New Delhi , the 18th February 1972
G.S.R. 83 ( E ) . In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Central Water Engineering ( Class I ) Service Rules , 1965 , namely : -
1. ( 1 ) Thesehese rules may be called the Central Water Engineering ( Class I ) Ser- vice (Amendment ) Rules , 1972 .
( 2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Central Water Engineering ( Class I) Service Rules , 1965 ,-
( 1) in rule 21 ,-
( a) in the proviso to sub - rule ( 2 ) , paragraph beginning with the words "certificates of eligibility will not " , and items ( 1 ) , ( 11 ) , and ( iii ) thereunder shall be omitted ;
(b) for Note ( ii ) of sub - rule ( 3 ) , the following Note shall be substituted, namely :-
"Note ( 11 ) . The candidature of a person who is admitted to the exami- nation under the age concession mentioned in clause ( b ) shall be cancelled if , after submitting his application , he resigns from ser- vice or his services are terminated by his department or office , either before or after taking the examination . He will, however, continue to be eligible if he is retrenched from the Service or post after submitting his application for the examination under this part";

(c) for clause (A) of the proviso to clause ( g ) of sub - rule (4 ) , the follow- ing clause shall be substituted , namely : -
" ( A) The candidate who has passed such examination should have ap- peared and passed in the following additional papers according to post 1959 scheme of Graduate Membership Examination , namely : -
( i ) Principles of Radio and Electronics I ( Section ' A' ) ;
( ii) Mathematics II ( Section ' B' ) . " ;
(2 ) for the proviso to clause ( b ) of rule 23B, the following proviso shall be substituted , namely : -
"Provided that candidates belonging to the Scheduled Castes or the Sche- duled Tribes may , to the extent the number of vacancies reserved for the Scheduled Castes and the Scheduled Tribes cannot be filled on the basis of the general standard , be recommended by the Ser- vice Commission by a relaxed standard to make up the deficiency in the reserved quota , subject to the fitness of these candidates for appointment to the Services or posts irrespective of their ranks in the order of merit at the examination . "

जी० एस ० नार ० ४३ ( अ) संविधान के अनुच्छेद 309 के परन्तुकद्वारा प्रदत्त अधिकारों का प्रयोग करते हुए राष्ट्रपति एनद्वारा केन्द्रीय जल इंजीनियरी ( श्रेणी I ) सेवा नियमावली , 1965 मे श्रागे और मशोधन करने के लिए निम्नलिखित नियम बनाते है ; नामशः --
1. ( 1 ) ये नियम केन्द्रीय जल इंजीनियर। (श्रेगी 1 ) सेवा (मशोधन ) नियमःदली, 1972 के नाम से कहे जाएं ।
(2 ) ये नियम सरकारी राजपत्र में प्रकाशिन होने की तारीख से लागू हो जाएगे ।
2. केन्द्रीय जल इंजीनियरी (श्रेणी I ) नेत्रा नियमावली. 1965 में---
(1 ) नियम 21 में, --
नही " (क ) उपनियम ( 2 ) के परन्तुक में. " नात्रता के प्रमाण पत्र . शब्दों से प्रारम्भ होने वाला पैग और उसके नीचे की मढे ( i ) , ( ii ) और ( ) छोड़ दी जाए;
(ख ) उपनियम ( 3 ) के नोट ( ) की जगह निम्नलिखित नोट रखा जाये , नामशः "नोट ii : -किसी भी ऐसे व्यक्ति की उम्मीदवारी जिसे परीक्षा में प्रवेश की मजूरी खण्ड (ख ) में उल्लिखित आयु- छट के अंतर्गत दी जाती है, उस हालत में रद्द कर दी जाएगी यदि वन्न अपना आवेदन-पत्त देने के बाद नेवा से त्याग पत्र दे दे या उसके परीक्षा देश के पूर्व या उसके बाद विभाग या कार्यालय द्वारा ही उसकी सेवाएं समाप्त कर दी जाए । बहरहाल , अगर इस भाग के अन्तर्गत परीक्षा के लिए अपना आवेदन-पत्र देने के बाद सेवा या पद में उसकी छटनी हो जाए , तो वह पात्र बना रहेगा । " , THE GAZETTE OF INDIA EXTRAORDINARY

(ग) उपनियम ( 4 ) के खण्ड (क ) के परन्तुक खण्ड के ( अ ) की जगह निम्नलिखित खण्ड राम्रा जाए , नामशः--
" ( अ ) जो उम्मीदवार ऐसी परीक्षा में उत्तीर्ण हो , उसे ग्रेजुएट मेम्बरशिप परीक्षा की 1959 के बाद की स्कीम के अनुसार निम्नलिखित अतिरिक्त प्रश्न-पत्त्रों में मम्मिलित और उत्तीर्ण होना चाहिए, नामशः-
( i ) रेडियो और इलेक्ट्रोनिक्स के सिद्धान्न प्रथम (खंड 'अ' )
( ) गणित - द्वितीय (खंड ' अ' ) ।" ;
(2) नियम 23 आ के खंड ( ख ) के परन्तुक की जगत्र , निम्नलिखित परन्तुक रखा जाये , : -- नामशः--
"बशर्ते कि अनुसूचित जातियों और अनुसूचित आदिमजातियों के लिए आरक्षित जितनी रिक्तिया सामान्य मानदड के आधार पर न भरी जा सकें, सेवा आयोग आरक्षिन कोटे को पूरा करने के लिए, अनुसूचित जातियों या अनुसूचित आदिम- जानियों के उनके उम्मीदवारों की सिफारिश शिथिलीकृत मानदंड से, इस शर्त के साथ करे कि परीक्षा में योग्यता-क्रम में उनके स्थान को ध्यान में लाये बिना ये उम्मीदवार दवाओं/ या पद। पर निक्षित के योग्य हों " ।

1. ( 1 ) ये नियम केन्द्रीय विद्युत् इंजीनियरी ( श्रेणी I ) सेवा ( संशोधन ) नियमावली, 1972 के नाम से कहे जाएं :
( 2 ) ये नियम सरकारी राजपत्र में प्रकाशित होने की तारीख से लागू हो जाएंगे ।
2. केन्द्रीय विधुत् इंजीनियरी ( श्रेणी I ) सेवा नियमावली , 1965 में ; 一 (i) नियम 21 में,-
.. नहीं .." (क) उपनियम ( 2 ) के परन्तुक में " पात्रता के प्रमाण पत्न
शब्दों से प्रारम्भ होने वाला पैरा और उसके नीचे की मदें ( i ) , ( ii ) और (iii) छोड़ दी जाएं ;
(ख) उपनियम ( 3 ) के नोट ( ii ) की जगह निम्नलिखित नोट रखा जाये, नामशः "नोट ii:- किमी भी ऐसे व्यक्ति की उम्मीदवारी जिसे परीक्षा में प्रवेश की मजूरी खण्ड ( ख ) मे उल्लिखित आयु- छूट के अंन्तर्गत दी जाती है ; उस हालत में रद्द कर दी जाएगी यदि वह अपना आवेदन-पत्त्र देने के बाद सेवा से त्यागपत्र दे दे या उसके परीक्षा देने से पूर्व या उसके बाद विभाग या कार्यालय द्वारा ही उसकी सेवाए समाप्त कर दी जाएं । बहरहाल अगर इस भाग के अन्तर्गत परीक्षा के लिए अपना आवेदन - पत्त्र देने के बाद सेवा या पद में उसकी छंटनी हो जाए तो वह पात्र बना रहेगा । " ;
( ग) उपनियम ( 4 ) के खण्ड ( छ) के परन्तुक के खण्ड ( अ ) की जगह निम्नलिखित खण्ड रखा जाए , नामशः-
" ( अ ) जो उम्मीदवार ऐसी परीक्षा में उत्तीर्ण हो , उमे ग्रैजुएट मेम्बरशिप परीक्षा की 1959 के बाद की स्कीम के अनुसार निम्नलिखित अतिरिक्त प्रश्न पत्नों में सम्मिलित और उत्तीर्ण होना चाहिए ; नामशः--
( i ) रेडियो और इलेक्ट्रोनिक्स के सिद्धान्त- प्रथम ( खंड 'श्रा' )
( ii ) गणित द्वितीय ( खंड ' आ' ) " ;

( 2) नियम 23 श्रा के खण्ड ( ख ) के परन्तुक की जगह निम्नलिखित परन्तुक रखा जाये , भामशः-
" बशत कि अनुसूचित जातियों और अनुसूचित श्रादिमजानियों के लिए आरक्षित जितनी रिक्तियांसामान्य मानदण्ड के आधार पर न भरी जा सके , सेवा श्रायोग श्रारक्षित कोटे को पूरा करने के लिए , अनुसूचित जातियों या अनुसूचित अदिमजातियों के उतने उम्मीदवारों की सिफारिगों शिथिनीकृत मानदंड से , इस शर्त के साथ करे कि परीक्षा में योग्यता - क्रम में उनके स्थान को ध्यान में लाये बिना ये उम्मीद- वार सेवाओं/ या पदों पर नियुक्ति के योग्य हों । "
