SUBJECT .- Export effort by units engaged in priority or other industries during the calendar year 1971 or the financial year 1971-72- Production of evidence regarding .
No. 49 - ITC ( PN ) /72.-Attention is invited to the policy containedin paras 18-21 In Section I of the Import Trade Control Policy ( Red Book- Vol . I) for the period April - March , 1973 according to which preference will be given in the matteratter of Imports of raw materials and components in the case of actual users exporting 10 per cent or more of their production during the calendar year 1971 or financial year 1971-72 .
2. For the purpose of calculating the export performance , the following exports will also be taken into account , apart from the direct exports made by the actual user concerned-
( i ) Supplies of materials at international prices under the arrangement approved by the Government .

( ii ) Supplies made against IBRD / IDA Aided Projects in India .
( iii ) Exports made through eligible Export Houses .
( iv) Supplies made by Indian firms in India under the Aid programmes of United Nations and other Multinational agencies at International prices and paid for in Free Foreign Exchange .
3. Accordingly , industrial units both in the large and small scale sector includ- ing public sector industrial undertakings engaged in priority or other industries should produce evidence of their export performance during the calendar year 1971 or financial year 1971-72 .
4. In support of their export performance in relation to their production during the calendar year 1971 or the financial year 1971-72 the actual users should sub- mit a statement in the proforma annexed to this Public Notice after getting all the pages thereof duly certified and stamped by Chartered Accountant ог Cost Accountant in practice who is not a partner or an employee of the concerned ex- porting unit or its associates .
5. The evidence in terms of this Public Notice should be produced by units engaged in priority industries and non -priority industries ( where the end -products are covered by the import policy for Registered Exporters ) .
6. The required evidence should be produced to the Chief Controller of Imports and Exports , New Delhi ( Imports Policy Cell ) on or before the 15th May , 1972 .
7. The units engaged in the undermentioned industries need not furnish Infor- mation required in terms of this Public Notice :-
( 1 ) Fertilizers ;
( if ) Pesticides ;
( iii ) Industrial and Mining Machinery ;
( iv) Cement ;
( v) Tea ;
( vi ) Jute Textiles :
(vil) Coffee;
( viii ) Sugar ;
( ix) Cotton Textiles ;
(x) Coir;
(x1 ) Cashew; and
( xii) Unmanufactured tobacco .
8. The documentary evidence indicated in paragraph 4 above should be produced separately in respect of each end -product or group of end - products for which the unit has to apply for separate licences to import raw materials and components under the import policy .
9. The industrial units in the large scale sector engaged in the industries covered by Appendix 10 to the Red Book ( Vol . 1 ) for April 1972 - March 1973 and which have been in production for a period of lessess than five years as on 1st January , 1972 , should also produce alongwith the required evidence a certificate from the sponsoring authority concerned in support of their having been in production for less than five years .
10. In the case of industrial units which fall to produce the evidence indicated in this Public Notice ,it wil lbe held that they do not consider themselves eligible to any facilities that may be provided under the import policy for April 1972- March 1973 to the units having export performance to the extent as may be specified .

5. Total c.i.f. value of imported raw materials and components ( not spare parts ) consumed by the unit in the manufacture of end - product mentioned against ( 2 ) above . This should also include consumption of imported items of Iron and Steel.
6. Total c.i.f. value of import licences obtained by the unit under the import policy for Registered Exporters during the calendar year 1971 or the financial year 1971-72 against the exports of the end - product mentioned at ( 2 ) above .

विषय पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान प्राथमिकता प्राप्त या अन्य उद्योगों में लग हुए एककों द्वारा निर्यात उपलब्धि- उसके सम्बन्ध में साक्ष्य का प्रस्तुतीकरण ।
संख्या: 49 प्राई ० टी० सी० पी ० एम ० ) / 71 अप्रैल -मार्च , 1973 के लिए आयात व्यापार नियंत्रण नीति ( रेड बुक वा ० 1 ) के भाग 1 में कांडिका 18-21 में निहित श्रायात नीति की ओर ध्यान आकृष्ट किया जाता है जिसके अनुसार , कच्चे माल और संघटकों के सम्बन्ध में उन वास्तविक उपयोक्ताओं के मामले में जो पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान अपने उत्पादन का 10 प्रतिशत या इससे अधिक का निर्यात कर रहे हों , वरीयता दी जाएगी ।
2. निष्पादन का परिकलन करने के लिए संबंधित वास्तविक उपयोक्ताओं द्वारा किए गए प्रत्यक्ष निर्यात के अतिरिक्त निम्नलिखित निर्यातों को भी इसके हिसाब में रखा आएगा:--
( 1 ) मरकार द्वारा स्वीकृत व्यवस्था मे अन्तर्गत अन्तर्राष्ट्रीय कीमतों पर वस्तुओं के संभरण ।
( 2 ) भारत में आई ० वी आर ० डी/ आई ० ए ० डी से सहायता प्राप्त परियोजनाओं के मद्दे किए गए संभरण ।
( 3) उपयुक्त निर्यात सदनों के माध्यम से किए गए निर्यात ।
( 4) संयुक्त राष्ट्र संघ के सहायता कार्यक्रम तथा अन्तर्राष्ट्रीय कीमतों पर अन्य विधि राष्ट्रीय अभिकरणों के अन्तर्गत भारत में भारतीय फर्मों द्वारा किए गए निर्यातों और जिनका भुगतान स्वतंत्र विषेशी विनियम के लिएकिया गया था ।
3. तदनुसरा , वृहत्त तथा लघु क्षेत्र के दोनों प्रकार के श्रौद्योगिक एकक जिन में सार्वजनिक क्षेत्र श्रौद्योगिक प्रक्रम भी शामिल है जो प्राथमिकता प्राप्त या अन्य उद्योगों में लगे हुए हैं, उन्हेंपंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान के अपने निर्यात निष्पादन का सांक्ष्य प्रस्तुत करना चाहिए ।
4. पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान अपने उत्पादन से सम्बन्धित अपने निर्यात निप्पादन के समर्थन में वास्तविक उपयोक्ताओं को इस सार्वजनिक सूचना में अनु- बन्धित प्रपत्त में उसके सभी पृष्ठों को ऐसे व्यवासयी सनदी लेखापाल से या लागत लेखापाल से जो सम्बन्धित निर्यात करने वाले एककों या इससे सम्बन्धित संगठनों में भागीदार न हो या उसमें कर्म- चारी न हो विधिवत् साक्ष्यांकित कराकर तथा स्टैम्प लगवा कर एक विवरण प्रस्तुत करना चाहिए ।

5. इस सार्वजनिक सूचना की शर्तों के अनुसार प्राथमिकता प्राप्त उद्योग और अप्राथमिकता प्राप्त उद्योगों ( जहां पंजीकृत निर्यातकों के लिए आयात नीति के अन्तर्गत अन्तिम उत्पाद आते हों ) में लगे हुए एककों द्वारा साध्य प्रस्तुत करना चाहिए ।
6. अपेक्षित साक्ष्य को मुख्य नियंत्रक, आयात- निर्यात, नई दिल्ली ( श्रयात नीति सेल ) को 15 मई, 1972 को या उसके पूर्व प्रस्तुत करना चाहिए ।
7. नीचे उल्लखित उद्योगों में लगे हुए एककों को इस सार्वजनिक सूचना की शर्तों के अनुसार अपेक्षित सूचना भेजने की जरूरत नहीं है :-
(1) उर्वरक;
( 2) कीटनाशक दवाई;
( 3) औद्योगिक तथा खान मशीन;
(4) सीमेंट;
(5) चाय;
( 6 ) पाट वस्त्र;
( 7) काफी;
(8) .जीनी;
( 9) सूती वस्त्र;
( 10) नारियल जटा;
(11 ) काजू; तथा
( 12 ) अनिर्मित तम्बाकू ।
8. उपर्युक्त कंडिका 4 में संकेतित प्रलेखीय साक्ष्य को प्रत्येक अन्तिम उत्पाद या अन्तिम उत्पाद वर्ग के सम्बन्ध में जिसके लिए एकक को आयात नीति के अन्तर्गत कच्चे माल तथा संघटकों के मायाप्त के लिए अलग अलग लाइसेंसों के लिए आवेदन करना है , अलग अलग प्रस्तुत किया जाना चाहिए ।
9. वृहत् उद्योगों के उन औद्योगिक एरुकों के जो भप्रैल, 72 ; -मार्च, 73 के लिए बुक ( वा० 1 ) के अनुबन्ध 10 में श्राने वाले उद्योगों में लग हुए हैं और जिन्हें जनवरी , 72 को 5 वर्षों से कम की अवधि के लिए उत्पादन में लगाए गए है , उन्ह भी साक्ष्य के साथ सम्बद्ध प्रायोजित प्राधिकारी से प्राप्त उनकी पंच वर्षों से कम के लिए उत्पादन के समर्थन में एक प्रमाण-पत्नत्र प्रस्तुत करना चाहिए ।

10. उन श्रौद्योगिक एककों के मामले में जो इस सार्वजनिक सूचना में संकेतिक साक्ष्य को प्रस्तुत करने में असमर्थ हों तो यह समझा जाएगा कि वे अपने आपको ऐसे किसी सुविधा के लिए उपयुक्त नहीं समझते जो अप्रैल , 72-मार्च , 73 के लिए आयात नीति के अन्तर्गत उस सीमा तक जिसका उल्लेख किया जा सकता है , निर्यात निष्पादन करने वाले एककों को दी जा सकती है ।

अनुबंध ( 1 )
उत्पादन उपभोग , पंजीकृत निर्यातकों के लिए श्रायात नीति के अधीन जारी किए गए आयात लाइसेंसों के ब्यौरों और निर्यातों के जहाज पर्यन्त निशुल्क मूल्य को प्रदर्शित करने वाला विवरण पत्र ।
1 ( 1 ) एकक का नाम और पता
( 2 ) तकनीकी विकास महानिदेशालय एकक या लघु- उद्योग एकक ।
2. ( 1 ) निर्माण किया गया अन्तिम उत्पाद ।
( 2 ) प्राथमिकता प्राप्त या अप्राथमिकता प्राप्त ।
( 3 ) उद्योग का नाम जिसके अन्तर्गत अन्तिम उत्पाद शामिल है ।
( 4 ) अन्तिम उत्पाद की क्रम संख्या जिसके अन्तर्गत यह रैड बुक ( वा ० 2 ) में वर्गीकृत है ।
( 5 ) क्या अतिम - उत्पाद ( उपर्युक्त 2 के सामने उल्लखित ) के निर्माण के लिए एक समेकित आयात लाइसेंस प्राप्त किया जा रहा है अथवा अलग अलग लाइसेंस प्राप्त किए आ रहे हैं ।
3. ( क ) पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान निर्माण किए गए उपर्युक्त ( 2 ) के सामने उल्लखित अंतिम उत्पाद के उत्पादन का बही -मूल्य ( श्रर्थात् उत्पाद शुल्क और लाभ को छोड़कर उत्पादन की वास्तविक लागत । ) (ख ) भात्ना में उत्पादन ।
4. पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान एककों द्वारा निर्माण किए गए और निर्यात किए गए माल के संबंध में निर्यातों का कुल जहाज पर्यन्त निशुल्क मूल्य के निम्नलिखित अनुसार अलग से निर्दिष्ट करना है :-
(क) एकक के अपने नाम में किया गया निर्यात ।
(ख ) पात्न निर्यात सदन के माध्यम से किया गया निर्यात ।
(ग ) व्यापारी निर्यातक के माध्यम से किया गया निर्यात ।
( ष ) सरकार द्वारा अनुमोदित व्यवस्थाओं के अधीन रियायती कीमतों पर संभरित किए गए और दूसरों द्वारा निर्मित तैयार उत्पाद के रूप में निर्यात किए गए संघटक या पुर्जे या कच्चा माल ।
5. उपर्युक्त ( 2 ) के सामने उल्लखित अंतिम उत्पाद के निर्माण में लगे हुए एकक द्वारा अपभोग किए गए आयातित कच्चे माल और संघटकों ( फालतू पुजें नहीं ) का कुल लागत -बीमा-भाड़ा मूल्य । इसमें लोहा तथा इस्पात की आयातित भदों की खपत भी शामिल होनी चाहिए ।

6. पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान पंजीकृत निर्यातकों के लिए भायात नीति के अधीन उपर्युक्त ( 2 ) में उल्लखित अन्तिम उत्पाद के निर्यात के बदले एकक द्वारा प्राप्स किए गए आयात लाइसेंसों का कुल लागत -बीमा भाड़ा मूल्य ।
7. पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान पंजीकृत निर्यातकों के लिए मायात नीति के अधीन प्राप्त किए गए आयात

1 ) एकक के अपने नाम में किया गया निर्यात

( 2 ) पान निर्यात सदन के माध्यम से किया गया निर्यात ( ब्यौरे संलग्न प्रपन में प्रस्तुत करने हैं ) -अनुबन्ध- 2
3 ) ( क ) ब्यापारी निर्यातकों के माध्यम से किया गया निर्यात,
(
(ख ) ब्यापारी निर्यातकों से प्राप्त किया गया नामांकन और
( 4 ) ( क ) सरकार द्वारा अनुमोदित व्यवस्थाओं के अधीन रियायती कीमतों पर संभरित किए गए और दूसरों द्वारा निर्मित तैयार उत्पाद के रूप में निर्यात किए गए संघटक या पुर्जे या कच्चा माल ।
(ख ) निर्यातकों से प्राप्त किया गया नामांकन ।

9. मुख्य नियंत्रक , आयात - निर्यात , नई दिल्ली द्वारा आवेदक को जारी किए गए निर्यात निष्पादन के प्रमाणपत्र की सं ० और दिनांक तथा लाइसेंस अवधि 1971-72 में किए गए निर्यात की प्रतिशतता ।
मैं एतद्वारा घोषणा करता है कि इस विवरण में दिए गए ब्यौरे सही हैं और उसमें कुछ भी छुपाया नहीं गया है या दबा कर रखा नहीं गया है । मुझे ज्ञात है कि यदि कोई भी सूचना गलत पायी जाती है तो इसके लिये मेरे विरुद्ध की जाने वाली किसी अन्य कार्यवाही का पक्ष लिए बिना , मुझे अपने दावे से बंचित कर दिया जाएगा ।

टिप्पणी:-विवरण पत्र के साथ सम्बद्ध पात्र निर्यात सदन से एक घोषणा पत्र इस सम्बन्ध में संलग्न करना चाहिये कि पंचांग वर्ष 1971 या वित्तीय वर्ष 1971-72 के दौरान उपर्युक्त ( 2 ) पर उल्लिखित माल रुपये ( जहाज पर्यन्त निःशुल्क ) मूल्य के लिये उनके माध्यम से निर्यात किया गया है
