ORDER
New Delhi , the 8th March , 1972
S.O. 180 (E ) /18AA/IDRA/72.-Whereas the Central Government is satisfied from the documentary evidence in its possession-
( 1 ) that the industrial undertaking owned by Coimbatore Spinning and Weaving Co. Ltd. , Coimbatore has been closed for a period of not less than three months ; and
( in) that such closure is prejudicial to the concerned scheduled industry , namely, the cotton textilextile industry and that the financial condition of the said company and the conditiocondition of the plant and machinery of the undertaking of such company at Coimbatore are such that it is possible to restart the undertaking and such restarting is necessar v in the interests of the general public .
Now , therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 18AA of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) . the Central Government hereby authorises the Tamil Nadu Textile Corporation

(hereinafter referred to as 'the authorised person' ) to take over the management of the whole of the undertaking of Combatore Spinning and Weaving Co. , Ltd. , Coimbatore , subject to the following terms and conditions , namely :-
( 1 ) the authorised person shall comply with all directions issued from time to time by the Central Government;
( 11 ) the authorized person shall hold office for a period of five years from the date of publication of this order in the official gazette; and
( iii ) the Central Government may terminate the appointment of the authoris- ed person earlier , ifit considers it necessary to do so .
2. This Order shall have effect for a period of five years commencing from the date of its publication in the Official Gazette .

फा० प्रा ० 180 ( म) / 18 कक/ प्राई ० डी० प्रार० ए/ 72.--यतः केन्द्रीय सरकार का अपने अधिकार में प्रलेखीय साक्ष्य से समाधान हो गया है: -
( 1) कि कोयम्बटूर स्ििनग एण्ड वीविंग कं ० लि ० , कोयम्बटूर के स्वामित्व में मौद्योगिक उपक्रम तीन महीने से अन्यून समय से बन्द पड़ा है ; भौर
( 2 ) कि उसके इस प्रकार बन्द होने से सम्बन्धित अनुसूचित उद्योग अर्थात् सूती वस्त्र उद्योग पर प्रतिकूल प्रभाव पड़ता है और यह कि उक्त समधाम की वित्तीय स्थिति तथा उस समवाय के कोयम्बटूर में स्थित उपक्रम के संयंत्र तथा मशीनों की दशा ऐसी है कि उपक्रम को पुनः चालू करना संभव है और उसे इस प्रकार पुनः चालू करना जनसाधारण के हित में भ्रावश्यक है ;
अतः अम, उद्योग ( विकास तथा विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की बारा 18 कक की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार एतद्वारा तमिलनाडु बस्त्र मिगम ( जिसे एतषोपरान्त "प्राधिकृत व्यक्ति " कहा जयेगा ) को कोयम्बटूर स्पिनिंग एण्ड वीविंग कं ० लि ० , कोयम्बटूर नामक उपरोक्त संपूर्ण उपक्रम का प्रबन्ध अपने अधिकार में लेने के लिए , निम्नलिखित शर्तों के अधीन, प्राधिकृत करती है, अर्थात्:-
( 1) प्राधिकृत व्यक्ति, केन्द्रीय सरकार द्वारा समय -समय पर दिये गये निवेशों का पालन करेगा ;
( 2 ) प्राधिकृत व्यक्ति इस आदेश के सरकारी राजपत्र में प्रकाशित होने की तारीख से पांच वर्ष तक की अवधि के लिए पद धारण करेगा ; और THE GAZETTE OF INDIA EXTRAORDINARY

( 3 ) केन्द्रीय सरकार, यदि वह ऐसा करना भावश्यक समझेगी , तो उससे पूर्व भी इस प्राधिकृत व्यक्ति की नियुक्ति को समाप्त कर सकती है ।
2. यह भादेश सरकारी राजपत्त्र में इसके प्रकाशित होने की तारीख से आरम्भ होने बासी पांच वर्ष की अवधि के लिए प्रभावी रहेगा ।
