26 T#E GAZETTE OF INDIA EXTRAORDINARY [PART II—SEC. 1J 2. The West Bengal Duty on Inter-State River Valley AuthorityElectricity Act, 1971, as in force immediately before the commencement of this Act, is hereby re-enacted
lie-enact- ment of Act 5 cf 1971.
V, V. GIRI,
President
N- D. P. NAMBOODIRIPAD, Joint Secy, to the Govt, of India.
Reasons for the Re-Enactment
The West Bengal Duty on Inter-State River Valley Authority Electri- city Act, 1971 was enacted by the President as a President's Act for levying and collecting duty on the consumption of electricity generated and sold by the Damodar Valley Corporation, an inter-State River Valley Autho- rity. The Act also validates the past collections of such duties.
2. Under clause (2) of article 357 of the Constitution, the Act will cease to operate on the expiration of the period of one year from the date on which the Proclamation made under article 356 of the Constitution in relation to the State of West Bengal was revoked, that is to say, on the 1st day of April, 1972. As the continuance of the Act is necessary in the interests of the State Revenues, the Act is being re-enacted as a President's Act.
3. In view of the urgency of the matter, it does not appear practicable to consult the Consultative Committee on West Bengal Legislation. The measure is accordingly being re-enacted without reference to the Consul- tative Committee,
