New Delhi , the 21st January 1972
S.O. 57 ( E ) /18A/IDRA/72.- Whereas the Central Government is of the opinion that Bengal Textile Mills Ltd. , Cossimbazar , an industrial undertaking in respect of which an investigation has been made under section 15 of the industries (Deve- lopment and Regulation ) Act , 1961 ( 65 of 1951 ) , is being managed in a manner highly detrimental to public interest;
Now, therefore , in exercise of the powers conferred by section 18 -A of the said Act , the Central Government hereby authorises the National Textile Corporation Ltd. , (hereinafter referred to as Authorised Controller ) to take over the management of the whole of the said undertaking namely , Bengal Textile Mills Ltd. , Cossim- bazar subject to the following terms and conditions , namely : -
( i ) The Authorised Controller shall comply with all directions issued from time to time by the Central Government;
( ii ) The Authorised Controller shall hod office for five years from the date of publication in the official gazette of this notified order;

( li ) The Central Government may terminate the appointment of the Authoris- ed Controller earlier, ifit considers it necessary to do so.
1. This Order shall have effect for a period of five years commencing from the date of its publication in the official gazette.

का० वा. 57 ( च ) / 18 ए/ बाई की चार ए/ १2.--यतः केन्द्रीय सरकार की यह राय है कि बंगाल टैक्सलाइल मिल्स लि , कोसिम बाजार नामक प्रौद्योगिक उपक्रम का, जिसके संबंध में प्रौद्योगिक ( विकास तथा विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 15 के अधीन एक जांच की गई है , प्रबंध इस ढंग से किया जा रहा है जो सार्वजनिक हित में बहुत ही महितकर है;
अतः , भब उपरोक्त अधिनियम की धारा 18 - क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार राष्ट्रीय वस्त्र निगम ( इसमें जिसे एतदोपरान्त प्राधिकृत नियंत्रक कहा जाएगा ) को बंगाल टैक्सटाइल मिल्स लि. , कोसिम बाजार नामक उपरोक्त संपूर्ण उपक्रम का प्रबंध अपने अधिकार मैंलेने के लिए , निम्नलिखित शर्तों के मध्यधीन , एतद्वारा प्राधिकृत करती है , मर्यात:---
(1) प्राधिकृत निबंधक , केन्द्रीय सरकार द्वारा समय - समय पर जिये गये निर्देशों का पालन करैगा;
(2 ) प्राधितट नियंत्रक इस अधिसूचित भावेश के सरकारी राजपत्र में प्रकाशित होने की तारीख से पांच वर्ष तक की अवधि के लिए पद धारण करेगा ; भौर
(3) केन्त्रीय सरकार, यदि वह ऐसा करना भ्रावश्यक समझेगी , तो उससे पूर्व भी इस प्राधिकृत नियंत्रक की नियुक्ति को समाप्त कर सकती है ।
2. यह आदेश सरकारी राजपत्र में इसके प्रकाशित होने की तारीख से प्रारंभ होने वाली पांच वर्ष की धमति के लिए प्रभावी होगी ।

Now, therefore , in exercise of the powers conferred by section 18 -A of the said Act, the Central Government hereby authorises the National Textile Corporation Ltd. , (hereinafter referred to as Authorised Controller ) to take over the management of the whole of the said undertaking , namely , Manindra Cotton Mills Ltd. , Cossimbazar , subject to the following terms and conditions , namely :-

( il) The Authorised Controller shall hold office for five years from the date of publication in the official gazette of this notified order ;

का० प्रा०58( प्र) / 18/ चाई की पार ए/ 72.--यतः केन्द्रीय सरकार की यह राय है कि महिन्द्रा मिल्स लि ० , कोसिम बाजार नामक औद्योगिक उपक्रम का, जिसके संबंध में श्रौद्योगिक ( विकास तथा विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 15 के अधीन एक जांच की गई है , प्रबंध इस ढंग से किया जा रहा है जो सार्वजनिक हित में बहुत ही प्रहितकर है ;
अतः अन उपरोक्त अधिनियम की धारा 18 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार राष्ट्रीय वस्त्र निगम ( इस में जिसे एतदोपरान्त प्राधिकृत नियंत्रक कहा आएगा ) को महिन्द्रा मिल्स लि ० , कोसिम बाजार नामक उपरोक्त संपूर्ण उपक्रम का प्रबंध अपने अधिकार में लेने के लिए , निम्नलिखित शर्तों के अध्यधीन , एतद्वारा प्राधिकृत करती है, अर्थात-
( 1 ) प्राधिकृत नियंत्रक केन्द्रीय सरकार द्वारा समय - समय पर दिये गये निवेशों का पालन करेगा;
( 2 ) प्राधिकृत नियंत्रक इस अधिसूचित आदेश के सरकारी राजपत्तत्र में प्रकाणित होने की तारीख से पांच वर्ष तक की अवधि के लिए पद धारण करेगा ; और
( 3 ) केन्द्रीय सरकार , यदि वह ऐसा करना श्रावश्यक समझेगी, तो उससे पूर्व भी इस प्राधिकृत नियंत्रक की नियक्ति को समाप्त कर सकती है ।
2. यह प्रादेश सरकारी राजपत में इसके प्रकाशित होने की तारीख से प्रारंभ होने वाली पांच वर्ष की अवधि के लिए प्रभावी रहेगा ।
