New Delhi , the 25th February 1971
G.S.R. 298. In exercise of the powers conferred by rule 12 of the Central Excise Rules , 1944 , the Central Government hereby directs that rebate of duty paid on any excisable goods shall , on their exportation from India to Nepal , be granted to His Majesty's Government of Nepal if the following conditions are fulfilled , namely : -
(1) the rebate does not . in each case , exceed the import duty , surcharge and any other charge of like nature levied by His Majesty's Govern- ment of Nepal on such goods when such goods are imported into Nepal from any country other than India;
(ii ) the goods are exported within four months from the date on which pay- ment of duty thereon has been made and such export has been made in accordance with such procedure as may be specifled by the Central Board of Excise & Customs in this behalf;

( iii ) the amount of duty paid on the goods exported and the date of pay- ment thereof are established from Central Excise records to the satisfaction of the officer competent to sanction such rebate ;
( iv ) where the goods are exported by land , the export takes place through any of the following border check - posts , namely , Raxaul, Jogbani , Jayanagar , Nepalganj , Barhani , Gauriphanta , Jarwa , Nautanwa , Pithoragarh , Tikonia , Tanakpur , Bairgania , Bhimnagar . Galgalia , Nirmali , Sonbarsa , Sukhiapokhri , Bikhanathori or such other check- post as may be specified by the Central Board of Excise and Customs ; and
(v) the whole or that part of duty as is granted as rebate to the exporter is not allowed as rebate to His Majesty's Government of Nepal .

नई दिल्ली, 25 फरवरी , 1971
सा ० क१० नि ० 298.-केन्द्रीय उत्पाद शुल्क , नियम 1944 के नियम 12 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा निदेश देती है कि जत्पाद शुल्क- योग्य किन्हीं भी माल पर , उनके भारत से नेपाल को निर्यात किए जाने पर , संदत्त शुल्क पर नेपाल के महाराजाधिराज की सरकार को रिबेट दिया जायगा यदि निम्नलिखित गतें पूरी हो जाऐं, अर्थात :--
( 1 ) रिबेट प्रत्येत दशा में उस आयात शुल्क , अधिभार और उसी प्रकार के किसी अन्य प्रभार से अधिक न हो, जो नेपाल के महाराजाधिराज की सरकार द्वारा ऐसे माल पर , जब ऐसे माल को भारत से भिन्न किसी देश में नेपाल श्रायात किए जाने हैं, उद्गृहीत किया जाता हो ;
( ।। ) माल उस नारोब से चार मास के भीतर निर्यान किए जाते हैं जिसको उन - पर शुल्क का संदाय किया गया है और ऐसा निर्यात ऐसी प्रक्रिया के अनुसार किया गया है जो केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड द्वारा इम निमित्त विनि- दिष्ट की जाए
( ।।। ) निर्यातिन माल पर संदत्त शुल्क की रकम और उनके संदाय की तारीख ऐमा रिबेट देने वाले सक्षम प्राधिकारी को समाधानप्रद रूप में केन्द्रीय ' उत्पाद शुल्क अभिलेखों से साबित हो जाए ;
( iv) जहां कि भाल भूमि द्वारा निर्यात किए जाते हैं निर्यात निम्नलिखित सीमा पड़ ताल-चौकियों, अर्थात रक्सौल , जोगवनी, जयनगर , नेपालगंज, बढ़नी , गौरीफन्टा , जरबा , नौतनबा, पिथोरागढ़ , तिकोनिया , टनकपुर , बैरगनिया , भीमनगर, गलगलिया निरमाली , सोनबरमा , सूखियापोखरी , बिखानाथोरी या ऐसी पड़तल चौकी की मार्फत किया जाता हो, जो केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड द्वारा विनिदिष्ट की जाए , और THE GAZETTE OF INDIA EXTRAORDINARY

(v ) संपूर्ण शुल्क या उसका ऐसा भाग जो रिबेट के रूप में निर्यातकर्ता को दिया जाय , नेपाल के महाराजाधिराज की सरकार को रिबेट के रूप ण अनुज्ञात न किया गया हो ।
