New Delhi , the 9th January 1972
G.S.R. 19 ( E ) .-The following Proclamation by the President is published for general information:
Whereas , I , V. V. Giri , President of India, have received a report from the Governor of the State of Bihar and after considering the report and other informa- tion received by me, I am satisfied that a situation has arisen in which the Govern- ment of that State cannot be carried on in accordance with the provisions of the Constitution of India ( hereinafter referred to as "the Constitution " ) ;
Now , therefore , in exercise of the powers conferred by article 356 of the Consti- tution and of all other powers enabling me in that behalf, I hereby proclaim that I-
(a) assume to myself as President of India all functions of the Government of the said State and all powers vested in , or exercisable by the Governor of that State:

(b) declare that the powers of the Legislature of the said State shall be exer- cisable by or under the authority of Parliament ; and
(c) make the following incidental and consequential provisions which appear to me to be necessary or desirable for giving effect to the objects of the Procla- mation , namely :-
(1 ) in the exercise of the functions and powers assumed to myself by virtue of clause ( a ) of this Proclamation as aforesaid , it shall be lawful for me as President of India to act to such extent as I think fit through the Governor of the said State ;
( 11) the operation of the following provisions of the Constitution in rela- tion to that State is hereby suspended , namely:-
so much of the proviso to article 3 as relates to the reference by the Pre- sident to the Legislature of the State;
so much of clause ( 2 ) of article 151 as relates to the laying before the Legislature of the State of the Report submitted to the Governor by the Comptroller and Auditor General of India;
articles 163 and 164 ;
so much of clause ( 3 ) of article 166 as relates to the allocation among the Ministers of the business of the Government of the State;
article 167;
so much of clause ( 1 ) of article 169 as relates to the passing of a resolu- tion by the Legislative Assembly of a State;
article 174;
articles 175 to 178 (both inclusive ) ;
clauses ( b ) and ( c) of article 179 and the first proviso to that article;
article 180 , 181 and 182 , clause ( c) of article 183 and the proviso thereto;
article 185;
so much of article 186 as relates to the salaries an allowances of the Deputy Speaker of the Legislative Assembly;
articles 189 , 193 and 194 ;
so much of article 195 as relates to the salaries and allowances of Members of the Legislative Assembly;
articles 196 to 198 (both inclusive ) , clauses ( 3 ) and ( 4 ) of article 199;
so much of sub- clause (b ) of clause ( 3 ) of article 202 as relates to the salaries and allowances of the Deputy Speaker of the Legislative Assembly; articles 208 to 211 ( both inclusive) ;
the proviso to clause ( 1 ) and the proviso to clause ( 3 ) of article 213 ; and
so much of clause ( 2) of article 323 as relates to the laying of the report with a memorandum before the Legislature of the State ;
( iii ) any reference in the Constitution to the Governor shall in relation to the said State be construed as a reference to the President , and any reference therein to the Legislature of the State or the Houses thereof 61 THE GAZETTE OF INDIA EXTRAORDINARY
SEC . 3 ( i) ]
shall , in so far as it relates to the functions and powers thereof , be construed , unless the context otherwise requires , as a reference to Parliamet , and , in particular , the reference in article 213 to the Gov- ernor and to the Legislature of the State or the Houses thereof , shall be construed as references to the President and to Parliament or to the Houses thereof respectively ;
Provided that nothing herein shall affect the provisions of article 153, articles 155 to 159 ( both inclusive ) , article 299 and article 361 and paragraphs 1 to 4 ( both(both inclusive) ofof the Second Schedule or prevent the President from acting under sub- clause ( i ) of this clause to such extent as he thinks fit through the Governor of the said State;
( iv) any reference in the Constitution to Acts or laws of , or made by , the Legislature of the State shall be construed as including a reference to Acts or laws made in exercise of the powers of the Legislature of the State , by Parliament by virtue of the Proclamation , or by the Presi- dent or other authority referred to in sub-clause ( a) of clause ( 1 ) of article 357 of the Constitution , and the Bihar and Orissa General Clauses Act , 1917 ( Bihar and Orissa Act 1 of 1917) , as in force in the State of Bihar , and so much of the General Clauses Act , 1897 ( 10 of 1897) , as applies to State laws , shall have effect in relation to any such Act or law as if it were an Act of the Legislature of the State .

जी०एस ० धार ० 19 (ई० ) राष्ट्रपति द्वारा जारी की गई निम्नलिखित उद्घोषणा सब- साधारण की सूचनार्थ प्रकाशित की जाती है :
यतः मुझे , व ० वे ० गिरि, भारत के राष्ट्रपति को बिहार राज्य के राज्यपाल से एक रिपोर्ट प्राप्त हुई है तथा उस रिपोर्ट पर और मुझे प्राप्त अन्य जानकारी पर विचार करने के पश्चात् THE GAZETTE OF INDIA EXTRAORDINARY

मेरा समाधान हो गया है कि ऐसी स्थिति उत्पन्न हो गई है जिसमें कि उस राज्य का शासन भारत के संविधान (जिसे इसमें इसके पश्चात् ' संविधान' कहा गया है ) के उपबन्धों के अनुसार नहीं चलाया जा सकता है ;
अतः अब मैं , संविधान के अनुच्छेद 356 द्वारा प्रदत्त शक्तियों का तथा उस निभिस मुझे समर्थ बनाने वाली अन्य सभी शक्तियों का प्रयोग करते हुए एतद्वारा उद्घोषणा करता हूं कि मैं-
(क ) उक्त राज्य की सरकार के सभी कृत्य और उस राज्य के राज्यपाल में निहित , या एतद्वारा प्रयोक्तव्य सभी शक्तियां , भारत के राष्ट्रपति के रूप में अपने हाथ में लेता हू ;
(ख ) घोषित करता हूं कि उक्त राज्य के विधान मंडल की शक्तियां संसद् के प्राधिकार द्वारा या अधीन प्रयोक्तव्य होंगी; और
(ग) निम्नलिखित आनुषगिक और पारिणामिक उपबन्ध करता हूं जो इस उद्घोषणा के उद्देश्यों को प्रभावी करने के लिए मुझे आवश्यक या वांछनीय प्रतीत होते है , अर्थात्:--
( i ) इस उद्घोषणा के उपर्युक्त खड (क ) के आधार पर अपने हाथ में लिए गए कृत्यों और शक्तियों का प्रयोग करने में, मेरे लिए भारत के राष्ट्रपति के रूप में उस सीमा तक जिम तक मै ठीक समझू उक्त राज्य के राज्यपाल के माध्यम से कार्य करना विधिपूर्ण होगा;
(ii ) उस राज्य के सम्बन्ध में संविधान के निम्नलिखित उपबंधों के प्रवर्तम को एतद्वारा निलम्बित किया जाता है , अर्थात् : --
अनुच्छेद 3 के परन्तुक का उतना भाग जितने का सम्बन्ध राष्ट्रपति द्वारा राज्य के विधान मंडल को निर्देश करने से है ;
अनुच्छेद 151 के खंड ( 2 ) का उतना भाग जितने का सम्बन्ध भारत के नियंत्रक और महालेखा परीक्षक द्वारा राज्यपाल के समक्ष प्रस्तुत किये गये प्रतिवेदनों को राज्य के विधान मडल के समक्ष रखे जाने से है;
अनुच्छेद 163 और 164 ;
अनुच्छेद 166 के खंड (3 ) का उतना भाग जितने का सम्बन्ध राज्य सरकार के कार्य के मंत्रियों के बीच बटवारे से हैं ;

अनुच्छेद 167;
अनुच्छेद 169 के खंड ( 1 ) का उतना भाग जितने का सम्बन्ध राज्य की विधान सभा द्वारा संकल्प पारित किये जाने से है;
अनुच्छेद 174;
अनुच्छेद 175 से 178 तक ( जिसमें ये दोनों सम्मिलित हैं ) ;
अनुच्छेद 179 का खंड (ख ) और ( ग ) और उस अनुच्छेद का प्रथम परन्तुक;
अनुच्छेद 180 , 181 ओर 182 , अनुच्छेद 183 का खंड (ग ) और उसका परन्तुक;
अनुच्छेद 185;
अनुच्छेद 186 का उतना भाग जितने का सम्बन्ध विधान सभा के उपाध्यक्ष के सम्बत्मों और भत्तों से है;
अनुच्छेद 189 , 193 और 194;
अनुच्छेद 195 का उतना भाग जितने का सम्बन्ध विधान सभा के सदस्यों के सम्बत्मों और भत्तों से है ;
अनुच्छेद 196 से 198 तक (जिसमें ये दोनों सम्मिलित है ) ,
अनुच्छेद 199 के खंड ( 3 ) और (4 ) ;
अनुच्छेद 202 के खंड ( 3 ) के उप-खंड (ख ) का उतना भाग जितने का सम्बन्ध विधान सभा के उपाध्यक्ष के सम्बत्मों और भत्तों से है ; अनुच्छेद 208 से 11 तक ( जिसमें ये दोनों सम्मिलित हैं ) ;
अनुच्छेद 213 के खंड (1 ) का परन्तुक और खंड ( 3 ) का परन्तुक; और अनुच्छेद 323 के खंड ( 2 ) का उतना भाग जितने का सम्बन्ध ज्ञापन सहित रिपोर्ट को राज्य के विधान मंडल के समक्ष रखे जाने से है ;
(iii ) संविधान मे राज्य पाल के प्रति किसी निर्देश का अर्थ उस राज्य के सम्बन्ध में राष्ट्रपति के प्रति निर्देश लगाया जायेगा और उसमें राज्य के विधान मंडल या विधान सभा के प्रति किसी निर्देश का जहां तक उसका सम्बन्ध उसके कृत्यों और उसकी शक्तियों से है , अर्थ , जब तक कि संदर्भ द्वारा अन्यथा अपेक्षित न हो संसद् के प्रति निर्देश लगाया जायेगा और विशिष्टतया अनुच्छेद 213 में राज्यपाल और राज्य के विधान मंडल या विधान सभा के प्रति निर्देश का अर्थ क्रमशः राष्ट्रपति और संसद् या उसके सदनों के प्रति निर्देश लगाया जायेगा;

परन्तु इममें की कोई बात अनुच्छेद 153, अनुच्छेद 155 से लेकर अनुच्छेद 159 तक ( जिसमें ये दोनों भी सम्मिलित है ) , अनुच्छेद 299 और अनुच्छेद 361 तथा द्वितीय अनुसूची के पैरा 1 से लेकर पैरा 4 तक ( जिसमें ये दोनों भी सम्मिलित हैं ) के उपबन्धों पर प्रभाव नहीं डालेगी और न राष्ट्रपति को उस खंड के उपखंड ( i ) के अधीन उस सीमा तक जहां तक वह ठीक समझे उक्त राज्य के राज्यपाल के माध्यम से कार्य करने से निवारित करेगी;
(iv ) संविधान में राज्य के विधान मंडल के या एतद्वारा बनाए गए अधिनियमों या विधियों के प्रति किसी निर्देश का ऐसे अर्थ लगाया जायेगा मानों उसके अन्तर्गत इस उद्घोषणा के आधार पर संसद् द्वारा या राष्ट्रपति या सविधान के अनुच्छेद 357 के खण्ड ( 1 ) के उपखण्ड (क ) में निर्दिष्ट अन्य प्राधिकारी द्वारा राज्य के विधान मण्डल की शक्तियों का प्रयोग करते हुए बनाए गए अधिनियमों या विधियों के प्रति निर्देश है , और बिहार और उड़ीसा साधारण खण्ड अधिनियम 1917 ( 1917 का बिहार और उड़ीसा अधिनियम 1 ) ,
जिस रूप में बिहार राज्य में लागू है श्रीर साधारण खंड अधिनियम 1897 (1897 के 10 वें ) , का उतना भाग जितना राज्य विधियों पर लागू है , ऐसे किसी अधिनियम या विधि के बारे में ऐसे प्रभावी होगा मानों यह उस राज्य के विधान मंडल का अधिनियम हो ।

In pursuance of sub- clause ( i ) of clause ( c ) of the Proclamation issued on this the 9th day of January , 1972 , by me under article 356 of the Constitution of India , I hereby direct that all the functions of the Government of the State of Bihar and all the powers vested in or exercisable by the Governor of that State under the Constitution or under any law in force in that State , which have been assumed by the President by virtue of clause ( a ) of the sald Proclamation, shall , subject to the superintendence , direction and control of the President , be exercisable also by the Governor of the said State .

जी० एस ० प्रार ० 20 ( प्र ) राष्ट्रपति द्वारा जारी किया गया सर्व साधारण के सूचनार्थ प्रकाशित किया जा रहा है :-- निम्नलिखित आदेश
भारत के संविधान के अनुच्छेद 356 के अधीन मेरे द्वारा श्राज जनवरी, 1972 के 9 वें दिन आरी की गई उद्घोषणा के खंड (ग ) के उपखंड ( 1 ) का अनुसरण करते हुए मैं एतद्वारा निवेश देता हूं कि बिहार राज्य सरकार के सभी कृत्य और संविधान के अधीन या उस राज्य में प्रवृत्त किसी विधि के अधीन उस राज्य के राज्यपाल में निहित या प्रयोक्तव्य सभी शक्तियां , जिनको राष्ट्रपति ने उक्त उद्घोषणा के खंड (क ) के श्राधार पर अपने हाथ में ले लिया है, राष्ट्रपति के अधीक्षण , निदेशन और नियंत्रण के अध्याधीन रहते हुए , उक्त राज्य के राज्यपाल द्वारा भी प्रयोक्तव्य होंगी ।
