ORDER
New Delhi , the 24th January 1972
S.O. 64 (E ) . Whereas the manufacturers of motor cars have in pursuance of the under- taking given to the Hon'ble Supreme Court furnished the necessary details and the re- levant data to the Central Government for re - fixing the prices of the motor car manu- factured by them;
And whereas , after consideration of the said details and data , the Central Government has , in accordance with the recommendations of the Car Prices Enquiry Commission as modified by the Supreme Court , determined the prices at which the motor cars manu factured by the said manufacturers shall be bought and sold ;
Now , therefore , in exercise of the powers conferred by section 18G of the Industries (Development and Regulation ) Act, 1951 ( 65 of 1951 ) , the Central Government hereby makes the following Order further to amend the Motor Cars ( Distribution and Sale ) Con trol Order , 1959 , namely :-
1. (1 ) This Order may be called the Motor Cars ( Distribution and Sale ) Control (Amendment ) Order , 1972 .
(2) It shall come into force at once .

2. In the Motor Cars ( Distribution and Sale ) Control Order , 1959 , for Schedule I , the following Schedule shall be substituted , namely: -
" SCHEDULE I

Explanation 1.-The prices specified above are ex - factory prices , inclusive of dealers commission and do not include Excise duties , Central Sales Tax and local taxes , if any , and transportation charges .
2. The prices specified above are liable tobe increased or decreased in accordance with the provision relating to escalation and de - escalation , contained in the judgment of the Supreme Court in Writ Petitions No. 327 , 330 , 331 , 486 and 487 of 1969. "

का० भा० 64 ( भ) ,-- यतः माननीय उच्चतम न्यायालय को दिए गए वचन के अनुसरण में मोटर कार के विनिर्माताओं ने उनके द्वारा विनिर्मित मोटर कारों की कीमतें पुन नियत करने के लिए आवश्यक ब्यौरे और सुसंगित आंकड़े केन्द्रीय सरकार को दे दिए है ;
और यतः उक्त ब्यौरे और आंकड़ों पर विचार करने के बाद , केन्द्रीय सरकार ने , कार कीमत जांच श्रायोग की उच्चतम न्यायालय द्वारा यथाउपान्तरित सिफारिशो के अनुसार वे की मते अवधारित की है जिनपर उक्त विनिर्माताओं द्वारा विनिर्मित मोटर कारें खरीदी और बची जाएंगी ;
अतः , अब , उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 छ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा मोटर कार ( वितरण और
विक्रय ) नियंत्रण श्रादेश 1959 में और संशोधिन करने के लिए निम्नलिखित श्रादेश करती है , अर्थात: 1. ( 1 ) यह आदेश मोटर कार ( वितरण और विक्रय ) नियंत्रण ( संशोधन ) आदेश 1972 कहा जा सकेगा ।
( 2 ) यह तुरन्त प्रवत्त होगा ।

2. मोटर कार ( वितरण और विक्रय ) नियत्त्रण आदेश, 1859 में अनुसूची I के स्थान पर निम्नलिखित अनुसूची प्रतिस्थापित की जाएगी , अर्थात्: --

स्पष्टीकरण 1. ऊपर विनिर्दिष्ट कीमतें कारखाना द्वारा कीमतें है, इनमें व्यवहारी का कमीशन सम्मिलित है और उत्पाद शुल्क, केन्द्रीय विक्रय कर और स्थानीय कर , यदि कोई हो, तथा परिवह्न प्रभार सम्मिलित नहीं है ।
2. ऊपर विनिर्दिष्ट कीमन 1969 की रिट पिटीशन स ० 327 , 330 , 331,486 और 487 में उच्चतम न्यायालय के निर्णय में अन्र्तावष्ट उन उपबंधों के उन्मार बढ़ाई या घटाई जा सकेगी जो ऐसे बढाने और घटाने के संबंध में है । "
