8.O. 40 ( E ) . Whereas the Central Government has , as required by sub - section (2) of section 78C of the Indian Patents and Designs Act , 1911 ( 2 of 1911 ) , recon- sidered the question whether the direction issued under sub - section ( 1 ) of the said section to the Controller by the notification of the Government of India in the late Ministry of Industrial Development , Internal Trade and Company Affairs (Deptt. of Industrial Development ) No. S.O. 1631 , dated the 22nd April , 1969 , as published in the Gazette of India , Part II , Section 3 ( 11 ) , dated the 3rd May , 1969 , read with the notification of that Government in the Ministry of Industrial Develop- ment and Internal Trade No. SO . 235 , dated the 20th January , 1970 , as published in the Gazette of India Extraordinary , Part II , Section 3 ( 11 ) , dated the 20th

January , 1970 , and the notification of that Government in the Ministry of Indus- trial Development and Internal Trade ( Department of Industrial Development) No. S.O. 364 , dated the 19th January , 1971 , as published in the Gazette of India Extraordinary , Part II , Section 3 ( 11 ) , dated the 20th January , 1971 , continues to be necessary or expedient in the public interest ;
And , whereas , on such reconsideration it appears to the Central Government that the said direction continues to be necessary in the public interest ;
Now, therefore , in pursuance of sub - section ( 3 ) of the said section , the Central Government hereby notifies that the said direction continues to be necessary in the public interest .

नई दिल्ली 18 जनवरी , 1972
का ० प्रा० 40 ( अ) .-यतः केन्द्रीय सरकार ने , जैसा की भारतीय पेटन्ट तथा डिजाइन अधिनियम 1971 ( 1971 का 2 ) की धारा 78 ग की उपधारा ( 2 ) के अनुसार आवश्यक है , इस प्रश्न पर फिर से विचार किया कि उक्त धारा की उपधारा ( 1 ) के अधीन नियंत्रक के अधीन नियंत्रक को भारत सरकार के भूतपूर्व औद्योगिक विकास , अतिरितक व्यापार तथा समवाय कार्य मंत्रालय ( औद्योगिक विकास विभाग ) की अधिसूचना संख्या का ० भा ० 1631 दिनांक 22 अप्रैल 1969 द्वारा जारी किए गये निवेश को जो भारत के राजपत के भाग 2 खण्ड 3 उपखण्ड ( 2 ) दिनांक 3 मई , 1969 में प्रकाशित हुआ । सरकार के औद्योगिक विकास तथा आंतरिक व्यापार मंत्रालय की अधिसूचना संख्या का ० आ ० 235 , दिनांक 20 जनवरी , 1970 जो भारत के श्रसाधारण राजपत्र के भाग 2 खण्ड 3 ( 2 ) , दिनांक 20 जनवरी , 1970 में प्रकाशित हुई और उस सरकार के प्रौधोगिक विकास तथा श्रांतरिक व्यापार मंत्रालय ( श्रौद्योगिक विकास विभाग ) की अधिसूचना संख्या कॉ ० आ ० 364 , दिनांक 19 जनवरी , 1971 जो भारत के मसाधारण राजपत्त्र के भाग 2 , खण्ड3 ( 2 ) , दिनांक 20 जनवरी 1971 में प्रकाशित हुई के साथ पढ़ते हुए , आगे जारी रखना जनहित में भ्रावश्यक अथवा का ोचित है । और यतः इस पुनर्विचार पर केन्द्रीय सरकार को ऐसा प्रतीत हुआ कि उक्त निदेश जनहित की दृष्टि से आवश्यक है ।

भब, अतः, उक्त धारा की उपधारा ( 3 ) के अनुसरण में केन्द्रीय सरकार एतद्द्वारा प्राधसूचित करती है कि उक्त निदेश जनहित मे आवश्यक है ।
