NOTIFICATION
New Delhi , the 16th March 1972
S.O. 195 (E ) /ESS.COMM/IRON AND STEEL .- In exercise of the powers confer- red by section 3 of the Essential Commodities Act . 1955 ( 10 of 1955 ) , the Cer tral Government hereby makes the following order further to amend the Iron and Steel ( Control ) Order , 1956, namely: --
1. ( 1 ) This order may be called the Iron and Steel ( Control ) Amendment Order , 1972 .
( 2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Iron and Steel ( Control ) Order , 1956 ,-
( i ) after clause 11 , the following clause shall be inserted , namely :-
" 11 A. Power to suspend supplies under Part - II-
Notwithstanding anything contained in this Part or in the conditions governing the acquisition or disposal of any categories of Iron or Steel , the Controller may order suspension of supplies of Iron or Steel forthwith to any person against whom there exists a credible information , or a reasonable suspicior , of the contravention . of any conditions laid down under this Order or of any directions issued thereunder .

Note . The provisions of this clause shall be invoked only as an interim action in order to forestall further mis - utilisation of iron or steel , and shall be followed up with further action , regard being had to the circumstances of the case." ;
( ii) in clause 19 ,-
(a) the words and figure " in accordance with the provisions of clause 18" shall be deleted;
(b) the words " or otherwise than for the purpose mentioned by him in the application for such acqulsilion" shall be inserted at the end ;
( iii ) after clause 23 , the following Clause shall be inserted , namely :-
" 23A. Power to suspend supplies under Part - III-
If the Controller is of opinion that any person has utilised any category of scrap otherwise than for the purpose for which the scrap had been acquired by him , the Controller may suspend further supplies of scrap to such person and take against kim such further action as deemed fit in the circumstances of the case ." .

का० प्रा० 195 ( श्र ) / श्रावश्यक वस्तएं / ल हा था इस्पात लोहा और इस्पात श्रावयश्क वस्तु प्रधिनियम , 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार लोहा और इस्पात ( नियंतण ) श्रादेश , 1956 में और आगे संशोधन करने के लिए एतद्वारा निम्नलिखित आदेश बनाती है, अर्थात्:-
1. ( 1 ) इस प्रदेश का नाम लोहा और इस्पात ( नियंत्रण ) संशोधन श्रादेश, 1972 होगा ।
( 2 ) यह सरकारी राजपत्र में प्रकाशन की तारीख से लागू होगा ।
2. लोहा भौर इस्पात ( नियंत्रण ) आदेश , 1956 में,
( i) खण्ड 11 के पश्चात् निम्नलिखित खण्ड स्थापित किया जायगा, अर्थात्:--
" 11 ( क ) भ.ग II क अधीन सप्लाई निलम्बित करने का अधिकार.--
इस भाग में अथवा किसी प्रकार का लोहा अथवा इस्पात लेने अथवा बेचने सम्बन्धी शतौं में किसी बात के होते हुए भी , लोहा और इस्पात नियंत्रक ऐसे किसी व्यक्ति को , जिसके विरुद्ध इस भ्रादेश के अधीन की गई व्यवस्थाओं में से किसी व्यवस्था अथवा उनके अधीन जारी किए गए निदेशों में से किसी निदेश का अतिक्रमण करने के बारे में विश्वसनीय जानकारी होने अथवा कोई युक्ति संगत संदेह होने की दशा में तत्काल लोहे अथवा इस्पात की सप्लाई निलम्बित करने का आदेश दे सकता है ।
न ट :-- इस खण्ड के उपबन्धों का लोहे अथवा इस्पात के और अधिक दुरुपयोग का पूर्वानुमान करके उसे रोकने के लिए केवल अन्तरिम कार्यवाही करने के लिए ही इस्तेमाल किया जाएगा और मामले को दृष्टिगत रखते हुए आगे कार्यवाही की जाएगी । "

(क) " ब्रड 15 के उपबंधी के शनुभार " शब्द और अंक निकाल दिए जायेंगे ;

(ख ) "" अथवा उसके द्वारा ऐसे अर्जन के लिए श्राषेवन पत्तन में उल्लिखित उद्देश्य से अन्यथा" शब्द अन्त में जोड़ दिए जायेंगे ।
( iii ) खण्ड 23 के पश्चात् निम्नलिखित खंड जोड़ दिया जाएगा, अर्थात्:-
" 23 ( क ) भाग III के अधीन सप्लाई गित करने का अधिकार-यदि नियंत्रक की राय में किसी व्यक्ति ने किसी प्रकार के स्क्रैप का उस काम से जिसके लिए उसने स्क्रैप लिया था भिन्न किसी काम के लिए उपयोग किया है, तो नियंत्तक ऐसे व्यक्ति को स्क्रैप की और सप्लाई निलम्बित कर सकता है और मामले की स्थिति को देखते हुए उसके विरुद्ध ऐसी कार्यवाही , जिसे वह उचित समझे कर सकता है । "
