GIFT- TAX
New Delhi , the 25th February 1972
S.O. 166 ( E ) . In exercise of the powers conferred by section 46 of the Gift- tax Act, 1958 ( 18 of 1958 ) , the Central Board of Direct Taxes hereby makes the following rules further to amend the Gift- tax Rules , 1958 , namely : -
1. These rules may be called the Gift - tax ( Amendment ) Rules , 1972 .
2. In the Gift- tax Rules ,-
(a) in Form H ,-
( i ) for item 9 , the following items shall be substituted , namely :-
"9. Date on which the return of gifts , if any , for the assessment year referred to in item 2 was filed .
10. Date on which the assessee was served with a notice , if any , calling upon him to file the return of ifts for the assessment year referred to in item 2 ....
11. Relief claimed in appeal .
(ii) In Note No. 2 , for the words "one hundred rupees " , the words and figures "one hundred rupees in a case where either of the dates shown against items 9 and 10 falls before 1st April 1971 , and one hundred and twenty five rupees in any other case " shall be substituted;

(b) in Form I, -
( i ) for paragraph 6 , the following paragraphs shall be substituted , namely:-
"6. That the date on which the return of gifts for the assessment year in connec- tion with which the reference application is being made was filed is.. and the date on which the assessee was served with a notice calling upon him to file the return of gifts for that assessment year is ...
7. That the documents and copies thereof , as specified below the translation in Eng- lish of the documents , where necessary , is annexed) be forwarded to the High Court with the statement of the case . ";
( ii) in Note No. 2 , for the words " one hundred rupees " , the words and figures " one hundred rupecs in a case where either of the dates shown in paragraph 6 falls before 1st April , 1971 , and one hundred and twenty - five rupees in any other case " shall be substituted ,

नई दिल्ली , 25 फरवरी , 1972
का० प्रा० 166 ( प्र ) दानकर अधिनियम , 1958 ( 1958 का 18 ) की धारा 46 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय प्रत्यक्ष कर बोर्ड , दानकर नियम, 1958 में और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाता है , अर्थात्--
1. इन नियमों का नाम वानकर (संशोधन ) नियम, 1972 होगा ।
2. दानकर नियम में , --
(क) प्ररूप ज में --
(i ) मद 9 के स्थान पर , निम्नलिखित मदें प्रतिस्थापित की जाएंगी, अर्थात्:-
" 9. तारीख , जिसको मद 2 में निर्दिष्ट निर्धारण वर्ष के लिए दान , यदि कोई हो, की विवरणी फाइल की गई थी .....
10. तारीख , जिसको निर्धारिती को कोई ऐसी सूचना यदि कोई हो, तामील की गई थी, जिसमें उसमे मद 2 में निर्दिष्ट निर्धारण वर्ष के लिए दान की विवरणी फाइल करने के लिए कहा गया था
11. अनुतोष जिसका अपील में दावा किया गया . " ;
( ii ) टिप्पण सं ० 2 में , " एक सौ रुपए" शब्दों के स्थान पर, " किसी ऐसे मामले में जहां मद 9 और 10 के सामने दशित तारीखों में से कोई तारीख 1-4-71 से पहले पड़ती हो, एक सौ रुपए और किसी अन्य मामले में एक सौ पच्चीस रुपए" शब्द और अक प्रतिस्थापित किए जाएंगे ।
(ख ) प्ररूप न में , -
(i ) पैरा 6 के स्थान पर , निम्नलिखित पैरा प्रतिस्थापित किए जाएंगे, भ्रर्थात्:-
" 6. कि तारीख , जिसको उस निर्धारण वर्ष के लिए दान की विवरणी फाइल की गई थी जिसके बारे में निर्देश भावेदन किया गया है -है THE GAZETTE OF INDIA EXTRAORDINARY

और तारीख, जिसको निर्धारित कोई ऐसी सूचना जिसमें उससे उस निर्धा- रण वर्ष के लिए दान की विवरणी फाइल करने के लिए कहा गया था तामील की गई थी , है ।
7 कि नीचे यथा विनिर्दिष्ट दस्तावेज या उनकी प्रतियां ( दस्तावेजों का अंग्रेजी अनुवाद , जहां आवश्यक हो, उपाबद्ध है ) मामले के कथन के माथ उच्च न्यायालय को अग्रषित की आएं । " ;
( ii ) टिप्पण सं ० 2 मे, " एक सौ रुपए " शब्दों के स्थान पर, " किसी ऐसे मामले में पैरा 6 में दशित तारीखों में से कोई तारीख 1-4-1971 से पहले पड़ती हो, एक सौ रुपए और किसी अन्य मामले में एक सौ पच्चीस रुपए " शब्द और अंक प्रतिस्थापित किए जाएंगे ।
