ORDER
New Delhi , the 17th January 1972
G.S.R. 32 ( E ) Ess.Com. Sugar. In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) and clause 6 of the Sugar (Control ) Order , 1966 , the Central Government hereby makes the following Order , namely:-
1. Short title and commencement .- ( 1 ) This order may be called the Sugar (Restrictions on Movement ) Order , 1972 ,
(2) It shall come into force at once .
2. Restrictions on transport of certain sugar. No person shall transport or offer or accept for transport, whether by road , rail or water , any sugar produced by vacuum pan process from one State to another State except under , and in accor- dance with , a permit issued in this behalf by the Central Government or the Chief Director or by the Government of State from which sugar is to be taken out or an officer authorised by the Government of that State :
Provided that nothing in this Order shall apply to the transport of sugar :-

( i ) by a vacuum pan sugar factory in pursuance of a direction issued to it under clause 5 of the Sugar ( Control ) Order , 1966 for the sale of sugar; or
( ii) by a recognised dealer nominated by a State Government from a vacuum pan sugar factory by road ; or
( iii ) on Government account ; or
( iv) by the Food Corporation of India ; or
(v ) under and in accordance with the military credit notes ; or
(vi) forming part of ships ' stores intended for bonafide consumption during voyage ; oг
(vii) apportioned to the owner of a factory under section 5 of the Sugar Export Promotion Act , 1958 ( 30 of 1958 ) , either through or on behalf of, or by , the Indian Sugar Industry Export Corporation Limited .

नई दिल्ली, 17 जनवरी 1972
सा० का ० नि ० 32 ( ई) आ० व० /शर्करा श्रावश्यक वस्तु अधिनियम 1965 ( 1965 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा निम्नलिखित आदेश करती है अर्थात्-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इस आदेश का नाम शर्करा ( संचलन पर निर्बन्धन ) आदेश 1972 होगा ।
( 2 ) यह तुरग्त प्रवृत्त होगा ।
2. कुछ शर्करा के परिवहन पर निर्मभ्बन. कोई व्यक्ति निर्वात कढ़ाई प्रक्रिया द्वारा उत्पादित शर्करा का केन्द्रीय सरकार या मुख्य निदेशक द्वारा या उस राज्य सरकार द्वारा जिससे शर्करा बाहर ले जाई जा रही है या उस राज्य की सरकार द्वारा प्राधिकृत अधिकारी द्वारा इस निमित्त जारी किये गये अनुज्ञापन के अधीन या के अनुसार के सिवाय एक राज्य से किसी अन्य राज्य को सड़क रेल या जलमार्ग द्वारा परिवहन महीं करेगा या परिवहन करने के लिए प्रस्थापना या प्रतिग्रहण नहीं करेगा :
परन्तु इस आदेश में की कोई बात--
( i ) शर्करा के विक्रय के लिए शर्करा ( निंत्त्रण ) मावेल 1966 के खण्ड 5 के अधीन जारी किये गये निदेश के अनुसरण में निर्वात कढ़ाई कारखाने द्वारा ; या THE GAZETTE OF INDIA EXTRAORDINARY

( ii ) निर्यात कढ़ाई कारखाने से सड़क द्वारा राज्य सरकार द्वारा नामनिदिष्ट मान्यता प्राप्त व्यवहारी द्वारा ; या
( iii ) सरकारी लेखे मद्धे; या
( iv) भारत के खाद्य निगम द्वारा ; या
( v ) सैनिक जमा पत्नों के अधीन या के अनुसार ; या
( vi ) जलयात्रा के दौरान सद्भाविक उपभोग के लिए आशयित पोतभंडार का भाग बनाने वाली; या
( vii ) निर्यात प्रोन्नति अधिनियम 1958 ( 1958 का 30 ) की धारा 5 के अधीन कारखाने के स्वामी के लिए भारतीय शर्करा उद्योग निर्यात निगम लिमिटेड के माध्यम से या की ओर से या द्वारा , प्रभाजित शर्करा के परिवहन को लागू नहीं होगी ।
