed, namely:

"Provided that nothing contained in clause ( c ) shall preclude a member of a police - force from participating in a meeting-

(i ) which is convened by an Association of police - officers of the same rank of which he is a member and which has been granted recog- nition under clause ( b ) of sub - section ( 1 ) of section 3 of the Act ;

( ii ) which has been specifically provided for in the articles of association governing the functioning of such an Association ;

( iii ) which , though not specifically provided for in the articles of associa- tion, has been , by general or special order , permitted by the Inspector General of Police having regard to the objects of such meeting and other relevant factors ; and

( iv ) which has been convened to consider the agenda circulated to all concerned according to the relevant provisions of the articles of association , after giving intimation in advance to the Inspector General of Police or an Officer nominated by him. " ;

(d) after rule 4, the following rules shall be inserted , namey: -

" 5. Record of Proceedings . Minutes of the proceedings of every meeting shall be recorded by the secretary of the Association in the minute book of the Association or the constituent body , as the case may be , Immediately after the conclusion of the meeting and a true copy of the minutes attested by the President of the Association shall be submitted without delay to the Inspector General of Police for infor- mation .

8. Observers . The Inspector General of Police, may , if he deems neces- sary, depute sary , depute one or more officers of notnot below the rank of Deputy Superintendent of Police to attend a meeting of the Association or Deputy any of its constituent bodies convened under the proviso to clause (c) of rule 3 and observe the proceedings thereof.

7. Exclusion of outsiders . Save as otherwise provided in rule 6 , no per- son who is not a member of the Association shall unless otherwise permitted by the Inspector General of Police by a general or special order , be permitted to attend any such meeting .

8. Recognition . Members of a police force belonging to the same rank desiring to form an Association may make an application for the grant of recognition under clause ( b ) of sub - section ( 1 ) of section 3 and such application shall be in writing under the hand of a re- presentative of suchof such Association addressed to the Inspector General of Police who shall be the authority to grant, refuse or revoke such recognition :

Provided that before refusing or revoking recognition , the Association shall be given a reasonable opportunity of making representation against the proposed action .

9. Suspension of recognition . The Inspector General of Police may in the interests of the general public or for the maintenance of discipline in the police- force and with the prior approval of the Central Gov- ernment , the State Government or as the case may be the Adminis- trator of the Union territory suspend the recognition granted under rule 8 for a period not exceeding three months which may be ex- tended for a further period of three months by the Central Gov- ernment , State Government or as the case may be the Administrator of the Union territory so however that the total period for which such recognition may be suspended shall not , in any case , exceed six months .

10. Publication of notices . Special notices regarding the grant , suspension or revocation of recognition of an Association shall be published in the departmental Gazette or Bulletin of the police force and in such other manner as may be directed by the Inspector General of Police from time to time .

11. Special provision regarding recognition already granted. Recognition granted prior to the commencement of the Police - Forces ( Restric- tion of Rights ) Amendment Rules , 1970 , to any AssociationAssociation the articles of association of which are not in conformity with these rules shall , unless the said articles of association are brought in conformity with the provisions of these rules within a period of thrity days , stand revoked on the expiry of the said period .

सा० का ० न ० 2049.-पुलिस बल ( अधिकारों का निर्बन्ध) अधिनियम , 1966 (1966 का 33 ) की धारा 6 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्द्वारा पुलिस बल ( अधिकारों का निर्बन्धन ) नियम , 1966 , में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात् :--

1. ( 1 ) ये नियम पुलिस बल ( अधिकारों का निर्बन्धन ) ( संशोधन) नियम, 1970 कहे जा सकेंगे ।

( 2 ) ये शासकीय राजपत्न में अपने प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पुलिस बल ( अधिकारों का निर्बन्धन ) नियम , 1966 में:-

(क) नियम 2 के स्थान पर निम्नलिखित नियन प्रतिस्थापित किया जाएगा , अर्थात्ः-

" 2. परिभाषाएं:-इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो:-

( i ) "अधिनियम" से पुलिस बल ( अधिकारों का निर्बन्धन ) अधिनियम , 1966 (1966 का ( 33) अभिप्रेत है -

( ii ) " पुलिस महानिरीक्षक " के अन्तर्गत समरुप शक्तियों का प्रयोग करने वाला कृत्यकारी है ;

नियम 3 के खण्ड ( ग ) के परन्तुक के स्थान पर निम्नलिखित प्रतिस्थापित किया

जाएगा, अर्थात्:-

"परन्तु खण्ड ( ग ) में की कोई बात पुलिस बल के किसी सदस्य को किसी ऐसे अधिवेशन में भाग लेने से प्रवारित नही करेगी :-

( i) जो उसी पंक्ति के, जिनका कि वह सदस्य है, पुलिस बल अधिकारियों के ऐसे संगम द्वारा संयोजित की गई हो, जिने अधिनियम की धारा 3 की उप धारा

( 1 ) के खण्ड ( ख ) के अधीन मान्यता प्रदान की गई हो THE GAZETTE OF INDIA EXTRAORDINARY

( ii ) जिसके लिए ऐसे संगम के कार्यकरण को शासित करने वाले संगम अनुच्छेदों में विनिर्दिष्ट रुप से उपबन्ध किया गया हो ;

( iii ) जो यद्यपि कि उसके लिए संगम - अनुच्छेदों में विनिर्दिष्ट रुप से उनवत्व में किया गया हो , ऐसे अधिवेशन के उद्देश्यों और अन्य सुसंगत कारणों को ध्यान में रखते हुए पुलिस महानिरीक्षक द्वारा साधारण या विशेष श्रादेश द्वारा अनुज्ञात किया गया हो और

( iv) जिसे पुलिस महानिरीक्षक को या उसके द्वारा नाम निर्देशित अधिकारी को अग्रिम प्रज्ञापना देने के पश्चात् संगम-अनुच्छेदों के सुर्पगत उपबन्धों के अनुसार सभी संबंधित व्यक्तियों को परिचालित कार्य- पूची के मम्बस्त्र में विचार करने के लिए संयोजित किया गया हो ।

( ग) नियम 4 में स्पष्टीकरण लुप्त कर दिया जाएगा ।

(घ) नियम 4 के पश्चात् निम्नलिखित नियम अन्तः स्थापित किए जाएंगे , अर्थात्:--

" 5. कार्यबाहिकों का अभिलेखः प्रत्येक अधिवेशन की कार्यवाहियों का कार्यवृत संगम के सचिव द्वारा अधिवेशन की समाप्ति के तुरन्त पश्चात् यथास्थिति संगम या संघटक निकाय की कार्यवृत्त- पुस्तिका में अभिलिखित किया जाएगा और संगम के अध्यक्ष द्वारा अनुत्रमाणित कार्यवृत्त की एक प्रति अविलम्ब पुलिस महानिरीक्षक को सूचनार्थ भेजी जाएगी ।

6. सप्रेक्षकः-पुलिस महानिरीक्षक यदि वह आवश्यक समझे , तो एक या अधिक अधि- कारियों को जो पुलिस उप अधीक्षक की पंक्ति के नीचे के न हों , संगम या उसके किसी संघटक निकाय द्वारा नियम 3 के खण्ड ( ग ) के परन्तुक के अधीन संयोजित श्रत्रिजेशन में भाग लने भौर उसको कार्यवाहियों का सप्रक्षण करने के लिए प्रतिनियुक्त कर सकेगा ।

7. बाहर के लोगों का प्रपत्र जैनः नियम 6 में अन्यथा उपबंधित के सिवाय , कोई भी व्यक्ति जो संगम का सदस्य नहीं है , जब तक कि पुसिल के महानिरीक्षक के साधारण या विशेष आदेश द्वारा अन्यथा अनुज्ञात नहीं किया जाता ऐसे किसी अधिवेशन में उपस्थित होने के लिए अनुज्ञात नहीं किया जाएगा ।

8. मान्यता: - पुलिस बल के ऐसे सदस्य जो एक ही पंक्ति के हों और जो संगम बनाने के इच्छुक हों, धारा 3 की उपधारा ( 1 ) के खण्ड ( ख ) के अधीन मान्यता दिए जाने के लिए आवेदन दे सकेगे और ऐसा आवेदन ऐसे संगम के प्रतिनिधि द्वारा हस्ताक्षरित तथा लिखित रुप में होगा ओर पुलिस महानिरीक्षक को संशोधित होगा , जो ऐसी मान्यता प्रदान, इंकार या प्रतिसंहत करने वाला प्राधिकारी होगा ;

परन्तु माम्यता इंन्कार या प्रतिसंहृत करने से पूर्व संगम को प्रस्थापित कार्यवाई के विरुद्ध भभ्या- वेदन करने का युक्तियुक्त अवसर दिया जाएगा ।

9. मान्यता का निलम्बन पुलिस महानिरीक्षक साधारण जनता के हित में या पुलिस बल में अनुशासन बनाए रखने के लिए और यथास्थिति केन्द्रीय सरकार , राज्य सरकार या संघ राज्यक्षेत्र के प्रशासक के पूर्वानुमोवन से नियम 8 के अधीन दी गई मान्यता को तीन मास से अनधिक की कालावधि के लिए , जो यथास्थिति केन्द्रीय सरकार , राज्य सरकार या संघ राज्यक्षेत के प्रशासक द्वारा तीन मास THE GAZETTE OF INDIA EXTRAORDINARY

की और कालावधि के लिए विस्तारित की जा सकेगी, निलत्रित कर सकेगा , किन्तु इस प्रकार की ऐसी कुल कालावधि , जिसके लिए मान्यता निलम्बित की जा सकेगी, किसी भी दशा में छह मास से अधिक न हो ।

10. स्वनाओं ह। पकशाः संगम की मान्यता देने, निलम्बित करने या प्रतिसंहृत करने की बाबत विशेष सूचनाएं विभागीय राजस्व या पुलिस-चल बुलेटिन में और ऐसी अन्य रीतियों में जो पुलिस महानिरीक्षक द्वारा समय -समय पर निदेशित की जांए , प्रकाशित की जाएगी ।

11. पहले से ही दी गई मान्यता के संबंध में विशेष उपबंध किसी संगम को, जिस के संगम- अनुच्छेद इन नियमों के अनुरुप नहीं हैं, पुलिसबल ( अधिकारों पर निर्बन्धन, ) संशोधन , नियम, 1970 के प्रारम्भ होने से पूर्व दी गई मान्यता , जब तक कि उक्त संगम- अनुच्छेद तीस दिन की कालावधि के भीतर इन नियमों के उपबंधों के अनुरुप नहीं कर दिए जाते , उक्त कालावधि के अवसान पर प्रतिसंदूत हो जाएगी ।"
