NOTIFICATION
New Delhi , the 19th February 1972
S.O. 145 ( E ) / IDRA/ 29B/ 72 -Whereas the Central Government is of the opinion that having regard to the stage of development of the scheduled industries spe- cified in the Schedule to this Notification , 11 would not be in the public interest to apply the provisions of clause ( d ) of sub - section ( 1 ) of section 13 of the In- dustries (Development and Regulation ) Act 1951 ( 65 of 1951 ) , to the said sche duled industries ;
Now , therefore , in exercue of the power conterred by sub - section ( 1 ) of section 29B of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , and in supersession of the Order of the Government of India in the Ministry of Industrial Development , No SO. 4 ( E ) , ORA / 29B / 71 / 1 dated the 3rd January , 1972 , the Central Government hereby exempis from the operation of clause ( d ) of sub- section ( 1 ) of sectio 13 of the said Act and the rules made thereunder . all industrial undertakings registered under the said Act or in respect of which any licence or permission has been issued mder that Act , and pertaining to the scheduled industries specified in the Schedule to this Notification , to the follow- ing extent , namely :-
( a) in respect of industrial undertakings which have been licensed or registered under the Art specifically on the basis of single or double shift working , to the extent of production obtainable by maximum utilisation of their licensed or registered capacity ;

(b) in respect of other industrial undertakings which had commenced pro- duction on or before the first day of January , 1972 , to theextent of an additional one hundred per cent of the existing licensed registered capacity , as the case may be: or
Provided that no such industrial undertaking shall be eligible for exemption, -- (i) if it belongs to or is controlled by any of the Larger Industrial Houses , as specified in the list at Appendix II -A ( 1 ) of the report of the Industrial Licensing Policy Inquiry Committee , as amended by the Central Government from time to time or
( it) if it is a foreign company or a branch or subsidiary of a foreign com- pany or
( iii) if the industrial undertaking is engaged in industries reserved for the small scale sector as listed in Schedule II to the notificatiion of the Government of India in the late Ministry of Industrial Development , Internal Trade and Company Affairs (Department of Industrial De- velopment ) , No. S.O. 713 / IDRA / 29B / 70/1 , dated the 19th February , 1970, as amended from time to time or
(iv) if it requires additional machinery ( except minor badanoing equipment procured indigenously ) whether indigenous or imported ; or ( v) if the industrial undertaking is engaged in an industry other than one of the industries listed in the Schedule to this Notification .
2. This notification is in addition to, and not in derogation of anything con- tained in the following notifications of the Government of India in the late Ministry of Industrial Development , Internal Trade and Company Affairs (De- partment of Industrial Development ) , namely :--
(1 ) No. S. O. 713 / IDRA / 29B/ 70 / 1 dated the 19th February , 1970 , as amend- ed from time to time , in so far as the said notification relates to sub- stantial expansion of industrial undertakings , and
( ii ) No. S. O. 912 / IDRA / 29B / 70 / 3 dated the 28th February , 1970 , as amended from time to time .

अधिसूचना
नई दिल्ली, 19 फरवरी , 1972
का ० प्रा० 145 ( श्र ) / याई ० डी० आर ० ए ० / 29बो/ 72/ 1.--यतः केन्द्रीय सरकार की राय है कि इस अधिसूचना की अनुसूची में विनिर्दिष्ट श्रनुसूचिन उद्योगों के विकाम ने प्रक्रम को ध्यान में रखते हुए , उद्योग (विकाम और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 13 की उपधारा ( 1 ) के खण्ड ( घ ) के उपबन्धों को उक्त अनुसूचित उद्योगों पर लागू करना लोक हित में नहीं होगा ;
श्रताः, अब, उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 29 ख की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये और भारत सरकार के औद्योगिक विकास मंत्रालय के आदेश सं ० का ० आ० 4 (ई ) / आई० डी ० आर ० ए ० / 29 ख / 71/1 , तारीख 3 फरवरी , 1972 को अधिक्रांत करते हुये केन्द्रीय सरकार , उक्त अधिनियम के अधीन रजिष्ट्रीकृत नगरी प्रौद्योगिक उपकों का उन उपक्रमों को जिनकी बाबत उम अधिनियम के अधीन कोई अनुज्ञप्ति या अनुज्ञा जारी की गई हो, और जो इस अधिसूचना की अनुसूची में विनिर्दिष्ट अनुसूचित उद्योगों से सम्बन्धित हैं, उक्त अधिनियम की धारा 13 की उपधारा ( 1 ) के खण्ड (घ ) के और तद्वीन बनाये गये नियमों के प्रवर्तन से निम्नलिखित मीमा तक एतद्वारा छूट देती है, अर्थात्:--
(क ) उप- औद्योगिक उपक्रमों की बावत जिन्हें विनिदिष्टतया एकल या दोह्री पारी कार्यकरण के आधार पर अधिनियम के अन्तर्गत अधीन धनुज्ञप्ति या रजिस्ट्रीकृत किया गया है , उनकी अन्ज्ञप्त या रजिस्ट्रीकृत क्षमता केके अधिकतम उपयोग से अभिप्राय उत्पादन की सीमा तक ;
(ख ) अन्य उपक्रमों की बाजत जिन्होंने जनवरी , 1972 के प्रथम दिन को या पूर्व उत्पादन प्रारम्भ किया हो , यथास्थिति विद्यमान अनुज्ञप्त या रजिस्ट्रीकृत क्षमता के अतिरिक्त एक सौ प्रतिशत तक की सीमा तक ।
परन्तु कोई ऐसा औद्योगिक उपक्रम छूट के लिये पात्र नही होगा -
( i ) यदि सरकार द्वारा समय - समय पर यथा संशोधित श्रौद्यीगिक अनुजप्त नीति जांच समिति की रिपोर्ट के परिशिष्ट ।। क ( 1 ) की सूची में विनिर्दिष्ट किये गये किमी बड़े औद्योगिक गहू की है या उसके द्वारा नियंत्रित है : या
( ii ) यदि वह विदेशी कम्पनी है या बिदेशी कम्पनी की शाखा या महायकी है , या
( iii ) यदि प्रौद्योगिक उपक्रम उन उद्योकों में लगा हुआ है जो भारत सरकार के भूत- पूर्व ग्रौद्योगिक विकाभ , श्रान्तरिक व्यापार और कम्पनी कार्य मंत्रालय ( औद्योगिक विकाम विभाग ) की समय- गमय पर गथ संशोधित अधिसूचना सं ० का ० आ० 713/ आई ० डी० आर ० ए० / 29ख/ 70/ 1 , तारीख 19 फरवरी 1970 की अनुसूची 2 में मुचीबद्ध रूप में नध क्षेत्र के लिये शारक्षित हैं, या
(iv) यदि इसके लिये अतिरिक्त मशीनरी कपेक्षित है ( देश में ही ग्रभिप्रान लघु- मश्नुत्सम- उपस्कर के ये वो देश हो या आयातित या
( v) यदि प्रौद्योगिक उपक्रम इस अधिसूचना की चमसूची में सूचीबद्ध उद्योगों से भिन्न किसी उद्योग में लगा है ।

2 यह अधिसूचना भारत सरकार के भूतपूर्व औद्योगिक विकास, आन्तरिक व्यापार और कम्पनी काये मत्रालय (औद्योगिक विकास विभाग ) की निम्नलिखित अधिसूचनाओं में अन्तविष्ट किसी वात के अतिरिक्त है , और उनका अल्पीकरण नही करती, अर्थात--
( i ) समय -समय पर यथा-संशोधित का ० आ० सं ० 713 / आई ० डी० आर० ए ० / 29ख/ 70/1 , तारीख 19 फरवरी , 1970 , जहां तक उक्त अधिपूचना का सम्बन्ध श्रऔद्योगिक उपक्रमों के सारभूत विस्तार से है, और
